ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
UI[IAH PROVIDING FOR THE OPERATION OF BINGO
GAMES BY NON-PROFIT CIIARITABLE CORPORATIONS
The City Council of the City of Ukiah does Ordain as
follows: --
Section 1. Chapter 3a is added to Division 2 of the Ukiah City
Code to read as follows:
Chapter 3a - Bingo For Charity,'
Article 1 -Authority
Section 2430 - Authority:
The authority for this chapter is Article 4, Section 19
of the California State Constitution and Section 326.5 of the
California Penal Code.
Article 2 - Regulations
Section 2435 - Regulations
The following subsections constitute the regulations which
govern the operation of bingo for charity:
a) No minors shall be allowed to participate in any bingo
game.
b) A nonprofit, charitable organization shall conduct a
bingo game only on property owned or leased by it, and which
property is used by such organization for an office or for per-
formance of the purposes for which the organization is organized.
c) All bingo games shall be open to the public, not just
to the members of the nonprofit charitable organization.
d) A bingo game shall be operated and staffed only by
members of the non-profit charitable organization which organized
it. Such members shall not receive a profit, wage, or salary
from any bingo game. Only the organization authorized to conduct
a bingo game shall operate such game, or participate in the pro-
motion, supervision or any other phase of such game.
e) No individual corporation, partnership, or other
legal entity except the organization authorized to conduct a bingo
game shall hold a financial interest in the conduct of such bingo
game.
f) All profits derived from a bingo game shall be kept in
a special fund or account and shall not be commingled with any
other fund or account.
g) No person shall be allowed to participate in a bingo
game, unless the person is physically present at the time and
place in which the bingo game is being conducted.

Section 2436 - License
Each non-profit, charitable organization which wishes to
conduct bingo games shall pay a license fee established by resolution
of the City Council, said fee not to exceed the actual cost of
issuing such license.
Article 3 - Penalty
Section 2440 - Penalties
It is a misdemeanor for any person to receive a profit, wage,
or salary from any bingo game authorized by this ordinance. A
violation of this chapter shall be punishable by a fine not to
exceed Ten Thousand Dollars ($10,000), which fine shall be deposited
in the general fund of the City.
Section 2. This ordinance shall be published as required by law in
a newspaper of general circulation published in the City of Ukiah.
Section 3. This ordinance shall become effective 30 days after
its adoption.

following roll call vote:
