HomeMy WebLinkAbout635 Condo Development Regulations1~~ ORDINANCE N0. 635 AN ORDINANCE OF THE CITY OF UKIAH, ADDING ARTICLE 12a TO CHAPTER 2, DIVISION 9, OF THE UKIAH CITY CODE, THEREFORE PROVIDING CONDOMINIUM DEVELOPMENT REGULATIONS The City Council of the City of Ukiah does ordain as follows: Section 1. Article 12a is added to Chapter 2 of Division 9 of the Ukiah City Code and reads as follows: Article 12a - Condominium Developments Section 9155 - Development Standards. Condominium developments, either new structures or the conversion of existing structures originally built for sale or lease, shall be permitted in any district upon the securing of a use permit, provided that following standards are met: (a) Use, height, yard, and other regulations. Regulations governing the use, building height, required setbacks, building separation, signs, off-street parking, and other explicit regulations, where not governed by the provisions of this article, shall be those of the district within which the development is located. (b) Classification. Residential condominiums shall be classified as follows: (1) Horizontal condominiums shall be buildings in which single- family units are constructed, either as separate structures or as self- contained units, within a common structure having individual entrances and utility connections, no opening in any wall common to two (2) or more units, and no part of any unit on top of any part of any other unit. (2) Vertical condominiums shall be any duplex, triplex, or apart- ment house, as defined in the Uniform Building Code of the City (Chapter 1, Div. 3) in which condominium any part of any dwelling unit is on top of any part of any other dwelling unit. (c) Density. The maximum allowable density in any residential condominium shall be: (1) For horizontal condominiums, one unit for every 6,000 square feet of net area; and (a) For vertical condominiums: (i) One unit for every 6,000 square feet of net area if structures average two (2) stories or less; (ii) One unit for every 3600 square feet of net area if structures average between two (2) and three (3) stories; and (iii) One unit for every 2000 square feet of net area if structures average three (3) stories or more. For the purposes of this section, "net area" shall mean the total area of the development site, including driveways, but not including public streets, alleys, or other public areas; and "driveway" shall mean any accessway, from public or private streets, the primary function of which is to provide access to parking facilities provided on the site. (d) Outdoor common area. In all residential condominiums the outdoor common area, exclusive of all structures, shall contain an area having a : ~ i.? slope of not more than ten (10%) percent and a minimum area per unit as follows: (1) For horizontal condominiums, 1000 square feet per unit; and (2) For vertical condominiums: (i) Where structures average two (2) stories or less, 750 square feet per unit; (ii) Where structures average between two (2) and three (3) stories, 650 square feet per unit; and (iii) Where structures average three (3) stories or more, 550 square feet per unit. (e) Gross area required. No condominium shall be built unless the gross land area contains at least 6000 square feet. (f) Rights-of-way. The rights-of-way, and improvements thereon, for all streets, whether to be public or private, shall be approved by the Commission. (g) Separation from other structures. The main structures of any condominium in which residential uses are proposed in any residential zone shall be separated from any other main structure on the same lot by at least ten (10') feet. (h) Parking. There shall be provided one (1) non-exclusive guest parking space for each unit in the project. Fifty (50) per cent of these spaces may be provided along public streets contiguous with the project when related to the dwelling units to be served and when so approved by the Planning Commission. In addition, on-site covered parking spaces shall be provided within fifty (50) feet of each dwelling unit as follows: (1) For units with five (5) or more bedrooms, two (2) covered spaces. (2) For units with three (3) or four (4) bedrooms, one and one- half (1 z) covered spaces. (3) For units with up to two (2) bedrooms, one (1) covered space. (i) Storage. There shall be provided a minimum covered storage area of forty (40) square feet for each dwelling unit for storage of bicycles, patio furniture, garden tools, etc. (j) Boat and trailer storage. All boats and travel trailers shall be stored only within areas specifically designated for such storage on the approved plans. Said area shall be screened by fencing and/or landscaping. Fifty (50) square feet of area shall be provided for each dwelling unit. (k) Occupancy type. Condominiums shall be Group I Occupancy as defined in the Uniform Building Code (chapter 1, Division 3 of this code). Section 9156 - Use permits. Applications for use permits for condominium developments shall be accompanied by the following: (a) A topographic map to a workable scale, showing the site in relation to surrounding property, existing roads, and other existing improvements; (b) A site plan, showing proposed improvements, locations of buildLngs on the ground, orientation of buildings, utilities, public services, public facilities, 4 \. 1, , y s ~ i i ~! streets and alleys, landscaping, and the boundaries of the project; (c) Drawings showing how airspace is to be divided within the condominium. (d) A copy of the tentative subdivision map, if required. {e) Floor plans and elevations of all proposed buildings and structures; (f) A copy of the declaration of restrictions and proposed management arrangement relating to the project, as required by the provisions of Section 1355 of the Civil Code of the State; and (g) Any information deemed necessary or desirable in assisting the Commission in its determinations for apporval of the use permit and the conditions thereof. Section 2. Effective Date: This ordinance shall be effective 30 days after adoption and shall be published once in the Ukiah Daily Journal, a newspaper o£ general circulation published in said City.
