RESOLUTION NO. 92-23
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
APPROVING TENTATIVE SUBDIVISION MAP NO. 92-39, SONOMA VALLEY HOMES
WHEREAS, on September 2, 1992 the City Council introduced Ordinance
No. 930 approving Planned Development No. 92-40 (which encompasses the
property of this subdivision); and
WHEREAS, the Director of Public Works reports that the City of Ukiah
has sufficient capacity to handle wastewater for this project without
violation of Water Quality Control Board Standards; and
WHEREAS, on August 26, 1992, the Planning Commission approved the
subject Tentative Subdivision Map with conditions; and
WHEREAS, a Negative Declaration of Environmental Impact for Planned
Development No. 92-40, and a 38--lot subdivision, No. 92-39, was adopted by
the City Council in conjunction with approval of the Planned Development
on September 2, 1992.
NOW, THEREFORE, BE IT RESOLVED that Tentative Subdivision Map
No. 92-39 for Sonoma Valley Homes (attached as Exhibit "A"), is approved
conditioned upon compliance with all applicable State Statutes, local
ordinances, and the following special conditions:
1. Standard Conditions 1 - 23.
2. Hours of construction are limited to 7:00 a.m. to dark, Monday
through Saturday.
3. Fire hydrants to be provided by developer to the approval of the
Fire Marshal.
4. Street lights to be provided by developer to the approval of the
City Electric Department.
5. Dust control measures be instituted during construction.
6. Developer shall purchase, install, and maintain for one (1) year
City specified street trees to be planted at locations, at least
one per lot frontage, determined by the City throughout the
subdivision according to a Street Tree Program approved by City
Staff.
7. School impact fees be paid to the Ukiah Unified School District
pursuant to adopted procedures.

8. Ail units constructed in the subdivision are required to have
installed low-flow showerheads and faucets and ultra low-flush
toilets.
9. Uses allowed or permitted: Single family residential uses and
accessory uses as allowed in Ukiah City Code Section 9016.
10. Building heights: Maximum of 30 feet.
11. Building setback and yards: Setbacks and yards shall be as
defined on the Subdivision Map.
12. Maximum number of dwelling units: 38.
13. Building site area required: There shall be 38 parcels with the
size and configuration as defined on the Subdivision Map.
1~. Required parking: Minimum parking area and required off-street
parking requirements shall be as prescribed in Ukiah City Code
Section 9190 et seq.
15. Ail regulations not specified herein shall be as prescribed in
the Ukiah City Code.
16. Prune the existing tree at Mulberry and Washington intersection
to provide sufficient site distance to the east.
17. Paint red curb return and red curb 65 feet easterly and 50 feet
westerly on the north side of Washington Avenue at this
intersection, with the concurrence of the Traffic Engineering
Committee.
18. Paint red curb returns at the south side of Observatory at the
Mulberry-Observatory intersection, with the concurrence of the
Traffic Engineering Committee.
19. Mulberry Street shall have a stop sign at the
Mulberry-Washington intersection.
20. Paint stop bars and striping per City standards at
Mulberry-Washington intersection.
21. Department of Fish and Game approval will be required for any
improvements affecting the creek.
22. Common open space areas identified on the subdivision map shall
remain as such and be maintained by the subdivision homeowners
association and shall be credited for a portion of the park
dedication requirement.
23. Payment of in-lieu park fees pursuant to City Code shall be made
to meet the remainder of the park dedication requirement.
24. Parking not be allowed on Creekside Court except for the
cul-de-sac area. NO PARKING areas must have curbs painted red
and NO PARKING FIRE LANE signs posted.
25. The driveway serving the eight units at the north end of the
subdivision must be designated as a fire lane. Red curbs and
approved signing for identification of same shall be provided.
The clear width of the driveway shall be 20 feet.
26. The project CC&R's shall preclude rear fences over three feet in
height for those parcels backing onto Doolan Creek and prohibit
repair or storage of vehicles within the front setback.
27. The project shall provide a housing program which will ensure
the development is available for first time homeowners, equity
caps are set, retention in the affordability pool is
established, units are affordable to low and/or moderate income
persons, and a homeowners association is created. The housing
program must be approved by the City Council prior to acceptance

map, upon the recommendation of the Redevelopment Low and
Moderate Income Housing Advisory Committee.
Circulation to the northern parcels shall be reevaluated and one
unit be removed if determined necessary for safety purposes
subject to approval by the City Council prior to acceptance of
the final map.
BE IT FURTHER RESOLVED that this resolution shall become valid only
after the effective date of Ordinance 930, adopting Planned Development
No. 92-40, Sonoma Valley Homes.
PASSED AND ADOPTED this 2nd day of September, 1992, by the following
roll call vote:
AYES: Councilmembers McMichael, Wattenburger, Shoemaker, and
Mayor schneiter
NOES: None.
ABSENT: Councilmember Malone
