HomeMy WebLinkAbout606 Adding Amending Sections of Ch. 5~(~ ORDINANCE N0. 606 ORDINANCE OF THE CITY OF UKIAH ADDING, & AMENDING SECTIONS OF CHAPTER 5, DIVISION 5 OF THE UKIAH CITY CODE The City Council of the City of Ukiah does ORDAIN as follows: SECTION 1. Section 4461 (b) of the Ukiah City Code is amended to read: Section 4461 (b) - The Contractor shall charge rates not in excess of those rates established by action of the Ukiah City Council. Con- tractor shall render bills for the services performed and is hereby expressly authorized to render quarterly bills, payable in advance by the user. The Contractor shall make appropriate refunds for unused periods of prepaid service. Failure to pay said charges on or before the end of the service period covered by a bill will result in a penalty assessment equal to 10% of the amount of said bill or the amount of $2.00 whichever is greater. Said penalty to be added to the bill. SECTION 2. Section 4474 of the Ukiah City Code is amended in the following manner: Section 4474 - The word "lien" in the last sentence of the afore- mentioned section is changed to read "special assessment". SECTION 3. Section 4475 of the Ukiah City Code is amended and added to in the following manner: Section 4475 - In the title of said section the word "lien" is amended to read "special assessment". Said word "lien" is further stricken from the third paragraph of said section and in its place is substituted the term "special assessment". Section 4475 is further amended in that the three paragraphs of said present section shall be made one paragraph and designated Section 4475(a). Section 4475 is added to by creating paragraphs (b), (c), and (d). Said paragraphs to read as follows: Section 4475 (b) - The Contractor, between the first day of August and the first day of September of each year, shall present to the City Manager a list which sets forth a legal description of the real estate upon which the charges herein provided for have not been paid during the previous fiscal year (to wit, from the first day of July of the preceeding year to the 30th day of June immediately preceeding the presentation of the report), the amount of said charges, and the owners thereof. Said list shall be verified by an oath of the Con- tractor substantially in the following form, to wit: STATE OF CALIFORNIA) ss. COUNTY OF MENDOCINO) I, the garbage contractor of the City of Ukiah do hereby swear that the attached list is a true and accurate list of the descriptions of real properties within said city, and owners thereof, the occupancies of which are in default in the payme~ of garbage collection charges for a period within the preceeding fiscal ~) ~ year, to wit from July 1, 19 to June 30, 19 That the amounts in arrears and unpaid are set forth opposite each occupancy. Subscribed and sworn to before me this day of August, 19 Contractor Notary Publ Section 4475 (c) - Whereupon, the City Manager shall immediately cause to be notified the concerned parties of the amount delinquent and unpaid, the amount of the penalty, collection costs and costs of abatement, by directing a letter to the owner and/or occupant of the property at the address shown on the latest tax roll. Such notice shall further declare that the City Council shall at its next regular meeting review and approve as an assessment against the property the amount delinquent and unpaid, the amount of the penalty, collection costs and costs of abatement. If the total assessment determined and approved by the City Council is not paid within ten (10) days after such determination, then and in that event, there shall be recorded in the office of the County Recorder, a statement of the total balance due together with the legal description of the property affected. From and after the date of such recordation, the balance due shall be a special assessment against the real property. The assessment shall be collected at the same time and in the same manner as are county taxes and shall be subject to the same penalties and to the same procedure and sale in case of delinquency as provided for ordinary county taxes. All laws applicable to the levy, collection, and enforcement of county taxes shall be applicable to such special assessment. Section 4475 (d) - The Contractor shall be fully reimbursed in the amount due him on an unpaid account less ten (10) per cent when the assessed amount is recovered. SECTION 4. Section 4476 of the Ukiah City Code is herein referred to by reference as if fully set forth and incorporated by said reference. SECTION 5. Publication: The Clerk is directed to cause this ordinance to be published as provided by law in the Ukiah Daily Journal, a newspaper of general circulation, published and printed in the City of Ukiah. SECTION 6. Effective Date: This ordinance shall become effective thirty days after its adoption.
