HomeMy WebLinkAbout592 Sales & Use Tax Rate1~ ORDINANCE NO. 592 ORDINPNCE OF THE CITY OF UKIAH REPEALING ORDINANCE N0. 588; AMENDING SECTIONS 1701 (c), 1710 and 1720 of THE UKIAH CITY CODE TO CHANGE THE RATE IMPOSED FOR SALES AND USE TPXES TO .922/0; ADOPTED PS URGENCY MEASURE. The City Council of the City of Ukiah does hereby ORDAIN: SECTION 1. REPEALER OF ORDINANCE N0. 588. Ordinance No. 588 of the City of Ukiah is hereby repealed. SECTION 2. Amending Subsection (c) of Section 1701 of the Ukiah City Code. Section 1701 Subsection (c) of the Ukiah City Code is amended to read: "Section 1701 - Purposes: (c) To adopt a sales and use tax ordinance which imposes a .922 Per cent tax and provides a measure therefore that can be administered and collected by the State Board of Equalization in a manner that adapts itself as fully as practical to, and requires the least possible deviation from, the existing statutory and administrative procedures followed by the State Board of Equalization in administering and collecting the California State Sales and Use Taxes; (Ordinance No. 511, Section 2, as amended by Ordinance No. 592, Sec. 2, adopted 1967). SECTION 3• Amending Section 1710 of the Ukiah City Code. Section 1710 of the Ukiah City Code is hereby amended to read: "Section 1710 - Tax imposed: For the privilege of selling tangible personal property at retail a tax is hereby imposed upon all retailers in the City at the rate of .922 per cent (.92'-z%) of the gross receipts of the retailer from the sale of all tangible personal property sold at retail in the City of Ukiah on and after the operative date of this ordinance. (Ordinance No. 511, Section 4 (a) (1) as amended by Ordinance No. 592, Section 3, adopted 1967.) -~ 1J SECTION 4, Amending Section 1720 of the Ukiah City Code. Section 1720 of the Ukiah City Code is hereby amended to read: "Section 1720 - Imposition of tax: An excise tax is hereby imposed on the storage, use or other consumption in the City of Ukiah of tangible personal property purchased from any retailer on or after the operative date of this ordinance, for storage, use or other consumption in the City at the rate of .922 per cent (.922/0) of the sales price of the property. The sales price shalt include delivery charges when such charges are subject to State sales or use tax regardless of the place to which delivery is made. (Ordinance No. 511, Section 5 (a), as amended by Ordinance No. 592, Section 4, adopted 1967). SECTION S. Tax and urgency measure; effective date; publication: This ordinance has been introduced at a regular meeting and read in full at the time of its introduction. It is adopted as a tax and urgency ordinance pursuant to Sections 36934 and 36937 the Government Code of California and it shall become effective immediately upon adoption. This ordinance relates to taxes For the usual and current expenses of the City of Ukiah. A declaration of facts of urgency is as follows: There has for several months existed a controversy between the City and the County of Mendocino regarding the division, if any, of sales tax proceeds. This controversy has created doubt and uncertainly in the minds of many citizens, and if allowed to continue could cause drastic losses of sales tax revenue to both the City and the County. In order to reach an amicable compromise, the City and County representatives are agreeable to adjusting the present formula as set forth herein. That unless repealed by urgency ordinance, Ordinance No. 588, which establishes a division contrary to the compromise will take effect on July I, 1967. It is in the best interest of both City and County in order to preserve amicable relations between them that this ordinance, No. 592, take effect as a compromise measure on July 1, 1967. This ordinance shall become operative as a tax on July I, 1967. It shall be published as provided by law in the Ukiah Daily Journal.
