HomeMy WebLinkAbout589 Codifying Requirement for Soil Report11 ORDINANCE N0. 589 ORDINANCE OF THE CITY OF UKIAH CODIFYING REQUIREMENT FOR SOIL REPORT IN SUBDIVISIONS ADOPTED BY ORDINANCE N0. 583. The City Council of the City of Ukiah does hereby ORDAIN: SECTION I. CODIFICATION OF SOIL REPORT REQUIREMENT CONTAINED IN ORDINANCE N0. 583• The following provisions consisting of provisions of Ordinance No. 583 are hereby readopted and continued in code form and are included in the Ukiah City Code as Article 9 of Chapter 1 of Division 9 as follows: P.RTICLE 9 - SOIL REPORTS. Section 8140 - Preliminary soil report required; waiver: A preliminary soil report prepared by a civil engineer who is registered by the State, based upon adequate test borings or excavations, shall be required in every subdivision as defined in Section 8025 of the Ukiah City Code or in Sections 11535 and 11535.1 of the Business and Professions Code of California. The preliminary soil report may be waived if the Building Inspector shall determine that, due to the knowledge such department has as to the soil qualities of the soil of the --. subdivisions or lot, no preliminary analysis is necessary. (Ordinance No. 583, adopted 1966, as codified by Ordinance No. 589, Section I, adopted in 1967). Ed. Note: Adoption of an ordinance requiring a preliminary soil report is required pursuant to sections 17953 - 17957 of the Health and Safety Code (ch. 1001, P..B. 680, Stats. 1965). Section P,141 - Soil investigation by lot; necessity; preparation; recommendations: If the preliminary soil report indicates the presence of critically expansive soils or other soil problems which, if not corrected, would lead to structural defects, the Building Inspector shall require a soil investigation of each lot in the subdivision. The soil investigation shall be prepared by a civil engineer who is registered in this state. It shall recommend corrective action which is likely to prevent structural damage to each building proposed to be constructed on the expansive soil. (Ordinance No. 583, adopted 1966, as codified by Ordinance No. 589, Section 1, adopted 1967). Section 8142 - Approval; building permit conditions; appeal: The Building Inspector shall approve the soil investigation if he determines that the recommended action is likely to prevent structural damage to each buildinc, to be constructed. As a condi- tion to the building permit, the Building Inspector shall require that the construction and the approved recommended action of each building be incorporated. Appeal from such determination shall be to the local appeals board. ~ :.~. , (Ordinance No. 583, adopted 1966, as codified by Ordinance No. 589, Section 1, adopted 1867). Section 8143 - Non-liability of public agency or employee: The city is not liable for any injury which arises out of any act or omission of the city; or other enforcement agency, or a public employee or any other person under Section 17953, 17954, or 17955. (Ordinance No. 583, adopted 1966, as codified by Ordinance No. 589, Section 1, adopted 1867). Section 8144 -Authority for adoption; declaration of purposes: This article is adopted pursuant to the authority of Ch. 4, Part 1.5, Division 13 of the Health and Safety Code as a pro- cedure equal to or more restrictive than the procedure specified in Sections 17853, 17954, 17955, 17956 and 1785? of the Health and Safety Code. It shall apply to all subdivisions described in Section 8140 whether or not they relate to buildings to be used for human habitation. (Ordinance No. 583, adopted 1966, as codified by Ordinance No. 589, Section 1, adopted 1967). SECTION 2. PUBLICATION; EFFECTIVE DATE This ordinance shall be published as provided by law in the Ukiah Daily Journal. It shall be effective 30 days after its adoption.
