RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH DECLARING ITS INTENT TO VACATE A EIGHT HUNDRED (800) FOOT PORTION OF HOSPITAL DRIVE BETWEEN HAMILTON STREET AND ORCHARD AVENUE WHEREAS, the City Council conditionally approved use permit 93-32 to allow construction of a 117,162 square foot K-Mart store over a portion of Hospital Drive; and WHEREAS, an integral component of the design for the K-Mart project calls for the closure of a portion of a city street; and WHEREAS, Section 8320 et. seq. of the State of California Street and Highways Code prescribes the procedure for the vacation of rights-of-way and public service easements; and WHEREAS, the initial step in the process is the agency's declaration of intent to vacate. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Ukiah: 1. Declares its intent to vacate a eight hundred (800) foot portion of Hospital Drive between Hamilton Street and Orchard Avenue, as described on the attached Exhibit "A," which is also on file in the City of Ukiah City Engineer's Office, Civic Center, Ukiah. 2. The vacation proceedings will be conducted under the regulations prescribed in Sections 8320 et. seq. of the State of California Streets and Highways Code. 3. The public hearing to consider this vacation will be conducted by the City Council at 7:00 p.m. on June 15, 1994 in the City of Ukiah Council Chambers, Civic Center, 300 Seminary Avenue, Ukiah, California. This resolution of intent shall be published and posted as prescribed by normal practices of the City of Ukiah. All persons owning property abutting or adjacent to the subject street shall be mailed notice regarding the public hearing. Further publication or posting shall be r a ailed pursuant to Sections 8322 and 8323 of the California Streets and Highways Code.
