The Traffic Engineering Committee meeting was called to order by Vice -Chairman Turner at
3:10 p.m. Roll was taken with the results listed above. Chairman Fernandez arrived at 3:15 p.m.,
and requested that Vice -Chairman Turner continue conducting the meeting.

ON A MOTION by Member Harris, seconded by Member Looney, it was carried by an all AYE voice
vote of the members present to approve the minutes of March 9, 1999, as submitted.

DISCUSSION/ACTION ITEMS:
NEW BUSINESS
Request for a disabledap rking area at 302 West Henry Street at the corner of Oak
Street - James McLain - County of Mendocino AODP
Mr. James McLain, Administrative Services Officer, Department of Public Health, County
of Mendocino, stated he is requesting a handicap parking space to be designated at 302
West Henry Street for an employee who has recently been approved for a disabled person
placard. Currently, there is no designated handicap parking space that meets ADA
requirements for handicap individuals.

Vice -Chairman Turner noted that the placard expires September 10, 1999
Member Harris stated abutting the property is a vacated building with on-site parking, and
asked if that parking area could be used for employee and handicap parking.
Mr. McLain responded the vacated property is a separate parcel, but owned by the same
property owner. He advised, in a discussion with the County's Risk Manager, the on-site
parking area does not meet ADA requirements.
Vice -Chairman Turner asked if the employee is in a wheelchair or uses crutches. He
expressed that he is opposed to the on -street handicap parking on the south side of Henry
Street, and that the intersection of Henry and Oak Streets does not have curb cuts or
wheelchair ramps.
Mr. McLain responded the employee uses crutches.
Member Looney stated he is opposed to designated on -street handicap parking at that
location. ADA regulations for parallel parking requires an additional 5 -feet in width for
handicap parking to accommodate wheelchairs, and extensive repair to the sidewalk for
a handicap ramp.
Member Lohse asked if there is on-site parking.
Mr. McLain responded the employees utilize the on-site parking, however, they are not
authorized to use the parking area.
Vice -Chairman Turner stated the driveway adjacent to Henry Street has been designated
as a pick-up/drop-off/short-term parking for handicap parking. He asked if the employee
could utilize the end of the driveway, with the existing area being reserved for clients.
Mr. McLain responded staff measured the area and it will not accommodate a wheelchair.
Member Lohse asked if there is sufficient parking area to develop another handicap
parking space.
Mr. McLain responded he will contact the property owner to discuss this issue and the
possibility of paving the parking area.
Member Lohse expressed he is opposed to the on -street handicap parking area because
the parking space would be utilized by others, other than for the employee, and there are
no handicap ramps.
Discussion followed regarding the possibility of relocating the fence along the driveway to
obtain additional parking space; Henry Street is narrow and Oak Street has a downhill

grade.
ON A MOTION by Member Looney, seconded by Member Harris, it was carried by an all
AYE voice vote of the members present, to deny the request for a disabled parking area
at 302 West Henry Street at the corner of Oak Street.
a. Request for stop sign on Dora Street at the new driveway entrance of the Catholic
Church - Lois Cook.
Member Looney advised the Public Works Department has provided a stop sign, at no
cost, to St. Mary's Catholic Church, and no further action is required.
b. Request to change two hour parking zone to a loading zone located in front of
Tom's Glass, 105 South Main - Tom Griffin. Owner.
Vice -Chairman Turner reported staff received a letter from Tom Griffin, owner of Tom's
Glass located at 105 South Main Street. He is requesting that the two hour parking zone
be changed to a loading zone for deliveries to his business. Mr. Griffin states it has
become difficult for a 40 -foot delivery truck to make a right -turn into the driveway when
vehicles are parked on -street and close to the driveway entrance, and creates traffic
congestion. The loading zone could be utilized for deliveries, making a resourceful and
safer area.
Vice -Chairman Turner asked if there is on -street parking in front of the Dragon's Lair.
Member Looney responded the Dragon's Lair has off-street parking, and is also an access
entrance/exit to the parking lot of the Porter Street Barbeque. He advised that he spoke
with Mr. Griffin regarding the possibility of yellow curbing the entire frontage, including the
24.8 -foot red curb area, to allow larger trucks to utilize the entire frontage. Mr. Griffin
expressed a concern that vehicles would utilize the loading zone for other surrounding
businesses and wished to stay with his original request for a loading zone and keep the
24.8 -foot red zone. Mr. Griffin noted the delivery trucks deliver three times a week.
Vice -Chairman Turner expressed a concern to on -street parking near the intersection of
Perkins Street and Main Street.
Member Lohse stated at high peak traffic hours vehicles are backed -up and utilize the
right-hand turn lane.
ON A MOTION by Vice -Chairman Turner, seconded by Member Harris, it was carried by
an all AYE voice vote of the members present, that the Traffic Engineering Committee
recommend to the City Council approval of the request to change the two hour parking
zone to a loading zone located in front of Tom's Glass, 105 South Main.

OLD BUSINESS
a. Status Report on Traffic Issues and Complaints Concerning Pick-up and Drop-off
Area for Elementary School Children at Mendocino Drive and Dora Street - Ukiah
Police Department.
Member Harris stated the School Administrator, Principal of Yokayo Elementary, Sergeant
Greg Heitkamp, and himself looked at the area. Flyers were to be sent to parents, plans
were given to the School indicating the location of the sewer line along the south property
line, and there was discussion of improvements along Mendocino Drive.
Vice -Chairman Turner advised in a discussion with Sergeant Heitkamp, the gate at the
southwest corner of the property was to be open to allow children access to the school
grounds within the fenced area, and the gate at mid -block was to be locked to prevent
children from exiting between the parked vehicles. As of this date, the School has not
opened the gate and the gate at mid -block remains unlocked. He expressed he would like
to see "NO PARKING' zone signs installed on Mendocino Drive, 10 - 20 feet apart, to
allow the children clear sight visibility when exiting the gate area.
Member Lohse expressed he agrees with Vice -Chairman Turner and would like to see the
gate at mid -block locked. He advised that he would like to have a representative from the
School District respond on the status of this issue.
It was the consensus of the Committee to continue this item to the May 11, 1999 meeting,
requesting representatives from the Police Department and School District to respond on
the status of the traffic issues and complaints concerning pick-up and drop-off area for
elementary school children at Mendocino Drive and Dora Street.

As last registered (and/or legal) owner of record of (description of vehicle - make,
model, license, etc.) you are hereby notified that the undersigned pursuant to §7605 of
the Ukiah City Code has determined that said vehicle (or parts of a vehicle) exists as an
abandoned, wrecked, dismantled or inoperative vehicle at (describe location on public or
private property) and constitutes a public nuisance pursuant to the provisions of Division
8, Chapter 8 of the Ukiah City Code.
You are hereby notified to abate said nuisance by the removal of said vehicle (or
said parts of a vehicle) within ten (10) days from the date of mailing of this notice.
As a registered (and/or legal) owner of record of said vehicle (or said parts of a
vehicle), you are hereby notified that you may, within ten (10) days after the mailing of
this notice of intention, request a public hearing and if such a request is not received by
the City Clerk within such ten (10) day period, the Police Chief or his designated
representative shall have the authority to abate and remove said vehicle (or said parts of
a vehicle) without a hearing.

§7610: REQUEST FOR HEARING; HEARING UNNECESSARY: Upon request by the
owner of the vehicle or owner of the land received by the City Clerk or her
designated representative within ten (10) days after the mailing of the notices of intention
to abate and remove, a public hearing shall be held by the Traffic Engineering Committee
on the question of abatement and removal of the vehicle or parts thereof as an
abandoned, wrecked, dismantled or inoperative vehicle, and the assessment of the
administrative costs and the cost of removal of the vehicle or parts thereof against the
property on which it is located.
If the owner of the land submits a sworn written statement denying responsibility for the
presence of the vehicle on his land within such ten (10) day period, said statement shall
be construed as a request for hearing which does not require his presence. Notice of the
hearing shall be mailed at least ten (10) days before the hearing to the owner of the land
and to the owner of the vehicle, unless the vehicle is in such condition that identification
numbers are not available to determine ownership. If such a request for hearing is not
received within said ten (10) days after mailing of the notice of intention to abate and
remove, the City shall have the authority to abate and remove the vehicle or parts thereof
as a public nuisance without holding a public hearing. (Ord. 617, §1, adopted 1971; Ord.

§7611: HEARING: All hearings under this Chapter shall be held before the Traffic
Engineering Committee which shall hear all facts and testimony it deems
pertinent. Said facts and testimony may include testimony on the condition of the vehicle

or parts thereof and the circumstances concerning its location on the said private property
or public property. The Traffic Engineering Committee shall not be limited by the technical
rules of evidence. The owner of the land may appear in person at the hearing or present
a sworn written statement in time for consideration at the hearing, and deny responsibility
for the presence of the vehicle on the land, with his reasons for such denial.
The Traffic Engineering Committee may impose such conditions and take such other
action as it deems appropriate under the circumstances to carry out the purpose of this
Chapter. It may delay the time for removal of the vehicle or parts thereof if, in its opinion,
the circumstances justify it. At the conclusion of the public hearing, the Traffic
Engineering Committee may find that a vehicle or parts thereof has been abandoned,
wrecked, dismantled, or is inoperative on private or public property and order the same
removed from the property as a public nuisance and disposed of as hereinafter provided
and determine the administrative costs and the cost of removal to be charged against the
owner of the land. The order requiring removal shall include a description of the vehicle
or parts thereof and the correct identification number and license number of the vehicle, if
available at the site.
If it is determined at the hearing that the vehicle was placed on the land without the
consent of the owner of the land and that he has not subsequently acquiesced in its
presence, the Traffic Engineering Committee shall not assess the costs of administration
or removal of the vehicle against the property upon which the vehicle is located or
otherwise attempt to collect such costs from such owner of the land. If the owner of the
land submits a sworn written statement denying responsibility for the presence of the
vehicle on his land but does not appear, he shall be notified, in writing, of the decision.

§7612: REMOVAL; TIME LIMITS: Five (5) days after adoption of the order
declaring the vehicle or parts thereof to be a public nuisance, five (5) days
from the date of mailing of notice of the decision if such notice is required by Section
7611 of this Chapter, or fifteen (15) days after such action of the governing body
authorizing removal following appeal, the vehicle or parts thereof may be disposed of by
removal to a scrap yard or automobile dismantler's yard. After a vehicle has been
removed it shall not thereafter be reconstructed or made operable. (Ord. 617, §1, adopted
1971)
§7613: REQUIRED DEPARTMENT OF MOTOR VEHICLE NOTICES: Within five (5)
days after the date of removal of the vehicle or parts thereof, notice shall be
given to the Department of Motor Vehicles identifying the vehicle or parts thereof
removed. At the same time there shall be transmitted to the Department of Motor
Vehicles any evidence of registration available, including registration certificates,
certificates of title and license plates. (Ord. 617, §1, adopted 1971)

Dear Toni and Regina,
I am writing this letter pursuant to the conversation I had with you
(Regina) on 04-26-99, via telephone. I am also enclosing a copy of the letter
that Cpl. Heilkamp sent to Rose on 03-15-99. The letter and the notices of
Abatement on the vehicles located at your property, 660 Talmage Rd., Ukiah ,
CA, was returned to the Ukiah Police Dept. I am sending you the revised copies
of the notices regarding the Abatement of the vehicles, since I now am clear on
the situation with Rose and Tom being the conservator of her estate.
As you are now aware, the Ukiah Police Dept. was assigned to handle the
vehicle abatement matter on the mentioned property. I am aware that the City
of Ukiah Building Inspector, Carl Tuliback, has sent you a letter regarding the
complete clean up of the mentioned property. Mr. Tuliback has set a proposed
date of completion for the clean up for August 31, 1999. The Police Dept. has a
stricter guideline regarding the vehicles.
As you will find in the abatement notices, the notice has a 10 day
stipulation regarding removal of the vehicles and/or submission of a request for a
public hearing regarding the issue. The Ukiah Police Dept. realizes that your
tenant, Mr. Pugh, is the responsible party for the disarray on your property, and
we are willing to work around the requirements of the abatement codes.
However, the vehicles (and auto parts) on your property pose concerns for the
safety of the public.
As I have mentioned in our telephone conversations, the oils deposited
from the vehicles, the acids from the wet cell batteries, and the general pollution
from the vehicles causes problems to the environment, as well as, the public

safety. The potential problems could lead to further violations of the law (local,
state, and federal) without immediate clean up. I would like to state, again, that
we ar e not trying to be unreasonable, and that we are willing to work with you in
this matter.
As I have stated in our conversations, the Police Dept. would like to see
all of the vehicles off of the property no later than May 31, 1999. Jhe alternative
is that the Police Dept. will abate the vehicles ourselves, which unfortunately
brings costs to you. I know that you are making progress with Mr. Pugh in the
clean up of the property and we would all like to see the progress continue.
I had a conversation with Mr. Pugh on 04-21-99. Mr. Pugh shared with
me Iiis design to dismantle the vehicles and make some type of trailer vehicles
with the parts. Mr. Pugh's plans have other problems that we have discussed
and do not follow the requirements set forth by Mr. Tuliback, which is the
complete clean up of the property.

It has been brought to my attention that a condition exists at 660 Talmage
Rd. that needs to be remedied.
1 have been renting the second hand store to Bob fuel) I'm many yews.
Ile has accumulated on the property, too much stulT Some good stuff and
some not so good.
only want such materials on (he property that stake use for a "Quality
Second Iland Store". Not the situation that Bob Pueh has brought it to.
I am not in agreement with the trailer, autos and debris being stored on
my property.
They are not mine. I never gave Bob permission to store these items
there.
Since I became aware of the trailer and autos being there, I asked Bob,
"do you have pink slips Ibr each one of these", lie said yes he does.
1 am not happy with the way the property looks. I plan to clean up the
area and make it look better.
Mr. Carl Tuliback via a phone call, said lie was happy that I agree will)
the City that the property should be cleaned up. Ile also said that I should set
a date of time that I think I can accomplish this cleanup. Mr. Tuliback agreed
that it would take sonic time to remedy the situation.
I have looked at tl)e properly and I think 1 can have the situation remedied
by the end of August.
Since we have received the City's leper, we have lilled and removed 3
fill[ S' by 8' by 20' dumpsters of material, and we are working on number 4.
We plan to keep this an ongoing program until the situation is remedied.

1 have received your letter of intention to abate all code violations at your property located at the
above noted address. You have indicated that you intend to have all violations as noted in my letter to you
on March 11, 1999 corrected by August 1999. This time frame seems to be sufficient to resolve this matter
and is hereby approved with the following conditions: .
I. Correction of all violations is to be completed on or before August 31, 1999.
2. Progress shall be continues throughout this lime frame.
3. No further trash, debris, vehicles or other items, is to be allowed to be placed or accumulate on
ur about the properly.
Please be advised that progress inspections will be performed on a weekly basis to insure that the above
requirements are being complied with. Also any future plans for outdoor sales will require you to first
apply for and have approved a use permit per the City of Ukiah Zoning Code, Section 9184. In the event
that you do choose to apply for a use permit the Planning Department is unlikely to make
reconunendalions for approval to the Planning Commission until such time that all the code violations are
abated and the properly is in compliance with the Cities zoning and land use laws.

To City of Ukiah 4-11-99
It has been brought to my attention that a condition exists at 660 Talmage
Rd. that needs to be remedied.
I have been renting the second hand store to Bob Pueh for many years.
He has accumulated on the property, too much stuff. Some good stuff and
some not so good.
I only want such materials on the property that make use for a "Quality
Second Hand Store". Not the situation that Bob Pueh has brought it to.
I am not in agreement with the trailer, autos and debris being stored on
my property.
They are not mine. I never gave Bob permission to store these items
there.
Since I became aware of the trailer and autos being there, I asked Bob,
"do you have pink slips for each one of these", he said yes he does.
I am not happy with the way the property looks. I plan to clean up the
area and make it look better.
Mr. Carl Tuliback via a phone call, said he was happy that I agree with
the City that the property should be cleaned up. He also said that I should set
a date of time that I think I can accomplish this cleanup. Mr. Tuliback agreed
that it would take some time to remedy the situation.
I have looked at the property and I think I can have the situation remedied
by the end of August.
Since we have received the City's letter, we have filled and removed 3
full 8' by 8' by 20' dumpsters of material, and we are working on number 4.
We plan to keep this an ongoing program until the situation is remedied.

Dear Mr.Caldwell:
The City of Ukiah has a Code Enforcement Program to help eliminate property nuisances within the
City The program is meant to correct property and building conditions that pose a hazard to public
health, safety or welfare. It is also designed to improve the value of your property, home or business
and increase the livability within our community.
It has been brought to the attention of the department on several occasions that the above subject
property is in violation of the following:
Ukiah City Code 4420:
Accumulation of trash and debris to include but not limited to automotive parts, auto body
parts, furniture, appliances, garbage, bagged and unbagged trash, scrap wood, metal, glass,
and other miscellaneous items.
Ukiah City Code 2462:
Maintaining a travel trailer or camp car upon a parcel within the City that is not legally defined
as a trailer camp for the purpose of living or sleeping quarters.
Ukiah City Code 7601:
Accumulation and storage of abandoned, wrecked, dismantled or inoperative vehicles or
parts thereof.
Uniform Housing Code 201:
Lack of owners responsibilities for maintaining buildings in sound condition and for
keeping all parts of buildings and the premises in a clean, sanitary and safe condition.
Uniform Housing Code 1001:
Improper maintenance of structures resulting in conditions described in section 1001 (a)
thru (n) of the Uniform Housing Code. ( Inspection was limited to the exterior of all
structures and further inspection is pending. )

The conditions found at your property, as articulated above, constitute violations of the City of Ukiah
Municipal Code and are hereby found to create blight and deterioration, fire hazards, attractive
nuisances, a harborage for rodents and insects, unsafe and unsanitary building and living
conditions, and an overall hazard to the health and general welfare of the public. Accordingly, in
accordance with Ukiah Municipal Code Chapter2, Article 22, and the Uniform Building Code
Section 102, you are hereby requested to abate or eliminate these adverse health, safety, and
welfare conditions in an expedient manner, or no later then April 16 1999. Failure to correct
and/or remove these conditions will result in enforcement action by this office which may include
removal of the violations by the City with the cost being charged to you.

Investigation:
On 3-11-99 at 0930 hrs I met with Carl Tuliback of the City
Building Department at #660 Talmage Rd regarding complaints of
abandoned vehicles and accumulated trash on the property. On the
property is located a business called "Bob's Trading Post" which deals
mainly in secondhand merchandise. Tuliback told me that he has received
complaints about the appearance of the business in the past and has
previously spoken with the owner. Tuliback said that these contacts had
resulted in the business rearranging their goods so that they appeared
organized for display.
Upon our arrival this date I observed all of the property to be strewn
about in disarray with no indication that any of it was for sale. There were
no price tags or for sale signs on any of the mist. equipment on the
property nor were there any on the 15 vehicles that were parked in various
locations. Tuliback advised me that he would address the issue of
accumulated trash if I would deal with the abandoned vehicles on the
property.
I proceeded to walk about the property and record the license
numbers and descriptions of the vehicles that were obviously abandoned
or inoperative. Also located on the property was a large quantity of misc.
vehicle parts, which were contained mainly in the rear yard area to the
North of the business. Upon completing an inventory of the vehicles I
proceeded to take 15 color digital photographs depicting the condition of
the property and vehicles located thereon (copies attached).
During our inspection of the property I located an RV trailer in the
front yard area that was occupied by a subject named Mike Davidson
(DOB: 8-14-39). Davidson stated that he was currently living in the trailer
on the property and had been given permission to stay there from the
business owner, Bobby Pugh. I informed Davidson that it was illegal for

him to be staying on lite property in the RV and advised him he would
have to move. Davidson told me that he would make immediate
arrangements to move his RV to a legal living area. As we continued to
walk through the property we located a "lean to" type camping tent near
the North property line which appeared to be in current use as a living
structure. There was plastic sheeting set up over some branches to provide
shelter, a cooking area that appeared recently used along with a
Five gallon plastic bucket that was being used as a toilet. I was unable to
locate a possible resident in the vicinity of this structure.
Tnliback made note of the various types of trash and rubbish being
stored on the property and provided me with the name and address of the
property owner, S#1 Rose Caldwell. At 1010 hrs we concluded our
inspection of the property and left the location.
On 3-15-99 I prepared vehicle abatement notices (copies attached)
for S#1 Caldwell and all of the registered owners of the vehicles on the
property and caused these to be sent to the involved parties by certified
mail in accordance with 7609 UCC (receipts on file).
Recommendations:
Further action is pending the expiration of the required ten-day
waiting period that the parties are allowed in order to request a hearing on
the issue. If no requests are made I will re -inspect the property on 3-29-99
to determine if it has been brought into conformance.

Subject: STOP SIGNS AND NO PARKING

Rick, this is a follow-up letter in regards to our conversation on 4-19-99.
At the present time there is only a two way stop on Freitas Ave. I would like this changed
to a four way stop at the intersection of Freitas and Oak.
Just recently the Catholic Church was finished at this intersection which has
increased the amount of vehicle traffic on these two streets one hundred percent. On
street parking has also increased to the point where you can't see if the road way is clear
until you are in the middle of the intersection. In addition what use to be a quite
neighborhood street has become a raceway at times. There have been several near
accidents and several accidents since the church has opened.
For the above-mentioned reasons, I feel that a potentially dangerous problem has
arisen for drivers in the area and for the small children who live in the apartments at this
intersection.
Your attention and quick action in this matter would be greatly appreciated.

Dear John:
Your request for an all way stop at Frietas and Oak Street intersection, and the elimination
of on -street parking adjacent to the intersection has been agendized for the Traffic
Engineering Committee's regular scheduled meeting of May 11, 1999. The meeting begins
at 3:00 p.m., and it is conducted at the Civic Center. The receptionist will direct you to the
appropriate meeting room.
Although your presence at the Committee meeting is not mandatory, I would recommend
that you attend for the purpose of presenting your opinions and observations relating to
your request.
