RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
APPROVING USE PERMIT NO. 93-16, BALTINS
WHEREAS, the Planning Commission conducted a public hearing on October 27,
1993, at which time the Use Permit to construct a surgical center and medical offices as
filed by Dr. Aldis Baltins, was considered and recommended for approval to the City
Council; and
WHEREAS, Use Permit Application No. 93-16 is on file with the Clerk of the
Planning Commission, said file being incorporated herein by reference; and
WHEREAS, the City Council held a public hearing on November 17, 1993, found
the Negative Declaration adequate and complete, and determined the proposed Use
Permit to be appropriate.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Ukiah
approves Use Permit 93-16, allowing a surgical center/medical offices within an R-3 High
Density Residential zone:
a) subject to the following conditions: 1. Standard Conditions 1-23.
2. Final building design be approved by the Community Development
Director.
3. Street improvements be completed per City Engineer requirements.
4. Exterior lighting be directed away from residential uses.
5. All conditions be completed prior to use and occupancy.
6. This action is valid when Zone Change 93-16 is effective.
b) based upon the following findings which indicate the project will not
be detrimental to the health, safety, or welfare of people working or
residing in the area:
1. The project can be designed to make the buildings look like the
surrounding residential character with similar setbacks, and
parking can be screened and otherwise designed to minimize its
adverse aesthetic effects. The condition requiring Planning
Commission approval of the final site plan and elevations insures
that the project's aesthetic impacts will not be detrimental.
2. Traffic circulation will utilize secondary access to Dora Street
through the adjacent medical office complex to the south of the
project. The additional traffic contributed by the project to Dora
and Observatory will net significantly reduce the level of service
on those streets or at the intersection of Dora and Observatory.
3. The approval of this project will not significantly influence the
future character of this area, because mixed commercial and
residential uses already exist in the area. This is the last
developable lot on Observatory. Consequently, residential uses
will continue to predominate on that street. With secondary
vehicle access and pedestrian access between the project and the
medical office complex on Dora this use will compliment the
existing medical office uses in the area.
