RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
UKIAH AUTHORIZING THE CITY MANAGER TO
ESTABLISH RATES FOR CHARGING THE USE OF CITY
OWNED EQUIPMENT.
WHEREAS,
1. The City has occasion to charge members of the public for
the use of City owned equipment, such trucks, line trucks,
bulldozers and other vehicles, and expensive tools such as chain
saws, and pumps; and
2. The City charges for the use of its equipment in a variety
of circumstances, including when it makes repairs caused by the
negligence of third parties, or to benefit private property or
interests; and
3. The rates require periodic adjustment to account for
changes in the City's costs, including capital investment,
depreciation, financing costs, fuel, maintenance, repairs and
labor; and
4. If the rates are not promptly adjusted as the need arises,
the City fails to recover all of its costs in furnishing equipment;
and
5. Under Ukiah City Code section 106, the City Manager is the
administrative head of the municipal government, responsible for
the efficient administration of the City's affairs;
NOW, THEREFORE, BE IT RESOLVED that:
1. Pursuant to Ukiah City Code section 120, the City Manager
is hereby delegated the responsibility to establish and revise from
time to time as he deems necessary and appropriate the equipment
use rates for the City of Ukiah.
2. Prior to establishing or revising said rates the City
Manager shall provide such notice and conduct such hearings as may
be required by law. Currently, Government Code section 660018
requires a public hearing at which oral and written presentations
may be made. Notice of the hearing stating the date, time and
place of the hearing and its general subject matter must be
published twice in a newspaper of general circulation with the
first notice being published at least 10 days prior to the hearing
and at least five days elapsing between the first and second
publications.
2. The City Manager shall prepare an equipment use rate

schedule, bearing the date it was adopted or revised and a copy of
that schedule shall be provided to the City Council within thirty
(30) days after it is adopted or revised. The adopted schedule
shall be made available to members of the public upon request.
3. The charges for City equipment shall be based on the
schedule adopted and revised by the City Manager.
