RESOLUTION NO.2020-03
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE MILLVIEW COUNTY
WATER DISTRICT RATIFYING ACCEPTANCE OF UKIAH VALLEY SANITATION
DISTRICT AS A JPA MEMBER
WHEREAS, the Ukiah Valley Sanitation District (the "District") is a county Sanitation
District formed on July 6, 1954 by Resolution No. 1294 of the Mendocino County Board of
Supervisors to provide sewer facilities and services for the unincorporated areas adjacent to the
City of Ukiah; and
WHEREAS, the District owns a system for the collection and transmission of
Wastewater within the District (the "Wastewater System") which wastewater is treated at a
wastewater treatment plant owned by the City of Ukiah (the "City); and
WHEREAS, on July 8, 2020, at a regular board meeting of the Board of Directors oh the
Ukiah Valley Sanitation District, the Board considered requesting membership in Upper Russian
River valley Water Agency, a duly formed Joint Powers of Authority (the "JPA"); and
WHEREAS, pursuant to the provisions of California Government Code 6500, et seq., the
JPA entered into an agreement dated December 29, 2014 forming the JPA (the "JPA
Agreement); an
WHEREAS, the JPA Agreement provides, at paragraph 11, for "Addition of
Constituents" in the form of any public agency that a purveyor of water or operator of a sewer
treatment or collection system located within the Russian River watershed; and
WHEREAS, Ukiah Valley Sanitation District is such a purveyor and/or operator of a
sewer treatment or collection system located within the Russian River watershed; and
WHEREAS, on August 5,2020, at its duly noticed regularly scheduled meeting, the
Upper Russian River water Agency, ("URRWA"), a duly formed Joint Powers Authority, of
which WILLOW COUNTY WATER DISTRICT is a Constituent member, voted to accept the
application of the Ukiah Valley Sanitation District to become a constituent member of URRWA;
and
WHEREAS Paragraph 11 of the URRWA JOINT POWERS AGREEMENT provides
that a new Constituent member's application is complete upon ratification by each of the
Constituents' governing bodies;

NOW, BE IT THEREFORE RESOLVED that, by action of the its Board of Directors as
set forth below, MILLVIEW COUNTY WATER DISTRICT does hereby resolve that Ukiah
Valley Sanitation District immediately be accepted as a Constituent Member of the UPPER
RUSSIAN RIVER WATER AGENCY JPA.
Section 10. This resolution shall take effect immediately upon passage.
