HomeMy WebLinkAbout93-31RESOLUTION NO. 93-31 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH AUTHORIZING CITY MANAGER TO NEGOTIATE AND ENTER AGREEMENT WITH EBA WASTECHNOLOGIES. WHEREAS, 1. In response to the City's request EBA Wastechnologies, Engineers and Environmental Consultants ("EBA"), has submitted a Proposal for the Preparation of Additional Engineering Studies for the City of Ukiah Solid Waste Facility, dated October 1992, a true and correct copy of which is attached hereto as Exhibit A and incorporated herein; and 2. In 1991 EBA prepared a Report of Disposal Site Information ("RDSI") for the City of Ukiah's landfill which involved extensive geological and hydrological work by EBA and Hallenbeck & Associates, including the drilling of several test wells and water sampling; and 3. As a result of this prior work EBA and Hallenbeck & Associates are familiar with the landfill and the hydrology and geology of the area; and 4. As a result of on-site groundwater contamination detected in preparing the updated RDSI prepared by EBA in 1991 and revisions to state waste discharge regulations, the City received a letter from the Regional Water Quality Control Board ("RWQB"), dated October 5, 1992, which requires the city to submit a technical supplement to its existing Report of Waste Discharge ("RWD") and to establish and maintain assurances of financial responsibility for correcting ground water contamination which the landfill might cause. These conditions will also require the RWQB to amend the City's Waste Discharge Requirements, when the supplemental studies are completed. In addition, the City requires additional analysis of landfill impacts in connection with revising its current operator's permit and in obtaining an industrial storm water discharge permit; and 5. To meet these needs EBA has proposed six work items as follows: Task I Task II Article 5 Monitoring Proposal Characterize Groundwater Contamination Task III Task IV Revise Report of Waste Discharge Revise Report of Disposal Site Information s:\u\wpcloc$92\eba October 30, 1992 1 Task V Industrial Storm Water Discharge Permit Task VI Environmental Impact Report for Permit Revision 6. Soliciting bids for Tasks I - V by Request for Proposal ("RFP") in accordance with the procedure required by Ukiah City Code Section 1522, subdivision C2 is not possible because: a. These task are an augmentation of work, including on-site data collection, already performed by EBA. Any other consultant would have to review and/or duplicate work already completed by EBA, causing added cost and delay; b. Time does not permit the preparation of RFPs, advertising for bids and evaluation of proposals, because the City wants to drill additional wells and perfo£m other onsite work before winter rains cause significant delays. Time is of the essence because of city and RWQB concern with identified on-site groundwater contamination and the need to compile the data base necessary to revise the City's landfill operator's permit; and 7. These same constraints do not apply to the preparation of an Environmental Impact Report for Permit Revision, which will be subject to an RFP. 8. Based on staff's review EBA is the most qualified firm to perform the work and proposes to perform tasks I - V at a reasonable cost. NOW, THEREFORE, BE IT RESOLVED that the City Manager is hereby authorized to negotiate with EBA a contract, approved as to form by the City Attorney, to perform those services identified as Tasks I - V in Exhibit A, attached hereto, and in accordance with the proposal set forth in Exhibit A for a total price, not to exceed $109,680.00.
