On behalf of the County, BKF will be conducting an aerial mapping task that requires access to your property for the East Hills Ukiah Evacuation Route Planning Project. The description of the project and tasks needed for mapping are outlined in detail below. Project Description: The East Hills Ukiah Evacuation Route Planning Study consists of the planning and design of an emergency evacuation route that provides secondary access to three densely developed subdivisions located in the heavily wooded hills to the east of the Ukiah Valley. Deerwood Estates, El Dorado Estates, and Vichy Springs, along with the adjacent Guidiville Rancheria, contain approximately 325 homes and all are “one way in, one way out” communities at high risk during a fire event. This project will develop a conceptual design and identify a source of project maintenance and construction revenues that will lead to the pursuit of future grant funding. The proposed route will connect with Rafello Drive in the north and terminate at Bartolomei Way in the south, providing an alternative access to the subdivisions which can be used to allow firefighters to access these communities from the north and south while evacuation of the public uses existing public roads travelling west. Alternatively, should fire conditions warrant it, the public could be routed through the new route to evacuate. The project alignment is not anticipated to cross tribal lands of the Guidiville Rancheria. Requested Project Tasks: BKF Engineers proposes to enter the property along existing traveled ways and set the panel at a location shown below. Panels will be placed to not disturb day to day operations and staff will leave little to no trace of their presence. They will confirm mapping/data collection is successful and return to the remove the panel from the area unless otherwise requested not to. Staff should be onsite no longer than one hour per visit. You do not need to be present for our staff to complete the work. Consultant trucks will be marked similar to the one shown below. Staff will be able to provide a business card upon request. The target will be a 4’ x 4’ cloth panel with a nail or wooden hub set through the middle similar to the one shown below. Right to Enter. OWNER grants County of Mendocino and its subcontractor, BKF Engineers, a revocable license (Right of Entry) to enter the above-referenced property to place a marker for the East Hills Ukiah Evacuation Route Planning Study in accordance with the attached map provided to OWNER, which is incorporated herein. The East Hills Evacuation Route Planning Phase provide an alternative access to neighboring subdivisions which can be used to allow firefighters to access these communities from the north and south while evacuation of the public uses existing public roads travelling west. No legal title, interest, or leasehold interest in the property is created or vested in the County of Mendocino by the grant of this Right of Entry. 2. Funding. The County of Mendocino has applied for and been awarded Federal funding under the authority of the Federal Emergency Management Agency (FEMA) and the California Governor’s Office of Emergency Services (Cal OES). OWNER shall not be responsible for payment or reimbursement of the cost of the Project or any portion of the same. 3. Indemnity. The County of Mendocino shall be responsible for and indemnify OWNER to the extent of liability resulting from occurrences arising out of the operations of the County of Mendocino, its employees, agents, or contractors. 4. Term of Agreement. This agreement shall be effective from the signature date through the mapping process for planning. 5. Attorneys’ Fees. Should any legal or arbitration proceedings be brought by either party to enforce or interpret any of the terms or conditions of this Agreement, the prevailing party shall be entitled to recover his/her/its reasonable attorneys’ fees and costs from the other party. 6. Binding on Successors and Assigns. This instrument constitutes the entire agreement between OWNER and County relating to the Right of Entry. Any prior agreements, promises, negotiations, or representations not expressly set forth in this instrument are of no force and effect. Any amendment to this instrument shall be of no force and effect unless it is in writing and signed by OWNER and The County of Mendocino. Choice of Law.
