HomeMy WebLinkAbout93-18 5 6 ? 9 10 11 12 13 14 15 16 17 19 20 21 0.2 25 26 RESOLUTION NO. 93-18 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH DECLARING APPROVAL OF AIRPORT INDUSTRIAL PARK PLANNED DEVELOPMENT AMENDMENT AND WAL-MART SITE DEVELOPMENT PERMIT CONSISTENT WITH AIRPORT LAND USE COMMISSION LAW WHEREAS, Planned Development Amendment Application No. 90-77 (Airport Industrial Park Planned Development), and Site Development Permit Application No. 90-87 (Wal-Mart Stores), encompass property within one mile of the Ukiah Municipal Airport and thus applicable land use decisions regarding these matters must comply with Public Utilities Code Sections 21670 et seq.; and WHEREAS, the County of Mendocino has not established an Airport Land Use Commission pursuant to State statutes and there is no Airport Land Use Plan for the Ukiah Airport and its environs; and WHEREAS, the City of Ukiah Planning Commission and City Council held public hearings on July 22/23/24 and August 12/13/14, 1992, respectively regarding Applications 90-77 and 90-87; and WHEREAS, during the public hearings, both the Commission and Council considered an Environmental Impact Report and specific aviation study prepared for these projects which addressed issues relating to noise, safety, and compatibility of the land uses in relationship to the airport; and WHEREAS, substantial evidence was provided in the written and oral testimony before the Con~nission and Council that the proposed projects will not be detrimental to public health, safety, and welfare specifically related to noise and safety hazards with respect to the Ukiah Airport. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF UKIAH DOES HEREBY FIND THAT: 1 3 5 6 7 8 9 10 11 13 15 16 17 18 19 20 21 23 2~ 25 26 27 28 1. The location of the proposed Wal-Mart Store and area affected by the proposed Planned Development Amendment is well outside of the established (based upon FAA airspace standards) flight path for both landing and takeoff aircraft operations at the Ukiah Airport, being 1,800 feet east of the runway (final leg), 4,000 feet and 700-1,500 feet south of the standard and short base legs respectively, and 2,800 feet west of the downwind leg. 2. The project location is not within any of the critical approach or safety areas of the airport including the Object Free Area (OFA), Runway Protection Zone (RPZ), and the Approach Surface Area, and the proposed structure is not within the Transitional Surface Area. 3. In addition to the subject property not being sited within or under the flight path or any critical airspace area, the location is outside the area of high (greater than 80%) statistical probability for an aircraft accident. 4. The height of the proposed Wal-Mart building is considerably lower than the FAA established height limits, will not penetrate the airport's 7:1 transitional surface, is 144 feet below the designated airport horizontal surface, and thus is not an obstruction relative to flight operations. 5. The Community Noise Equivalent Level (CNEL) on the project site based upon airport operations is less than 60dB, well below any excessive noise exposure which would be considered problematic or sensitive for commercial development, or individuals utilizing the facility. 1 $ 5 6 ? $ 9 10 11 1~. 14 15 16 18 19 20 21 ~5 27 In light of these facts, the approval of the Planned Development Amendment and the Site Development Permit are consistent with regulations to minimize the public's exposure to excessive noise and safety hazards and do not create new noise, safety, or land use compatibility issues which conflict with State or local statutes for airport land use planning. PASSED AND ADOPTED this 14th day of August, 1992, by the following roll call vote: AYES: Councilmembers Malone, McMichael, Wattenburger, and Mayor Schneiter. NOES: Councilmember Shoemaker.
