HomeMy WebLinkAbout2023 -03Resolution No. 23-03 Adopting Policy for GSA Procurement Processes RESOLUTION NO. 23-03 RESOLUTION OF THE UKIAH VALLEY BASIN GROUNDWATER SUSTAINABILITY AGENCY TO APPLY FOR BOARD OF DIRECTORS ADOPTING A POLICY FOR GSA PROCUREMENT PROCESSES WHEREAS, the Ukiah Valley Basin Groundwater Sustainability Agency ("Agency") was formed pursuant to a Joint Exercise of Powers Agreement and is the designated Groundwater Sustainability Agency ("GSA") for the Ukiah Valley Basin; and WHEREAS, the Agency seeks to provide Agency Staff with clear guidance on the procurement processes to follow. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Ukiah Valley Basin Groundwater Sustainability Agency, as follows: The Agency hereby adopts a Policy Regarding Decisions on GSA Procurement, as follows: 1. Goods: The Agency must comply with the competitive bidding process on purchases of goods in the amount $10,000 or more. This competitive bidding process is conducted solely by the General Manager of the Agency under the direction of the Board. 2. Services: The Agency shall obtain competitive bids for personal and professional services contracts greater than $50,000, including grant funded or grant related project contracts. The Agency may award sole sourced contracts for personal and professional services contracts less than or equal to $50,000. If the Agency holds a contract between$10,000 and$50,000 for up to three years, the Agency shall obtain competitive bids for that contract before beginning the fourth year of said contract. 3. Contract amendments: The Agency shall document justification for all contract amendments for existing contracts that contain language which allows for a change in budget and scope to be modified as appropriate. Existing contracts that will be amended to increase the total contract value to greater than $50,000 shall require the Agency's Exception to Competitive Bid Form to be completed. If an existing contract does not contain language that allows for modifications in scope and budget, the contract cannot be amended. 4. Public Projects (i.e. construction, remodeling, etc.): The Agency shall comply with the alternate procedure of the Uniform Public Construction Cost Accounting Act, as contained in the State of California Public Contracts Code, (Cal. Pub. Cont. Section 22030 et. seq.). a) Public projects of$60,000 or less may be performed by the employees of a public agency by force account, by negotiated contract, or by purchase order. b) Public projects of$200,000 or less may be let to contract by informal procedures as set forth in the alternate procedure of the Uniform Public Construction Cost Accounting Act, as contained in the State of California's Public Contracts Code. c) Public projects of more than $200,000 shall be let to contract by a formal bidding procedure. 5. The Agency may choose to use the County of Mendocino's contract boilerplate or modify as necessary to fit the Agency's contractual needs. Legal review will be completed by the Agency's legal counsel and contract administration will be completed by Agency staff. All contracts, contract amendments, and exceptions to competitive bid RESOLUTION NO. 23-03 require advance approval by a majority vote of the Agency Board of Directors. The contract administration process for the Agency will be reviewed and revised as needed. This resolution shall take effect immediately upon adoption and supersedes any previous resolutions that were adopted on this manner.
