HomeMy WebLinkAbout2023 -02 Resolution No. 23-02 Adopting Policy for providing Letters of Support RESOLUTION NO. 23-02 RESOLUTION OF THE UKIAH VALLEY BASIN GROUNDWATER SUSTAINABILITY AGENCY TO APPLY FOR BOARD OF DIRECTORS ADOPTING A POLICY FOR PROVIDING LETTERS OF SUPPORT FOR MEMBER AGENCY OR OTHER ENTITIES SEEKING GSA SUPPORT FOR PROJECTS AND GRANTS WHEREAS, the Ukiah Valley Basin Groundwater Sustainability Agency ("Agency") was formed pursuant to a Joint Exercise of Powers Agreement and is the designated Groundwater Sustainability Agency for the Ukiah Valley Basin; and WHEREAS, the Agency seeks to provide Agency Staff with clear guidance on how to provide letters of support that are requested between Board meetings. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Ukiah Valley Basin Groundwater Sustainability Agency, as follows: The Agency hereby adopts a Policy Regarding Decisions on Letters of Support, as follows: 1. All letters of support requests are to be directed to the Ukiah Valley Basin Groundwater Sustainability Agency ("GSA") Staff for review. Upon review of the request, GSA Staff will: a. Review the letter of support to determine if the project or grant pursuit is related or unrelated to GSA's mission of sustainable groundwater management within the Ukiah Valley Basin. b. Request a detailed description of the project or grant pursuit, scope of work of project, and how the GSA is requested to be involved in the project or grant pursuit, if any, from the requester. 2. If the letter of support has a project or grant pursuit that is related to sustainable groundwater management within the basin, and support is advisable, then GSA Staff shall seek Chair approval and signature as soon as possible. In the event the Board Chair cannot be reached in a timely manner, GSA Staff will seek the Vice Chair's approval and signature as soon as possible. If the Board Chair and Vice Chair cannot be reached in a timely manner, the GSA General Manager may provide approval and sign the letter of support. 3. If the letter of support has a project or grant pursuit that is unrelated to sustainable groundwater management within the basin, GSA Staff shall attempt to contact the Chair and Vice-Chair to confer on the letter of support and seek guidance about how to proceed. 4. If the GSA is requested to provide GSA Staff time and resources toward the project in the future or to the current grant pursuit effort, the letter of support must be approved at a regularly scheduled Board meeting or a special meeting. GSA Staff shall attempt to contact the Chair and Vice-Chair to confer to determine the best course of action in which to proceed. 5. Any decisions made pursuant to this Policy shall be brought to the Board at the next meeting for ratification. 6. This policy replaces the previously adopted policy discussed and approved by the Board for Agenda Item 3(a) at the October 21, 2021 meeting. RESOLUTION NO. 23-02 7. This policy does not apply to decisions involved the expenditure of funds in excess of the GSA General Manger's authority. This resolution shall take effect immediately upon adoption and supersedes any previous resolutions that were adopted on this manner.
