The Board will not enter into a detailed discussion or take any action on any items presented during public comments. Ukiah Valley Basin Groundwater Sustainability Agency Agenda Summary Page 1 of 2 Item No.: 3.a Date: 2/10/22 To: Board of Directors Subject: Discussion and Possible Action Including Adoption of Resolution of the Ukiah Valley Basin Groundwater Sustainability Agency Finding that State or Local Officials Continue to Recommend Measures to Promote Social Distancing in Connection with Public Meetings Consent Agenda Regular Agenda Noticed Public Hearing Summary: Pursuant to Assembly Bill 361, the Ukiah Valley Basin Groundwater Sustainability Agency is required to reconsider the circumstances of the emergency and make a finding of whether state or local officials continue to recommend social distancing measures. This finding must be renewed every thirty (30) days if any member(s) of the Board will be participating from a location not open to the public. Mendocino County Health Officer Dr. Andrew Coren made such a recommendation on September 29, 2021, which continues to be in place as of the time of agenda publication. Staff has prepared the attached draft resolution, containing the required findings, for the Board’s consideration and approval. Recommended Action: Adopt resolution finding that State or Local Officials continue to recommend measures to promote social distancing in connection with public meetings. Background: Beginning in March 2020, amid rising concern surrounding the spread of COVID -19 throughout communities in the state, California Governor Gavin Newsom issued a series of Executive Orders aimed at containing the novel coronavirus. These Executive Orders (N-25-20, N-29-20, N-35-20) collectively modified certain requirements created by the Ralph M. Brown Act (“the Brown Act”), the state’s local agency public meetings law. Ukiah Valley Basin Groundwater Sustainability Agency Agenda Summary Page 2 of 2 Assembly Bill 361 provides local agencies with the ability to meet remotely during proclaimed state emergencies under modified Brown Act requirements, similar in many ways to the rules and procedures established by the Governor’s Executive Orders. AB 361’s provisions can only be used in the event that a gubernatorial state of emergency 1) has been issued AND 2) remains active. It is not sufficient that county and/or city officials have issued a local emergency declaration – the emergency declaration must be one that is made pursuant to the California Emergency Services Act (CA GOVT § 8625). This means that, during a state of emergency, under specified circumstances, AB 361 provides local agencies the flexibility to meet remotely during a proclaimed emergency pursuant to modified Brown Act requirements. Action: ___________________________________________________ Motion:_____________________ 2nd:__________________________ RESOLUTION NO. 22-02 1 RESOLUTION OF THE UKIAH VALLEY BASIN GROUNDWATER SUSTAINABILITY AGENCY FINDING THAT STATE OR LOCAL OFFICIALS CONTINUE TO RECOMMEND MEASURES TO PROMOTE SOCIAL DISTANCING IN CONNECTION WITH PUBLIC MEETINGS WHEREAS, all meetings of the Ukiah Valley Basin Groundwater Sustainability Agency are open and public, as required by the Ralph M. Brown Act (Cal. Gov. Code §§ 54950 – 54963), so that any member of the public may attend, participate, and view the legislative bodies conduct their business; and WHEREAS, the Brown Act, Government Code section 54953(e), makes provisions for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and WHEREAS, on March 4, 2020, Governor Newsom issued a Proclamation of a State of Emergency declaring a state of emergency exists due to the outbreak of respiratory illness due to a novel coronavirus (a disease now known as COVID -19), pursuant to the California Emergency Services Act (Government Code section 8625) and that State of Emergency is still in effect in the State of California; and WHEREAS, as of the date of this Resolution, neither the Governor nor the state Legislature have exercised their respective powers pursuant to Government Code section 8629 to lift the state of emergency either by proclamation or by concurrent resolu tion the state Legislature; and WHEREAS, the California Department of Industrial Relations has issued regulations related to COVID-19 Prevention for employees and places of employment. Title 8 of the California Code of Regulations, Section 3205(c)(5)(D) specifically recommends physical (social) distancing as one of the measures to decrease the spread of COVID -19 based on the fact that particles containing the virus can travel more than six feet, especially indoors; and WHEREAS, the Mendocino County Public Health Officer continues to recommend teleconferencing during public meetings of all legislative bodies to protect the community’s health against the spread of COVID-19, based in part on the continued increased safety protection that physical/social distancing provides as one means by which to reduce the risk of COVID -19 transmission; and WHEREAS, the Ukiah Valley Basin Groundwater Sustainability Agency finds that state or local officials have imposed or recommended measures to promote social distancing based on the Mendocino County Public Health Officer recommendation and the California Department of Industrial Relations’ issuance of regulations related to COVID -19 Prevention through Title 8 of the California Code of Regulations, Section 3205(c)(5)(D); and WHEREAS, as a consequence, the Ukiah Valley Basin Groundwater Sustainability Agency does hereby find that current conditions meet the circumstances set for in Gov ernment Code section 54953(e)(3) to allow this legislative body to conduct its meetings by teleconferencing without compliance with Government Code section 54953 (b)(3), pursuant to Section 54953(e), and that such legislative body shall comply with the req uirements to provide the public with access to the meetings as prescribed by Government Code section 54953(e)(2) to ensure the public can safely participate in and observe local government meetings. RESOLUTION NO. 22-02 2 NOW, THEREFORE, BE IT RESOLVED by the Ukiah Valley Basin Groundwater Sustainability Agency, as follows: SECTION 1. RECITALS. All of the above recitals are true and correct and are incorporated into this Resolution by this reference. SECTION 2. STATE OR LOCAL OFFICIALS CONTINUE TO RECOMMEND MEASURES TO PROMOTE SOCIAL DISTANCING IN CONNECTION WITH PUBLIC MEETINGS. The Ukiah Valley Basin Groundwater Sustainability Agency finds that State or local officials continue to recommend measures to promote social distancing pursuant to Government Code section 54953(e)(3) to allow legislative bodies to use teleconferencing to hold public meetings in accordance with Government Code section 54953(e)(2) to ensure members of the public have continued access to safely observe and participate in local government meetings. SECTION 3. REMOTE TELECONFERENCE MEETINGS. The Ukiah Valley Basin Groundwater Sustainability Agency is hereby authorized to take all actions necessary to carry out the intent and purpose of this Resolution including, conducting open and public meetings in acco rdance with Government Code section 54953(e)(2) and other applicable provisions of the Brown Act. The due date for proposals was January 11, 2022 and two proposals were received, from Regional Government Services Authority (RGS) and West Yost. A four-member evaluation panel comprised of two Board members, one TAC Committee member, and one Member Agency staff was formed to review and rate the proposals and make recommendations to the Bo ard regarding award of an agreement. After independent rankings of the proposals by the four Ad-Hoc Committee members, West Yost received an overall score of 448.75 out of 500 and RGS received a score of 292.5. West Yost estimates administrative services will cost approximately $66,637, billed at an hourly rate in accordance with their current rate schedule. The Ad-Hoc Committee recommends the Board enter into an agreement with West Yost for UVBGSA administration services for a period of three years. Recommended Action: Receive Recommendation from the Proposal Review Ad-Hoc Committee and Direct Staff to Prepare an Agreement with West Yost for Administration Services for the Ukiah Valley Basin Groundwater Sustainability Agency (UVBGSA). Background: Article 6.1 of the UVBGSA By-Laws titled “Collaborative Management”, grants the UVBGSA Board the authority to adopt staffing solutions as it determines appropriate to meet the Agency’s Ukiah Valley Basin Groundwater Sustainability Agency Agenda Summary Page 2 of 2 needs, provided they are consistent with the terms of the Joint Powers Agreement (JPA). Article 13.4 of the JPA allows the UVBGSA to contract with private entities for various services to accomplish the purposes of the Agency, subject to approval of the Board of Directors. Fiscal Summary: The five-year budget projection developed to determine the funding needs of the UVBGSA, assumed an annual average of $58,620 for general administration of the Agency. This estimate was used in calculating the member contribution requests of $68,750 annually. To fill said vacancy, the Mendocino County Farm Bureau is submitting three nominees for the position of Alternate Agriculture Stakeholder Dir ector to the Board of Directors for their consideration. Recommended Action: Consider nominees and appoint an Agricultural Stakeholder Alternate Director to the Board. Background: Article 7.1.2.(a) of the Joint Powers Agreement (JPA) requires One (1) Agricultural Stakeholder Director. The Agricultural Stakeholder Director shall meet the following criteria, determined at the sole discretion of the Board Members: (1) be a resident of Mendocino County; (2.a) own/ lease real property in active commercial agricultural production overlying the Basin or (2.b) be an employee of a commercial agricultural production operation overlying the basin involved with water use decisions and (3) extract groundwater from the Basin for the irrigation/frost protection of at least fifteen (15) acres of agricultural crops in commercial operation. The Agricultural Stakeholder may not be a party to any pending litigation against the Agency or any of its Members. Article 7.3.2 (a) of the JPA state and Article 2.2.4 (Agriculture Member) states “The Agricultural Member shall meet the qualifications as described in 7.1.2(a) of the Agreement. The Members shall be selected from a list of three (3) nominations submitted from the Mendocino County Farm Bureau (MCFB), but the three (3) nominees need not be a member of the organization. The MCFB shall submit a nomination letter and completed applications of all three nominees. The MCFB must use the application approved by the Board of Directions. Larry Walker Associates (LWA) has been contracted by the County of Mendocino to prepare the Ukiah Valley Basin Groundwater Sustainability Agency’s (UVBGSA) annual report. LWA will give a presentation on the preparation of the upcoming annual report. Recommended Action: Receive presentation and possibly give direction to LWA or staff on the preparation of the First Annual Report on Implementation of the Groundwater Sustainability P lan. Background: The UVBGSA is required to submit an annual report for the Ukiah Valley Basin Groundwater Sustainability Plan (GSP) to the California Department of Water Resources (DWR) by April 1st of each year following the adoption of its GSP under the requirements of Water Code §10733.6. This first annual report will cover Water Year 2021. The objective of annual reports is to demonstrate to DWR during the implementation phase that progress is being made towards meeting intermediate milestones that are defined in the GSP, which will lead to meeting the sustainability goals for the Basin. The content requirements of the annual report are outlined in §356.2 of the GSP Regulations. On October 21, 2021, the UVBGSA Board of Directors directed staff to request a proposal from LWA for preparation of the first annual report and return to the Board at a future meeting for the Board to consider recommending to the Mendocino County Board of Supervisors (BOS) an amendment to the County’s existing Agreement with LWA to Ukiah Valley Basin Groundwater Sustainability Agency Agenda Summary Page 2 of 2 prepare the report. On November 10, 2021, the Board of Directors received a proposal from LWA for preparation of the first annual report and recommended to the BOS an Amendment to BOS Agreement No. 18-104, with LWA, to prepare the GSP first annual report and authorized a budget adjustment, in the amount of up to $15,000 to reimburse Mendocino County for the cost of the amendment to the Agreement. On December 7, 2021, the BOS adopted a resolution (Agenda item 4ac) approving Amendment Number Two to BOS Agreement No. 18-04, with LWA, in the Amended Amount of $1,868,560, for the Term of July 10, 2018 through June 30, 2022, for the Ukiah Valley Basin GSP Plan Development, which included the preparation of the first annual report.
