The Ukiah Valley Basin Groundwater Sustainability Agency’s Board of Directors shall confirm the Upper Russian River Water Agency’s (URRWA) Board of Directors’ appointment of Member Ross LaRue to the UVBGSA Board of Directors. c. Discussion and Possible Adoption of Recommendations from the Ukiah Valley Groundwater Sustainability Agency’s Financial Ad-Hoc Committee Meeting Regarding Funding for the Implementation of the Groundwater Sustainability Plan and the Annual Operating Costs The UVBGSA will receive a report from the UVBGSA Financial Ad-Hoc Committee, discuss and possibly adopt recommendations regarding funding for the implementation of the Groundwater Sustainability Plan and the annual operating costs. d. Ukiah Valley Basin Groundwater Sustainability Agency Agenda Summary Page 1 of 2 Item No.: 3.b Date: 8/13/21 To: Board of Directors Subject: Approval of the UVBGSA’s Emergency Drought Funding Request to the California Department of Water Resources Consent Agenda Regular Agenda Noticed Public Hearing Summary: The Mendocino County Water Agency recommends the Ukiah Valley Basin Groundwater Sustainability Agency (UVBGSA) Board of Directors approve UVBGSA’s emergency drought funding request to the California Department of Water Resources to address immediate monitoring and data collection needs and to begin implementation of projects to enhance water supply. Recommended Action: Approve UVBGSA’s Emergency Drought Funding Request to the California Department of Water Resources to address immediate monitoring and data collection needs and to begin implementation of projects to enhance water supply. Background: The Mendocino County Water Agency submitted a letter, signed by UVBGSA Chair Glenn McGourty, to the California Department of Water Resources on July 22nd requesting emergency funding due to the existing emergency drought conditions in the Ukiah Valley Basin and the Russian River Watershed. The GSA is developing a Groundwater Sustainability Plan which will be submitted in January 2022. While working on the GSP, the UVBGSA discovered the basin does not possess a long history of monitoring and measurements that would be helpful to effective management during emergencies and disasters such as the current drought. Specific data gaps have been highlighted in the GSP process and discussed with the stakeholders and the importance to fill those gaps has been fully approved. GSA funding through a regulatory fee structure will not be available until after the implementation of a regulatory fee study. Therefore, the UVBGSA is asking the California DWR to kindly consider its request for the
Ukiah Valley Basin Groundwater Sustainability Agency Agenda Summary Page 2 of 2 allocation of emergency funding to the UVBGSA for the following projects: Drought Monitoring and monitoring Network Implementation; Well Inventory Program including Well Analysis and Impact Mitigation Evaluation; and Aquifer Storage and Recovery (ASR) and Managed Aquifer Recharge (MAR) feasibility and implementation. Fiscal Summary: The funding request letter included requests for funding up to $250,000. Ukiah Valley Basin Groundwater Sustainability Agency Agenda Summary Page 1 of 2 Item No.: 4.a Date: 8/13/21 To: Board of Directors Subject: Discussion and Appointment of Tribal Stakeholder Director Consent Agenda Regular Agenda Noticed Public Hearing Summary: Through a majority vote by the six tribes exercising jurisdiction over Indian lands within the Ukiah Valley Basin—3 yes, 1 no, and 2 abstentions—Eddie Nevarez of the Redwood Valley Rancheria has been nominated to serve on the UVBGSA Board of Directors as the Tribal Stakeholder Director. The UVBGSA will confirm the nomination and appoint the Tribal Stakeholder Director upon simple majority vote of all Member Directors. Recommended Action: Review the nomination of Eddie Nevarez submitted by the six Tribes within the Ukiah Valley and confirm the appointment of the Tribal Stakeholder Director to the Board. Background: Article 7 Section 7.1.2 of the UVBGSA Joint Powers Agreement (JPA) provides that the UVBGSA Board of Directors shall consist of two Stakeholder Directors, one of which shall be a Tribal Stakeholder Director appointed by the six tribes exercising jurisdiction over Indian lands within the Ukiah Valley Basin identified as Redwood Valley Rancheria, Coyote Valley Reservation, Pinoleville Pomo Nation, Potter Valley Rancheria, Guidiville Rancheria and the Hopland Reservation. Through a majority vote, Eddie Nevarez has been nominated to serve as the Tribal Stakeholder Director on the UVBGSA Board of Directors. Section 7.3.2 (b) of the JPA provides that the Board of Directors confirm the nomination for the Tribal Stakeholder Director submitted by the six Tribes within the Ukiah Valley. The Member Directors shall confirm the nominee at a regular meeting and shall appoint the Tribal Stakeholder Director upon simple majority vote of all Member Directors.

The UVBGSA shall confirm the URRWA’s Appointment of Member Ross LaRue. Recommended Action: The Ukiah Valley Basin Groundwater Sustainability Agency’s Board of Directors shall confirm the Upper Russian River Water Agency’s (URRWA) Board of Directors’ appointment of Member Ross LaRue to the UVBGSA Board of Directors. Background: The Joint Powers Agreement (JPA) Forming the Ukiah Valley Basin Groundwater Sustainability Agency was made and entered into by the Upper Russian River Water Agency (URRWA), the Russian River Flood Control and Water Conservation Improvement District (RRFC), the City of Ukiah, and the County of Mendocino. Article 7 Section 7.1.1. of the UVBGSA JPA provides one representative appointed by the governing board of each Member, who shall be a member of the governing board of the Member (each, a “Member Director). The Upper Russian River Water Agency (URRWA) is a Joint Powers Authority (JPA) working for the consolidation of Ukiah’s Valley’s water. The board includes a single member from Willow County Water, Calpella County Water, Redwood Valley County Water, Millview County Water, and the Ukiah Valley Sanitation District. James Green was the Director of the Millview County Water District Board and was appointed to the URRWA Board as Millview’s representative whereas he was appointed as

James Green resigned from the position of Director of Millview County Water District effective June 2nd, 2021. Consent Agenda Regular Agenda Noticed Public Hearing Summary: On July 29th the Ukiah Valley Basin Groundwater Sustainability (UVBGSA) Financial Ad-Hoc Committee met to discuss potential funding for the administrative costs of the UVBGSA and the fee structure for funding Groundwater Sustainability Plan (GSP) implementation and long term administrative costs of the UVBGSA. The Board will receive a report, discuss and possibly adopt recommendations from the UVBGSA Financial Ad-Hoc Committee. Recommendations for funding mechanisms include member contributions in the immediate future for an average annual budget of approximately $275,000, until such a time that fees can be imposed, and conducting a fee study, funded by Member Agencies, in order to implement a regulatory fee. Recommended Action: The UVBGSA will receive a report from the UVBGSA Financial Ad-Hoc Committee, discuss and possibly adopt recommendations regarding funding for the implementation of the Groundwater Sustainability Plan and the annual operating costs. Background: Article 15.2. of the Joint Powers Agreement (JPA) states, “In order to provide the needed capital to initially fund the Agency, the Agency shall be initially funded by a contribution from initial Members in the amount established in the bylaws, which contribution shall be set at an equal dollar amount for initial Members. In subsequent years, the Agency may be funded through additional voluntary contributions by all Members, and as otherwise provided in Chapter 8 of SGMA (commencing with Section 10730 of the Water Code).” The Sustainable Groundwater

Regulatory fees, imposed pursuant to Water Code Section 10730, can be used for a wide variety of costs, including developing and implementing a GSP which includes preparation and adoption of a GSP, investigations, inspections, compliance assistance, enforcement, and general program administration, including a prudent reserve. Recommended Action: None. Background: The Ukiah Valley Basin Groundwater Sustainability Agency (UVBGSA), in coordination with Larry Walker Associates, is in the process of developing a draft of the Groundwater Sustainability Plan (Plan) for the basin that must be submitted to the California Department of Water Resources by January 31, 2022. Per Water Code Sections 10727.2, 10728, 10728.2, 10733.2, and 10733.8, SGMA regulations require the GSA to provide a written assessment of GSP implementation and progress towards meeting the sustainability goal at least every five years. A similar evaluation must also be submitted whenever the GSP is amended. The five-year assessment report will be completed in a format consistent with Section 356.4 of the SGMA regulations. The UVBGSA Board will discuss GSA’s activities and role, as defined by SGMA, between the approval of the GSP and the first evaluation by DWR 5 years later. Fiscal Summary: No fiscal impact.

The Ukiah Valley Basin Groundwater Sustainability Agency’s (UVBGSA) Groundwater Sustainability Plan (GSP) is still in development but, once approved, will establish a groundwater monitoring network. Currently, there is minimal data being collected on the impacts of the 2021 Drought on groundwater conditions. With authorization and funding from the UVBGSA, Mendocino County Resource Conservation District (MCRCD) can obtain landowner permission and conduct monthly groundwater monitoring on a subset of 15 CASGEM wells. The proposed budget for additional monitoring between the months of August and December is approximately $16,000.00. The Board of Directors will consider adjusting the Fiscal Year 2021-2022 Budget and requesting an additional $4,000 in member contributions from each member agency to reflect the additional costs of the proposed immediate groundwater monitoring. Recommended Action: Approve budget adjustment for immediate additional groundwater monitoring and authorize staff to expend funds for said monitoring, with funding from additional member contributions. Background: On April 20, 2021, by Resolution No. 21-051, the Mendocino County Board of Supervisors declared a local emergency due to drought conditions, which declaration of emergency was subsequently renewed on June 8, 2021. While Water Code Section 10727.2. states that a GSP needs to establish a monitoring network, the UVBGSA is still in the process of drafting and submitting a GSP and no such monitoring network yet exists. The California Statewide
Ukiah Valley Basin Groundwater Sustainability Agency Agenda Summary Page 2 of 2 Groundwater Elevation Monitoring (CASGEM) Program tracks seasonal and long-term groundwater elevation trends in groundwater basins statewide. There are currently 45 CASGEM wells monitored within the Basin, each of which are normally sampled twice a year. Additional monthly monitoring by MCRCD on a subset of 15 CASGEM wells would be critical in evaluating the short and long-term effects of the 2021 Drought on groundwater conditions within the basin. The additional monitoring will require the Board to amend the Fiscal Year 2021-2022 Budget and request additional member contributions from each member agency pursuant to article 15.2 of the Joint Powers Agreement (JPA) which states, “In order to provide the needed capital to initially fund the Agency, the Agency shall be initially funded by a contribution from initial Members in the amount established in the bylaws, which contribution shall be set at an equal dollar amount for initial Members. In subsequent years, the Agency may be funded through additional voluntary contributions by all Members, and as otherwise provided in Chapter 8 of SGMA (commencing with Section 10730 of the Water Code).” Fiscal Summary: The recommended action will require additional funding from member contributions in the amount of $16,000 ($4,000 each).
