Discussion and Possible Direction for Funding the Implementation of the Groundwater Sustainability Plan and Annual Groundwater Sustainability Agency Administration Costs Including Receiving Director’s Reports on Voluntary Contributions from Groundwater Sustainability Agency Member Agencies The Joint Powers Agreement (JPA) provides that the Groundwater Sustainability Agency (GSA) may be funded through additional voluntary contributions by GSA member agencies. The Board will receive reports from Directors on additional voluntary contributions by GSA member agencies and discuss possible funding mechanisms to pay for annual administration costs and implementation of the Groundwater Sustainability Plan. c. Presentation and Discussion Regarding the Progress and Timeline of the Groundwater Sustainability Plan Development The Board will receive a presentation from Larry Walkers and Associates on the progress of the Groundwater Sustainability Plan development and timeline for distribution and submittal. d. General Discussion on Ongoing 2021 Drought Crisis The Board will discuss and receive reports on water supplies in the Ukiah Valley Basin and drought mitigation measures in development. 5. DIRECTOR REPORTS 6. PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA The Board will receive public comments on items not appearing on the agenda and within the subject matter jurisdiction of the Agency. The Board will not enter into a detailed discussion or take any action on any items presented during public comments. One Tribal Stakeholder Director shall be appointed by the six tribes exercising jurisdiction over Indian lands within the Ukiah Valley Basin identified as Redwood Valley Rancheria, Coyote Valley Reservation, Pinoleville Pomo Nation, Potter Valley Rancheria, Guidiville Rancheria and the Hopland Reservation. Section 7.3.2 (b) of the JPA provides that the Board of Directors confirm the nomination for the Tribal Stakeholder Director submitted by the six Tribes within the Ukiah Valley. The Member Directors shall confirm the nominee at a regular meeting and shall appoint the Tribal Stakeholder Director upon simple majority vote of all Member Directors. Recommended Action: 1. Review the nominees submitted by the six Tribes within the Ukiah Valley and confirm appointment of the Tribal Stakeholder Director and Alternate Director to the Board. Background: In 2019, the six Tribes of the Ukiah Valley Basin nominated Brandi Brown, Redwood Valley Tribal Treasurer as Tribal Stakeholder Director and Sonny Elliott Jr., Hopland Reservation as Alternate Stakeholder Director for a two year term representing Tribal interests on the UVBGSA Board and TAC. Ex: Domestic wells ⚫GSA should clearly analyze stated rationale for setting quantitative SMC and how they would prevent undesirable conditions from occurring.◼Monitoring Networks⚫Provide clear strategyand details of wells and gages needed to complete the networks and the implementation schedule. Monitoring network data gaps cannot go unaddressed in the implementation.⚫Detailed yearly progress updates was recommended to be provided to DWR toward expanding the networks in the annual report.⚫The Plan identifies the lack of well construction information (e.g., the depth of well screens or the total depth of the well) for many groundwater quality monitoring wells as a data gap. The implementation chapter of the Plan simply states that “[d]uring implementation, the SVBGSA will obtain any missing well information, select wells to include in monitoring network, and finalize the water quality network.” Department staff recommend the SVBGSA provide updates on the progress toward filling this data gap in its annual reports and that more details be provided in the first five-year assessment of the Plan.Santa Cruz GSP (Approved)Cuyama GSP (Incomplete)Paso Robles GSP (Incomplete)Salinas GSP (Approved) DraftBasin Specific Notes From DWR Reviews that Relate to Ukiah Valley Basin GSP 16◼GDEs & ISWs⚫Plan should sufficiently explain the evaluation of GDEs and how the proposed management program for surface water will likely limit significant and unreasonable impacts to beneficial uses and users. GSA, through implementation of the Plan, intends to maintain depletions at or below conditions observed prior to 2015. Based on the above rationale, the Department determines that GSA considered public trust resources in development of the Plan.⚫The GSP states the surface water flows in the Subbasin over the period of record are “[e]phemeral” and “[t]here are no available data that establish whether or not the groundwater and surface water are connected through a continuous saturated zone” when describing current and historical groundwater conditions. Citing such “insufficient data to determine whether surface water and groundwater are interconnected,” the GSAs accordingly do not develop sustainable management criteria. The GSAs state “[d]efinitive data delineating any connections between surface water and groundwater or a lack of interconnected surface waters is a data gap” and provide a general schedule for surface and groundwater investigations in areas of potential interconnectivity planned over the next four years, with a $400,000 budget.⚫However, above information contradict water budget and other aspects showing leakage in the basin. They need to be at least monitored if they are not considered for SMCs. Department staff believe that setting the minimum thresholds at the state drinking water standards for all representative monitoring sites is reasonably protective.⚫DWR determined more work needed to appropriately define the scope of evaluation of WQ undesirable results and asked for such to be done in 5-year update.⚫DWR found that the approach to focus only on WQ impacts associated with GSP implementation is inappropriately narrow. Department staff recognize that GSAs are not responsible for improving existing degraded WQ conditions. GSAs are required to manage future GW extraction to ensure that GW use subject to its jurisdiction does not significantly and unreasonably exacerbate existing degraded WQ conditions.⚫DWR recommend that the GSA coordinate with the appropriate WQ regulatory programs and agencies in the Subbasin to understand and develop a process for determining when GW management and extraction is resulting in degraded WQ in the Subbasin.⚫DWR did not agree with not setting SMC for Nitrate and Arsenic although they exceeded MCLs. DWR requested better inventory and definition of active wells and impacts to them in annual reports since the plan indicated some shallow wells may be impacted if MTs are reached.⚫Preventing GWE lower than 2015 is deemed reasonable. Plan should provide credible and thorough assessment of impacts to domestic wells.⚫GSA provided general statements about undesirable results and generic description of the effects of them. It did not explain specific significant and unreasonable conditions it tries to avoid.(We need to revise). GSP should explain why such effects were selected for undesirable results or how the GSAs determined that they will be avoided by managing to the established criteria for chronic lowering of groundwater levels.⚫GSP use 30 percent of monitoring wells going below MTs for 2 consecutive years for GWE, storage, WQ, subsidence, and depletion. But it fails to explain why this is consistent with avoiding significant and unreasonable effects. (We are using a similar approach and should consider this)⚫We need to be specific, explain thoroughly and provide quantitative measures. No historical subsidence explained through available DWR data and no measuring points in the Basin. They used two different approaches, and both were acceptable.⚫GSP avoided setting SMC and instead will monitor using DWR data. Then, they assign shallow GW levels as proxy for MTs. They used the model to show complexities of correlating depletion with pumping and other impactful components. DWR approved their method and SMC due to using best information and science available at the time and appropriately proposed actions to cover data gaps. ⚫Plan state the current level of estimated depletions are considered potentially significant but not unreasonable. The Plan states that “since flow requirements were being met under the 2007 biological opinion, surface water depletion rates were not unreasonable with regards to maintaining environmental flow requirements.”⚫DWR focused on Plan’s rationale not to exacerbate depletions since SVIHM was not yet fully available.⚫DWR asked for annual calculation of depletion instead of only on five-year reviews. DWR also required further actions during the review to complete characterization of ISWs and calculation of depletion.⚫DWR proposed corrective action to explain and justify the use of GWE for depletion.⚫DWR had issue with using all the GWE thresholds it defined for chronic lowering of groundwater levels regardless of depth of the well or proximity to surface water.
