RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH INITIATING THE PROPOSITION
218 PROCESS FOR PROPOSED ADJUSTMENTS TO SEWER SERVICE RATES AND SETTING
A PUBLIC HEARING DATE
WHEREAS, the City of Ukiah operates a sewer utility enterprise that is funded entirely by customer
charges and must generate sufficient revenue to cover its operating, maintenance, capital, and
debt service costs; and
WHEREAS, the City has engaged Hildebrand Consulting to prepare a comprehensive financial plan
and rate study for the sewer utility in order to assess the adequacy of existing rates and
recommend any necessary adjustments; and
WHEREAS, the rate study identifies the need for a series of rate increases to address operating and
capital funding needs, including rebuilding reserves, responding to increased operating costs due to
inflationary pressures, higher insurance costs, and a new allocation of Recycled Water
Program expenses; and
WHEREAS, Article XIII D, Section 6 of the California Constitution (Proposition 218) requires that
property owners and customers be notified of proposed increases to property -related charges, such
as sewer service rates, and be given the opportunity to protest those increases through a
written protest process; and
WHEREAS, Proposition 218 requires that a notice of the proposed rate increase be mailed at least
45 days in advance of a public hearing at which the City Council will consider adoption of the proposed
rates.
NOW, THEREFORE, BE IT RESOLVED that:
1. Initiation of Proposition 218 Process: The City Council hereby initiates the Proposition 218
protest process for proposed adjustments to sewer service rates, consistent with the
recommendations presented in the 2025 Sewer Rate Study prepared by Hildebrand Consulting.
2. Public Hearing Scheduled: A public hearing is hereby scheduled for September 17, 2025, at
5:15 PM, at a regular meeting of the City Council, to consider the proposed sewer rate
adjustments and to receive and tabulate written protests from property owners and customers,
as required by Proposition 218.
3. Notice to be Mailed: City staff is authorized and directed to prepare, print, and mail the required
Proposition 218 notice of the proposed sewer service rate adjustments to all affected property
owners and customers of record no later than August 2, 2025, which is at least 45 days before
the scheduled public hearing.
4. Public Availability: The 2025 Sewer Rate Study shall be made available for public inspection
during regular business hours at the City Clerk's Office and posted on the City's website.
