HomeMy WebLinkAboutButte Creek Property Corporation 2024-07-24BCSO LEMA Page 1 of 2 MEMORANDUM OF AGREEMENT BETWEEN BUTTE COUNTY AND CITY OF UKIAH FOR ASSISTANCE UNDER THE LAW ENFORCEMENT MUTUAL AID PLAN WHEREAS, on July 24, 2024, a wildfire (referred to hereafter as the Park Fire) spread rapidly and burned through thousands of acres of unincorporated Butte County including the mountain communities of Cohasset and Forest Ranch. The fire originated in an unincorporated area of Butte County in the northeast portion of Upper Bidwell Park and consistent wind blew the fire north and northeast through Cohasset and Forest Ranch and then spread into Tehama County. Approximately 19,000 people were evacuated and more than 750 structures were damaged or lost. The fire was intentionally set and the individual responsible has been arrested. Conditions that contributed to this event include, but are not limited to: drought conditions for several years and persistent high temperatures, wind, and dry weather; and WHEREAS, on July 25, 2024, the Federal Emergency Management Agency (FEMA) approved emergency assistance through the major disaster declaration (FEMA-5519-FM-CA); and WHEREAS, the Law Enforcement Mutual Aid Plan is issued and revised under the authority of Sections 8550, 8569, 8615 through 8619, and 8668 of the California Government Code, the California Emergency Plan, and the Master Mutual Aid Agreement; and WHEREAS, the Law Enforcement Mutual Aid Plan delineates the current state policy concerning law enforcement mutual aid; and WHEREAS, the Law Enforcement Mutual Aid Plan describes the standard procedures used to acquire law enforcement mutual aid resources and the method to ensure coordination of law enforcement mutual aid planning and readiness; and WHEREAS, the county sheriff is the Operational Area Law Enforcement and Mutual Aid Coordinator; and WHEREAS, Law Enforcement Mutual Aid Plan provides, in pertinent part, "When an emergency develops or appears to be developing which cannot be resolved by a law enforcement agency within an Operational Area, it is the responsibility of the Operational Area Mutual Aid Coordinator to provide assistance and coordination to control the problem;" and WHEREAS, the Law Enforcement Mutual Aid Plan provides, in pertinent part, "A request for law enforcement mutual aid requires the approval of the chief law enforcement officer of the requesting jurisdiction;" and WHEREAS, the Sheriff of Butte County requested the mutual aid assistance of the City of Ukiah, pursuant to the Law Enforcement Mutual Aid Plan to support law enforcement services in connection with the Park Fire; and WHEREAS, the City of Ukiah, provided mutual aid assistance consisting of law enforcement personnel, equipment, and materials from July 24, 2024 through August 5, 2024 to assist with law enforcement services in connection with the Park Fire; and COU No. 2425-114 BCSO LEMA Page 2 of 2 WHEREAS, the City of Ukiah agrees to document all of its mutual aid assistance costs related to the Park Fire, as attachments to this MOA, and submit to Butte County as soon as possible upon execution of this MOA; and NOW, THEREFORE, IT IS HEREBY AGREED by and between the City of Ukiah and Butte County, that Butte County may reimburse all reasonable costs associated with law enforcement mutual aid assistance during the Park Fire.
