Freeway Agreement

Gentlemen:
In connection with the freeway on Route 101
between 0. 1 mile south of Gobbi Street and Perkins Street,
it is desirable that the City of Ukiah and the State of
California enter into an agreement regarding the status
of public roads entering the new freeway.
There is attached such proposed agreement, which
is to be executed in duplicate. The agreement itself is
in general form with the details shown on the map attached
to and made a part of the agreement.
The agreement is necessary to indicate responsi-
bility with regard to the proposed pedestrian overcrossing
to the Oak Manor School. All of the freeway within the
City of Ukiah has been included in the agreement. This
was done only for clarity and continuity, and does not in
any way alter obligations which the City previously had
with regard to the freeway appurtenances . These obliga-
tions were assumed from the County through annexation of
the Gobbi Street interchange area.
It is respectfully requested that the Council
execute and return two copies of the agreement and map,
together with two copies of the usual certification of
authorization by the City Clerk. It is also requested
that the date of execution of this agreement be left
blank, as it will be inserted when the agreement is
signed by our Headquarters Office. Upon execution by
the State, one fully executed copy of the agreement will
be returned to the City.

Crook, It was unanimously carried Freeway Agreement 01-Men-101-23.9/24
be approved and the Mayor and Clerk be authorized to sign same.
REPORT RE. PURCHASE OF
POULOS PROPERTY - N.E.
CORNER PERKINS & MAIN STS,
The City Attorney reported that an escrow had been opened in
connection with the purchase of the Poulos property at Perkins
and Main Streets, and arrangements are being made with the bank
for deposit of the funds called for in the purchase agreement.
REQUEST FOR VACATION OF PORTION
OF CUL DE SAC - W. END OF MILL ST.
A letter requesting abandonment of a portion of the cul-de-sac
at the West end of Mill Street and indicating agreement as to
how the abandoned property would be divided signed by Ruel Stickney,
Lee White and Larry Baldwin was read by the City Attorney.
On a motion by Councilman Harlowe, seconded by Councilman Crook,
It was unanimously carried the request for abandonment of a portion
of the cul-de-sac at the W. end of Mill Street be referred to the
Planning Commission for report and recommendation.
PUBLIC UTILITIES COMMISSION
LEAGUE OF CALIF. CITIES BRIEF
RE. UNDERGROUND UTILITIES

The City Attorney reviewed the League of California Cities Brief
relative to the Public Utilities Commission investigation into
the requirements for a General Order providing rules governing
construction of underground electric and communication lines in
the State of California.
CLOSED PERSONNEL SESSION
At this point in the meeting, 9:08 P.M., the Council retired to
adjoining chambers for a closed personnel session, and returned to
continue in open session at 9:42 P.M.
CITY MANAGER REPORTS RE.
WATER SHORTAGE
A summary report was made by the City Manager on all factors
pertaining to the water shortage of Monday and Tuesday including
suggestions for scheduling water use by major consumers in order
to gain some control over the peak demand periods.
WHITE HOUSE LETTER RE.
CURBSIDE MAIL DELIVERY
A letter was read from the White House in reply to receiving a
L copy of the resolution recently adopted by the Council in opposition
to the requirement for curbside delivery of mail in new subdivisions
by the Post Office Department.
REPORT RE. POLICE PURSUIT
DRIVER TRAINING
The City Manager reviewed a report submitted by Police Chief
Saulsbury relative to the Police Pursuit Driver training recently
attended by the first group which will receive this training under
the direction of the Los Angeles County Sheriff's department.

A letter was read from Charles R. Bell, Attorney for the Estate
of Cecil E. Winch. indicating acceptance of- the City's offer
of $7500 for purchase of property south of the Airport which would
complete the Airport Clear Zone project. A form of bid supplied by
the Attorney was also read in full .
On• a motion by Councilman Crook, seconded by Councilman Harlowe, F
it was unanimously carried the City Council approve the offer of
$7,500 for purchase of property belonging to the Estate of
Cecil E. Winch, and the Mayor and Clerk be authorized to sign the
form of bid provided.
VARIANCE APPLICATION NO. 66-30
A.L. ANTONI - REDUCTION OF SETBACKS
LOUISE CT. & OAK ST.
Variance Application No. 66-30 by A.L. Antoni to- permit encroach-
ment into the required setback at the West end of Louise Court
and along Oak Street for construction of an apartment building,
plot plan and minutes of the Planning Commission meeting of May
19th, 1966 were reviewed by the City Manager. Resolution No. 66-28
of the Planning Commission recommending approval of the variance
subject to the special condition that drainage facilities be
provided in accordance with the requirements of the City Engineer
was also read.
There were no persons present on behalf of the application, and
no written or verbal objections to granting the proposed variance.
On a motion by Councilman Scotto, seconded by Councilman Harlowe,
it was unanimously carried the City Attorney be instructed to pre-
pare a resolution granting Variance No. 66-30 to A. L. Antoni
as recommended by the Planning Commission.
PROPOSED AGREEMENT FOR CONSTRUCTION
OF FREEWAY PEDESTRIAN OVERCROSSING
The City Manager reported that in connection with construction of
a freeway pedestrian overcrossing between Perkins and Gobbi
Street to serve Oak Manor School, a revised map has been provided
by the State Division of Highways which now meets with the approval
of all agencies concerned. The project would involve construction
of walkways to the structure by the City at School District expense,
with subsequent maintenance of the easement by the City. The
Freeway Agreement provided by the State was read in full by the City
Attorney.
After discussion, it was agreed that approval be deferred for one
week to permit thorough evaluation of the proposed agreement by
the City Attorney.
REPORT RE, PAVING OF ALLEYS
The City Manager reported that seven blocks of alley-ways have
been paved within the past two weeks which has resulted in many I
favorable comments from adjacent residents. L
REQUEST AND AUTHORIZATION TO CALL
FOR BIDS 1200 FEET CEMENT MORTAR
LINED STEEL, WATER PIPE
In connection with the project for construction of the water
collector system, the Council was requested to authorize a bid
call for 1200 feet of 18" cement mortar lined steel water pipe.
On a motion by Councilman Scotto, seconded by Councilman Henderson,
it was unanimously carried the Clerk be authorized to call for
bids for 1200 feet of 181" cement mortar lined steel water pipe
in accordance with specifications reviewed by the City Manager, bids
to be received prior to 2;00 P.M. , June 28, 1966.

FREEWAY AGREEMENT
This agreement, in duplicate, made and entered into
this ,{'• "`ti { day of - , 1966, by and
between the State of California, acting by and through the
Department of Public Works, Division of Highways, hereinafter
for convenience referred to as "the State," and the City of
Ukiah, hereinafter for convenience referred to as "the City,"
witnesseth:
WHEREAS the California Highway Commission has adopted
a resolution on February 15, 1956, declaring that certain section
of State Highway Route 101 in the County of Mendocino between
Robinson Creek and 0.8 mile south of Forsythe Creek to be a
freeway, and
WHEREAS the State and County of Mendocino have
previously entered into a freeway agreement dated October 16,
1962, relating to the freeway section between Robinson Creek
and 0.8 mile south of Forsythe Creek, and
WHEREAS the City has subsequently annexed portions
of former County territory including a portion of Route 101
covered by said freeway agreement dated October 16, 1962, and
WHEREAS subsequent to entering into said freeway
agreement a revised plan map for a portion of such freeway in
the City of Ukiah between 0.1 mile south of Cobbi Street and
Parkins Street has heretofore been prepared showing the proposed
plan of the State as it affects streets of the City, including
provision for closing City streets, for carrying City streets
over or under or to a connection with such freeway, for relocation
of City streets, and for construction of frontage roads and
other local roads.
NOW, THEREFORE, it is agreed:
1. The City agrees and consents of the closing of
City streets, relocation of City streets, other construction

affecting City streets, and for the construction of frontage
y roads and other local roads if and when the occasion therefore

arises all as shocm on the plan map attached hereto and marked
y Exhibit "A", and by this -reference made a part hereof.
2. The State, in construction of said freeway will,
at the State's expense, make such changes affecting City streets
in accordance with the said plan map 'attached hereto or as the
i same may hereafter be modified by mutual agreement between the
parties hereto, except that the City shall acquire rights of
way for and construct at City expense the sidewalks leading to
the pedestrian overcrossing located between Gobbi and Perkins
Streets, The State may, at the State's expense, install signs,
signals, and other traffic control devices at appropriate
locations to be determined by the State in order to regulate,
warn, or guide traffic upon the highways.
3. The City will accept control and maintenance of
the relocated, reconstructed, or otherwise altered City streets
and frontage roads, and other State constructed local roads, on
notice to the City from the State that the work herein provided
for on such roads has been completed except as to any portion
thereof which is adopted by the State as a part of the freeway
proper. The City will also accept title to the portions of
} such streets lying outside the freeway limits, upon relinquish-
f went by the State.
4. This agreement may be modified at any time by
the mutual consent of the parties hereto as may become necessary
for the best accomplishment through State and City cooperation
of the whole freeway project for the benefit of the people of '
the State and of the City.
