This agreement made and entered into this 9th day of May 2024 by and between Mykal Rose Hereinafter referred to as “ARTIST” and City of Ukiah Hereinafter referred to as “BUYER”. It is mutually agreed between the ARTIST and BUYER as follows: 1.Venue: Sundays in the Park, concert series Venue Contact: Jake Burgess Venue Address: Todd Grove Park, Ukiah, CA Venue Phone: (707) 391-3693 2.Event:: Sundays in the Park, concert series BUYER Phone: (707) 463-6201 3.Date of Engagement(s): Sunday July 28, 2024 Performance Time: tbd, 90 min 4.The Buyer agrees that in consideration of the services performed by ARTIST to pay the sum of: $6,500 guarantee Hotel: 3 single hotel rooms and 2 double hotel rooms plus a $300 hotel buyout for 2 hotel rooms in Emeryville, CA July 27 (they need to fly in the day before the show) Meals: $25 meal buyouts for 6 people ($150) and the riders 5.Deposit Required: Deposit in the sum of $3,250 plus the $300 hotel buyout for 2 hotel rooms July 27 ($3,550 total) is due upon signing the contract (prior to announcing the artist) 6.Deposit to be made by: (1) bank wire or direct bank deposit to: Peter Wardle - Kings Music International, Citibank Account #: 205684970 or Wells Fargo Account # 1585253394 or (2) in the form of a cashier’s check or bank check payable to: Peter Wardle - Kings Music International. P.O. Box 3505, Oakland, CA 94609 Balance of $3,250 to be paid to the artists in cash prior to the performance. 7.Arrival load in: tbd Sound Check: tbd 8.Miscellaneous Conditions: A bass amp, guitar amp and a complete drumkit are to be provided by the buyer. CANCELLATION: Until the buyer has executed the contract and Kings Music International has received the deposit, the artist retains the righ t to cancel and or make changes to this Agreement. In the event that the artist cancels for any reason, the advance deposit will be returned in full. If Venue/Promoter cancels show for any reasons (not withstanding natural disasters/catastrophes) without at least (5) five weeks notice to band, Venue/Promoter forfeits advance deposit. If the Venue/Promoter cancels any performances less than (2) weeks before the date of such performances, Venue/Promoter will pay the artist, as liquidated damages, the full guaranteed fee agreed to be paid for such performances. The agreement that musicians perform is subject to detention by sickness, accident, riot, strikes epidemic, acts of God or other legitimate conditions beyond their control. DISPUTES: In the event of any dispute that arises under this agreement that results in litigation or arbitration, the losing party shall pay the prevailing party reasonable attorneys fees and costs. This contract shall be governed by California state law, may be modified only by signed writing, and is binding and valid only when signed by the parties below and the deposit is in. COU No. 2324-205
