Except as expressly amended by this Amendment, all other terms remain unchanged and in full force and effect. As previously discussed, a significant amount of free product was encountered in monitoring well MW-4 during the December 15, 2023 groundwater sampling event at the former Leslie Street Gas Plant site. The amount of free product in the well prevented a reliable measurement of the product thickness since the entire length of the product interface probe was coated in thick black product but is estimated to be at least two to three feet in thickness based on field observations. These conditions are unanticipated based upon previous analytical data collected in 2004, 2005, 2011, and 2012. On December 15th, EBA collected a product sample from MW-4 which was analyzed by K Prime, Inc. (K Prime), a state-certified laboratory in Santa Rosa, California. Prior to analysis, EBA discussed the concerns of potential vandalism to the monitoring well with K Prime’s chemist. Based on the analysis, the chromatogram does not exhibit the typical pattern for waste oil and the analytical signature of the product sample closely resembled that of the other groundwater samples collected during this monitoring event as well as historical samples collected in 2004/2005 & 2011/2012 which were also analyzed by K Prime. Thus, there is no obvious indicator of dumping into the well. EXHIBIT 1 2 SCOPE OF WORK Based on the conditions observed, EBA previously provided the following recommendations to the City of Ukiah for additional work: • Schedule a phone call with the North Coast Regional Water Quality Control Board (NCRWQCB) to inform them of the field conditions. As previously requested by the City of Ukiah, EBA will be available to join the discussion with the NCRWQCB. • Remobilize to the site to remove the free product, to the extent feasible, from MW-4 to allow for collection of a representative groundwater sample. After product removal, EBA will purge the monitoring well and collect a groundwater sample which would be expected to have significantly lower concentrations of site constituents. The resampling data will be presented in the Fourth Quarter 2023 Groundwater Monitoring Report. COST ESTIMATE The estimated cost to perform the Additional Services is as follows: Task 1: Phone Meeting with the NCRWQCB  Labor: $170 Task 2: Product Removal and Resampling  Labor (remobilization, product removal/containerization, monitoring well purging and sampling): $550  Materials/Supplies: $250  Analytical Testing: $340 Total Cost: $1,310.00 The Additional Work described herein would be billed on a time-and-materials basis not to exceed $1,310.00. ASSUMPTIONS For the purposes of developing the scope of work and the cost estimate, the following assumptions were made: • Field work (monitoring and sampling) is not subject to prevailing wage. • There is free and open access to the site. • The analytical testing will be performed on a standard 10-day laboratory turn-around time. • The costs described above assume that one groundwater sample will be collected from MW-4 following product removal and analyzed for the site constituents of 3 concern (Diesel Range Organics, Heavy Range Organics, and Polyaromatic Hydrocarbons). •It is assumed that free product removed from MW-4 will be appropriately labeled, containerized in a steel drum, and transported to the City of Ukiah Corporate Yard where it will be stored pending subsequent characterization and disposal as part of a future scope of work. Costs associated with disposal of the drum are not included as part of this scope of work. LIMITATIONS Throughout this project, additional information may become available. This new information may result in a change in the scope of work, which may result in a change in the cost of the project. EBA will notify the client when there is a change in the cost and will not proceed without prior approval of the changes from the client. Throughout the project, EBA will make every effort to reduce the cost of the project by negotiating with regulatory agencies or landfills to eliminate unnecessary procedures and/or analytical costs.
