ORANDUM OF UNDERSTANDING CITY OF UKIAH POLICE DEPARTMENT DELEGATES TO CODE ENFORCEMENT DIVISION THE AUTHORITY TO ENFORCE ABANDONED VEHICLE REMOVAL ORDINANCE IN ACCORDANCE WITH UKIAH CITY CODE§7605 Agreement made this day of �phJUp�R~ , 202by and between: City of Ukiah: Police Department and City of Ukiah: Code Enforcement Division both having a place of business located at 300 Seminary Ave, Ukiah CA 95482. Whereas, the City of Ukiah participates in the State of California Abandoned Vehicle Abatement Program as a Joint Powers Authority ("J.P.A.") with the County of Mendocino Code Enforcement Division for reimbursement of costs incurred as a result of the removal of vehicles in accordance with California Vehicle Code § 22660, and Whereas, the Ukiah City Code("U.C.C.") Division 8, Chapter 8, entitled Abandoned vehicle Removal("Abandoned Vehicle Removal Ordinance") states that the administration and enforcement of this Chapter shall be the responsibility of the Chief of Police or his designated representative, The Police Department and Code Enforcement Division agree as follows: i. Purpose of this MOU To establish a cooperative and mutually beneficial relationship to administer and enforce the Abandoned Vehicle Removal Ordinance. This local program is integrated into the larger State-funded Abandoned Vehicle Abatement Program under the California Vehicle Code. In accordance with U.C.C. §7605, the Chief of Police accepts the assistance of and designates the City's Code Enforcement Division as the entity with the authority and duty pursuant to U.C.C. § 760E and other relevant applicable of the U.C.C. to undertake abatement actions for vehicles abandoned on public roadways. Goal: To proactively assist the U.P.D. in removing abandoned vehicles under the applicable provisions of the California Vehicle Code and Ukiah City Code, either in response to citizen complaint, or as a result of situations observed during the normal business activities of the Code Enforcement Division. ii. It is understood by both parties that each should fulfill its responsibilities under the MOU in accordance with the applicable provisions of law and regulations or operating procedures that govern their activities. Nothing in this MOU is intended to negate or otherwise render ineffective any such provision or operating procedures. iii. Responsibilities of the Parties: In consideration of the mutual aims and desires of the parties of this MOU and in recognition of the public benefit from effective implementation of the Abandoned Vehicle Removal program, the parties agree that their responsibilities under this agreement shall be as follows: A. The Ukiah Police Department shall retain responsibility for vehicle removal in the course of regular business, traffic stops, or seizures of property in accordance with the law. U.P.D. dispatchers will accept and route calls to the Code Enforcement Division for complaints of vehicles left on public roadways, provide DMV reports, and enter required information into CLETS. U.P.D. will provide assistance to the Code Enforcement Division by contacting assigned tow companies and routing to scene, in the event that the Division orders removal of an abandoned vehicle pursuant to the Abandoned Vehicle Removal Ordinance, and handling invoicing and reporting, and administrative oversight to ensure compliance with the J.P.A. and the State Program. B. The Code Enforcement Division shall be the primary enforcement authority within the City of Ukiah, for the removal of abandoned vehicles from public roads in accordance with Vehicle Code § 22651 and the City's Abandoned Vehicle Removal Ordinance. The Code Enforcement Division shall record and enter all observed violations through their case tracking system.The Code Enforcement Division will work with the J.P.A. to report and receive payments for vehicle tows under the California Abandoned Vehicle Abatement Program. The Code Enforcement Division will maintain records, invoices, and tow reports available and document removal of any vehicle within the City limits that is removed pursuant to the Abandoned Vehicle Removal Ordinance. All parties shall accept the above responsibilities and will provide input regarding the implementation and administration of the City's Abandoned Vehicle Removal Ordinance. iv. Duration of MOU This MOU becomes effective on the date signed and shall remain in full force and effect until specifically abrogated by one of the parties to this MOU with sixty (60) days' notice to the other party. V. Execution of this MOU 1. This MOU shall be renewed on an as needed basis and shall remain in full force and effect unless the MOU ends in accordance with the termination provision set forth herein. 2. Effective execution of the MOU can only be achieved through continuing communication and dialogue between parties. It is the intent of the MOU that channels of communication will be used to resolve questions, misunderstandings, or complaints that may arise that are not specifically addressed in the MOU.
