2. AUDIENCE COMMENTS ON NON-AGENDA ITEMS
The City Council welcomes input from the audience. If there is a matter of business on the agenda that you are interested in,
you may address the Council when this matter is considered. If you wish to speak on a matter that is not on this agenda, you
may do so at this time. In order for everyone to be heard, please limit your comments to three (3) minutes per person and not
more than ten (10) minutes per subject. The Brown Act regulations do not allow action to be taken on audience comments in
which the subject is not listed on the agenda.

3.a. Conference with Legal Counsel—Anticipated Litigation
(Government Code Section 54956.9(d)(2))
Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Gov’t Code
Section 54956.9: (1 potential case concerning incident and arrest by Ukiah Police Department
occurring on April 1, 2021.)
Recommended Action: Confer in Closed Session

Subject: Item 3.a l Training Suggestion
Dear City Council Members,
Like many in our community I am in shock by the contents of the video footage from last week's arrest. Clearly
there is a lot of work to do in regards to policing in our community. I urge you to reach out to Train 4
Transformation. This organization has vast experience helping communities heal and create action towards
healing through training in community conscious policing.
The issues with police, power, and their role in community run deep (beyond a few bad apples or lack of
training). Let's really think about the type of training that they should be receiving. In these times I urge you to
think proactively and work with our police department to give them the tools to be trusted allies within our
community.

Subject: UPD Beating of Mentally Ill Man
Dear City Council,
I am deeply disturbed by the violent actions of the UPD against a mentally ill man, Gerardo Magdaleno, in Ukiah. I
actually no longer feel safe in our town, and that fear is of the violence of UPD. This is unacceptable behavior coming
from those who are sworn to serve and protect. The City of Ukiah has this incredible opportunity to make things right.
Being mentally ill is not a crime, and even criminals deserve due process! When is beating a person ever acceptable
action?
Please, do everything in your power to bring justice for this man, and all mentally ill people in Ukiah.

Dear City Council,
I attempted to make a public comment orally this evening, but it seems something was wrong with my mic, or
my mics connection to the event.
My name is Max Hare. I'm relatively new to Ukiah. I just moved here in late January for work, and so far I like
it very much. I moved here to work as a public defender, but my comments are made in my individual capacity
as a resident of Ukiah and don't represent those of my office.
In addition to a law degree, I received a master's in public policy from UC Berkeley, and during that time I
worked closely with public organizations, including the UC Regents, to consider police accountability and
reimagine what public safety can look like with a less police-centric lens.
Like the journalist who left the first comment, I too have heard there will be an independent investigation
regarding this UPD incident. I would like to know more about the details: who will be leading it, how will it be
conducted, and how much will it cost. Right when I arrived, my office was dealing with fallout from the UPD
Officer Murray debacle. In light of that, I think an independent investigation not limited to the Magdalena
incident, but one that includes a department-wide audit, would be appropriate.
In my experience, law enforcement agencies are typically hesitant to give up authority, power, and
responsibility. Yet we ask them to do too much, in the name of "public safety," that too often leads to violence
and fear, especially for poor people, people of color, people with disabilities, and gender nonconforming people.
In fact, often in response to moments of backlash to police policies and tactics, law enforcement agencies ask
for more investment from the public, for trainings, new tools, and community interventions. Over and over this
has been shown to fail.
Instead, in addition to an independent investigation, the City Council should consider devoting resources to
researching with the goal of implementing non policing-centric models of public safety, for instance non law
enforcement first response teams for mental health crises.
I want Ukiah to thrive. So when I say that I'm glad the city faces a risk of a costly civil settlement, it's only in
this capacity: I think lawsuits are one of the only ways that a government agency can objectively acknowledge
the value of investing in alternatives to police.
