Special Meeting Minutes of July 20, 2006 - Fire Master Plan RIGHT TO APPEAL DECISION Persons who are dissatisfied with a dec[sion of the City Council may have the right to a review of that decision by a court. The City has adopted Section 1094.6 of the California Code of Civil Procedure, which generally limits to ninety days (90) the time within which the decision of the City Boards and Agencies may be judicially challenged. CONSENT CALENDAR The following items listed are considered routine and will be enacted by a single motion and roll call vote by the City Council. Items may be removed from the Consent Calendar upon request of a Councilmember or a citizen in which event the item will be considered at the completion of all other items on the agenda. The motion by the City Council on the Consent Calendar will approve and make findings in accordance with Administrative Staff and/or Planning Commission recommendations. a. In order for everyone to be heard, please limit your comments to three (3) minutes per person and not more than ten (10) minutes per subject. URGENCY ITEM DATE: August 16, 2006 AGENDA SUMMARY REPORT SUBJECT: REJECTION OF BID FOR LAKE MENDOCINO HYDROELECTRIC PLANT TAINTER VALVE MODIFICATION PROJECT SUMMARY: The City solicited bids for the modification of the Tainter valve at the Lake Mendocino Hydroelectric Plant. The modifications are necessary to commence operation of the plant to generate electricity. The engineer's estimate for this work was $140,000. After soliciting bids in compliance with the California Uniform Public Construction Cost Accounting Act, including 14 days advance publication in the newspaper and 30 days notice to trade journals, the City received only one bid from Richardson Engineering Contracts in Healdsburg. The bid is for $419,454, or three times the engineering estimate. Staff recommends rejecting this bid. If the City Council rejects the bid, staff intends to rebid the project with the notice inviting bids going out Thursday morning, August 17th after the City Council meeting. In accordance with Public Contracts Code Section 22038, the bidder was given two days advance written notice of staff's recommendation to reject all bids. The staff is requesting this item to be added to the agenda as an urgency measure. The bids were opened on August 14, 2006, after the agenda was posted. To prevent undue delay in construction resulting from the time required to rebid, a need exists to reject the bid before the next scheduled City Council meeting. RECOMMENDED ACTION: Agendize by a 4/5 vote and reject the bid. ALTERNATIVE COUNCIL POLICY OPTION: Accept the bid.
