CALL TO ORDER The City of Ukiah Planning Commission held a Regular Meeting on February 8, 2023. The meeting was legally noticed on February 3, 2023. The meeting was held in person and at the following virtual link: https://zoom.us/j/91264543193. Chair Christensen called the meeting to Order at 6:00 p.m. CHAIR CHRISTENSEN PRESIDING. 2. ROLL CALL Roll was taken with the following Commissioners Present: Alex de Grassi, Michelle Johnson, Rick Johnson, and Laura Christensen. Newly Elected Commissioner Present: Thao Phi. Commissioner Absent by Prearrangement: Mark Hilliker. Staff Present: Craig Schlatter, Community Development Director; Jesse Davis, Chief Planning Manager; Darcy Vaughn, Assistant City Attorney; and Kristine Lawler, City Clerk. 3. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Chair Christensen. a. Certificate Presentation for Outgoing Commissioner, and Swearing In of New and Reappointed Commissioners. Presenters: Kristine Lawler, City Clerk and Craig Schlatter, Community Development Director. Director Schlatter presented a Certificate of Appreciation to outgoing Chair Christensen. Chair Christensen passed the gavel to Commissioner Rick Johnson, who moved to the Chair position. COMMISSIONER RICK JOHNSON PRESIDING. City Clerk Lawler administered the Oaths of Office to Alex de Grassi and Thao Phi for their recent appointments by the City Council. 4. APPROVAL OF MINUTES a. Approval of the Minutes for the December 14, 2022, Regular Meeting. Motion/Second: de Grassi/ M. Johnson to approve the minutes of the December 14, 2022, regular meeting, with administrative corrections as discussed. Motion carried by the following roll call votes: AYES: Phi, de Grassi, M. Johnson, and R. Johnson. NOES: None. ABSENT: Hilliker. ABSTAIN: 5. APPEAL PROCESS No appeals were received. 6. COMMENTS FROM AUDIENCE ON NON-AGENDA ITEMS No public comment was received 7. NEW BUSINESS a. Ordinance Amendment to Ukiah City Code to allow for ‘Cannabis Consumption Areas’ at ‘Cannabis Retailers’ upon modification or approval of a Use Permit. Presenters: Jesse Davis, Planning Manager; Craig Schlatter, Community Development Director; and Darcy Vaughn, Assistant City Attorney. PowerPoint presentation was given. PUBLIC HEARING WAS OPENED AT: 7:02 P.M. Public Comment: Monique Ramirez, Kyle Greenhalgh, Stephen Schulman, Robert Werra, Todd Harpe, Paul Hansbury, Susan Tibbon, John Casali, Nick Caston, and Hrant. PUBLIC HEARING WAS CLOSED AT: 7:28 P.M. PUBLIC HEARING WAS RE-OPENED AT: 7:30 P.M. Public Comment: Kyle Greenhalgh. PUBLIC HEARING WAS CLOSED AT: 7:35 P.M. Motion by Commissioner de Grassi to adopt a resolution (PC Reso 23-01) making the Planning Commission’s report and recommendation to the City Council on a proposed amendment to Ukiah City Code, finding that the actions are categorically exempt pursuant to Section 15061 (b)(3) of the CEQA Guidelines, with the added condition that any modification to existing candibus businesses, for the purposes of a consumption area, go before the Planning Commission. Motion dies for lack of a second. Motion/Second: M. Johnson/R. Johnson to adopt a resolution making the Planning Commission’s report and recommendation to the City Council on a proposed amendment to Ukiah City Code, finding that the actions are categorically exempt pursuant to Section 15061 (b)(3) of the CEQA Guidelines. Motion carried by the following roll call votes: AYES: Phi, de Grassi, M. Johnson, and R. Johnson. NOES: None. ABSENT: Hilliker. ABSTAIN 13.
