7. RIGHT TO APPEAL DECISION
Persons who are dissatisfied with a decision of the City Council may have the right to a review of that decision by a court. The
City has adopted Section 1094.6 of the California Code of Civil Procedure, which generally limits to ninety days (90) the time
within which the decision of the City Boards and Agencies may be judicially challenged.
8. CONSENT CALENDAR
The following items listed are considered routine and will be enacted by a single motion and roll call vote by the City Council.
Items may be removed from the Consent Calendar upon request of a Councilmember or a citizen in which event the item will
be considered at the completion of all other items on the agenda. The motion by the City Council on the Consent Calendar will
approve and make findings in accordance with Administrative Staff and/or Planning Commission recommendations.
8.a. Approval of Notice of Completion of the Electric Service Center Site Work, Specification 16-07,
and Approve Final Payment of the 5% Retention to CWS Construction Group, Inc.
Recommended Action: Approve Notice of Completion for the Electric Service Center Site Work,
Specification 16-07, and approve the final payment of the 5% retention to CWS Construction
Group, Inc., and direct the City Clerk to file the Notice of Completion with the County Recorder.

8.b. Authorize City Manager to Negotiate and Execute Memorandum of Agreement with Ukiah
Adventist Hospital to Allow Participation in 340B Program, a Charitable Drug Discount Program.

Agreement (MOA) between the City of Ukiah and Ukiah Adventist Hospital regarding participation
in the 340B Program.

Future Participation Documents for the National Opioid Settlements.
Recommended Action: Adopt a Resolution of the City Council authorizing the City Manager to
negotiate and execute any and all corresponding documents related to the City’s participation in
the New National Opioid Settlements and receipt of Settlement Funds pursuant to the Proposed
California State Subdivision Agreements.

services agreement between the City of Ukiah and Mendocino Solid Waste Management Authority
(MSWMA) to provide general manager and related administrative services to MSWMA; that will
restructure the operation of MSWMA; dependent on the action to approve the same agreement,
by MSWMA at their regular Board meeting on April 20, 2023.
