ROLL CALL Ukiah City Council met at a Regular Meeting on July 20, 2022, having been legally noticed on July 15, 2022. The meeting was held virtually at the following link: https://zoom_usl/97199426600. Mayor Brown called the meeting to order at 6:00 p.m. Roll was taken with the following Councilmembers Present: Juan V. Orozco, Douglas, F. Crane, Mari Rodin, Josefina Duenas, and Jim O. Brown. Staff Present: Sage Sangiacomo, City Manager; David Rapport, City Attorney; and Kristine Lawler, City Clerk. MAYOR BROWN PRESIDING. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilmember Orozco. 3. PROCLAMATIONS/INTRODUCTIONS/PRESENTATIONS a. Proclamation: Disability Independence Day in the City of Ukiah. Presenter: Mayor Brown. Proclamation was received by Vice Mayor Duenas. 4. PETITIONS AND COMMUNICATIONS 5. APPROVAL OF MINUTES a. Approval of the Minutes for the June 16, 2022, Regular Meeting. b. Approval of the Minutes for the June 29, 2022, Special Meeting. Motion/Second: Rodin/Orozco to approve Minutes of June 15, a regular meeting; and June 29, a special meeting, as submitted. Motion carried by the following roll call votes: AYES: Orozco, Rodin, Duenas, and Brown. NOES: None. ABSENT: None. ABSTAIN: Crane. 6. RIGHT TO APPEAL DECISION Mayor Brown read the rights to appeal City Council decisions. 7. CONSENT CALENDAR a. Report of Disbursements for the Month of June 2022 - Finance. b. Authorize City Manager to Negotiate and Execute an Agreement (COU No. 2223-076) with the Fire Safe Council of Mendocino County for Environmental Review Work Towards Fire Prevention and Mitigation Efforts on City-Owned Properties -Administration. c. Adoption of Resolution (2022-45) of the City Council Reconsidering the Circumstances of the State of Emergency and Implementing Teleconferencing Requirements for City Council and Board and Commission Meetings During a Proclaimed State of Emergency Due to the COVID- 19 Pandemic— City Attorney. Award Professional Services Agreement (COU No. 2223-080) to LDA Partners, Inc. in the Amount of $1,218,573 to Prepare the Plans, Specifications, and Estimate for the Corporation Yard Design —Public Works. o. Report of the Acquisition of Parts and Labor (PO No. 48057) for the repair of 2018 Pierce Fire Engine from Golden State Emergency Vehicle Services Inc. in the Amount of $53,505.32, and Approval of Corresponding Budget Amendment—Public Works. PUBLIC HEARINGS (6:15 PM) a. Public Hearing and Possible Introduction by Title Only of an Ordinance Amending Various Sections of Ukiah City Code to Streamline the Use Permit Application Process and Operational Standards for Cannabis-Related Businesses. Presenters: Craig Schlatter, Community Development Director and Darcy Vaughn, Assistant City Attorney. PUBLIC HEARING OPENED AT 6:27 P.M. No public comment was received. PUBLIC HEARING CLOSED AT 6:28 P.M. Motion/Second: Rodin/Orozco to introduce the Ordinance by title only. Motion carried by the following roll call votes: AYES: Orozco, Crane, Rodin, Duenas, and Brown. NOES: None. ABSENT: None. ABSTAIN: None. City Clerk, Kristine Lawler, read the following title into the record: ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UKIAH AMENDING VARIOUS SECTIONS OF THE UKIAH CITY CODE TO AMEND THE USE PERMIT APPLICATION PROCESS AND OPERATIONAL STANDARDS FOR CANNABIS RELATED BUSINESSES. Motion/Second: Rodin/Orozco to introduce the Ordinance amending various sections of the Ukiah City Code to streamline the use permit application process and operational standards for cannabis- related businesses. Motion carried by the following roll call votes: AYES: Orozco, Crane, Rodin, Duenas, and Brown. NOES: None. ABSENT: None. ABSTAIN: None. 12. UNFINISHED BUSINESS a. Receive Report Regarding the Economic Development and Financing Corporation (EDFC); Consideration of Request for Funding from EDFC; and Authorize the City Manager to Negotiate and Execute Performance Agreement Between the City of Ukiah and EDFC in the amount of$12,455.25 for FY 2022-23. Presenters: Shannon Riley, Deputy City Manager and Robert Gernet, EDFC Executive Director. Motion/Second: Rodin/ORozco to receive the report regarding the Economic Development and Financing Corporation (EDFC), and authorize the City Manager to negotiate and execute Performance Agreement(COU No. 2223-081) between the City of Ukiah and EDFC . ABSTAIN: None. b. Approve Contract with HdL Companies for Tax and Fee Administration Services for Transient Occupancy, and Approve Corresponding Budget Amendment. Presenter: Dan Buffalo, Finance Director. Motion/Second: Orozco/Rodni to re-authorize the City Manager to execute a three-year contract (COU No. 2223-082) with HdL Companies for audit and financial assistance services of the City's Transient Occupancy Tax (TOT) revenue- including short term rental compliance, and authorize the corresponding budget amendment. Motion carried by the following roll call votes: AYES: Orozco, Crane, Rodin, Duenas, and Brown. NOES: None. ABSENT: None. ABSTAIN: None. 13. NEW BUSINESS a. The Ukiah City Council will Receive a Report on Energy Costs and Provide Direction on Scheduling a Public Hearing to Consider Adoption of a Power Cost Surcharge Rider. Presenter: Cindy Sauers, Electric Utility Director and Boris Prokop, Borismetrics. Motion by Councilmember Crane and seconded by Councilmember Rodin. Upon further discussion, it was decided that direction could be given to Staff by way of consensus. Council Consensus to authorize Staff to proceed with public noticing and scheduling a Public Hearing to consider adoption of a Power Cost Surcharge Rider. b. Consideration of New Ad Hoc Committee to Participate in the Recruitment Process for a New Police Chief. Presenter: Sage Sangiacomo, City Manager. Motion/Second: Orozco/Crane to nominate and appoint Mayor Brown and Councilmember Rodin to serve on a Police Chief recruitment ad hoc. Motion carried by the following roll call votes: AYES: Orozco, Crane, Rodin, Duenas, and Brown. NOES: None. ABSENT: None. ABSTAIN: None. c. Receive Updates on City Council Committee and Ad Hoc Assignments and, if Necessary, Consider Modifications to Assignments and/or the Creation/Elimination of Ad hoc(s). Presenter: Mayor Brown and Councilmember Rodin. Mayor direction for Councilmember Rodin to participate with Staff at the EDFC meetings, and report back to Council on what type of involvement she would like going forward.
