PURCHASER agrees to fulfil the rider provided by ARTIST/AGENT in advance to the best of their ability. Force Majeure:Agreement of Artist to perform is subject to detention by sickness,accident,civil tumult,strikes,war,crime,epidemics,and acts of God or Nature of conditions beyond their control and al,payments and deposits are non returnable under with an understanding of good faith and intentions to reschedule Producer's obligations to a later date in the event of Force Majeure cancellation. Purchaser and Artist agree that this Contract is not subject to cancellation unless both Purchaser and Artist have agreed to such cancellation in writing.It is further agreed that any cancellation by Purchaser will result in a forfeiture of the Purchaser's deposit.The forfeiture of deposit is in addition to any other remedies enumerated in this Contract or afforded by law to Artist.Additionally, nonpayment of deposit shall not relieve the Purchaser of the obligations set forth herein. Purchaser�s responsible for 150%of any legal fees incurred from nonpayment of this contract. It is understood that any deposits for performance of Artist sent to Agent will be held until after the performance has been completed. No performance on the engagement shall be recorded,reproduced or transmitted from the place of performance,in manner or by any means whatsoever,in the absence of a specific written agreement with Producer relating to and permitting such recording,reproduction,or transmission. Any use of the name of the Producer for merchandising purposes such as on T-shirts,posters,or any other type of promotional item, whether for free or for sale,must be cleared with Musicians prior to distribution.
