SUBJECT: ADOPTION OF RESOLUTIONS RATIFYING PROCLAMATION OF THE
EMERGENCY SERVICES DIRECTOR DECLARING A LOCAL EMERGENCY AND
REQUESTING GOVERNOR SCHWARZENEGGER PURSUE A PRESIDENTIAL EMERGENCY
DECLARATION IDENTIFYING MENDOCINO COUNTY AS A FEDERAL DISASTER AREA
BACKGROUND: On December 30, 2005, the City Manager acting as the Director of Emergency
Services prepared a proclamation (Attachment 1 )'declaring a local emergency. Staff is requesting the
City Council's ratification of that action by adopting the attached resolution (Attachment 2). Staff is
further requesting the Council adopt a resolution (Attachment 3) requesting the Governor pursue a
presidential emergency declaration identifying Mendocino County as a federal disaster area.
Pursuant to the City's Emergency Operations procedures and City Ordinance # 995, Chapter 2.25,
the City Manager as acting Director of Emergency Services has the authority to make such a
declaration if the City Council is not in session. This action is subject to ratification by the City Council
within seven days if the City is to qualify for financial assistance under the State's Natural Disaster
Assistance Act. In addition, the City Council must review, at least every fourteen (14) days, the
continuing existence of the emergency situation. They must also terminate the emergency declaration
at the earliest possible date that conditions warrant.
The Declaration of a Local Emergency provides certain legal immunities for emergency actions taken
by Ukiah City employees. This provides protection for City and the employees. A Local Emergency
Declaration enables the City Council to act as a Board of Equalization to reassess damaged property
and provide property tax relief. It also enables the City to request state assistance under the California
Natural Disaster Assistance Act.
The Mendocino County's Board of Supervisors has scheduled a special meeting for January 5, 2006
for a similar action.
RECOMMENDED ACTION: City Council adoption of Resolutions ratifying Proclamation of the
Emergency Services Director declaring a local emergency and requesting Governor Schwarzenegger
pursue a Presidential Emergency Declaration identifying Mendocino County as a federal disaster
area.

DECLAR'rNG A LOCAL EMERGENCY
WHEREAS, Chapter 2.25 of the Ukiah Municipal Code, adopted as Ordinance
Number 995 of the City of Ukiah, empowers the Director of Emergency Services
to proclaim the existence or threatened existence of a local emergency when the
city is affected or likely to be affected by a public calamity and the City Council is
not in session; and
WHEREA~ the Director of Emergency Services of the City of Ukiah does
hereby find:
THAT condition of extreme peril to the safety of the persons and property have
arisen within said city, caused by the threat of flood condition and winter storm
conditions, and
Thatthe City Council of the City of Ukiah is not in session;
NOW, THEREFORE, -rT .rs HEREBY PROCLA.rMED that a local emergency
now exists throughout the City of Ukiah; and
IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of
said local emergency that powers, functions and duties of the emergency
organization of this City shall be those prescribed by state law, by ordinances,
and resolutions of this City, and by the City of Ukiah Emergency Plan, as
approved by the City Council on fifth day of February, 2003.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
RESOLUTION CONFIRMING EXISTENCE OF
A LOCAL EMERGENCY
WHEREAS, Chapter 2.25 of the Ukiah Municipal Code, adopted as Ordinance
Number 995 of the City of Ukiah empowers the Director of Emergency Services
to proclaim the existence or threatened existence of a local emergency when the
City of Ukiah is affected or likely to be affected by a public calamity and the City
Council is not in session, subject to ratification by the City Council within seven
(7) days; and
WHEREAS, conditions of extreme peril to the safety of persons and property
have arisen within this City, caused by excessive rain, flooding and storm
conditions commencing on the 30th day of December, 2005, at which time the
City Council of the City of Ukiah was not in session; and
WHEREAS, the City Council does hereby find that aforesaid conditions of
extreme peril did warrant and necessitate the proclamation of existence of a local
emergency; and
WHEREAS, the Director of Emergency Services of the City of Ukiah did proclaim
the existence of a local emergency within the City on the 30th day of December,
2005;
NOW, THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that said
local emergency shall be deemed to continue to exist until its termination is
proclaimed by the City Council of the City of Ukiah, State of California.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
REQUESTING GOVERNOR SCHWARZENEGGER PURSUE A
PRESIDENTIAL DECLARATION PROCLAIMING
A STATE OF EMERGENCY IN MENDOCINO COUNTY
WHEREAS, conditions of extreme peril to the safety of persons and property has
arisen within the City of Ukiah, caused by excessive rain and flooding
commencing on the 30th day of December, 2005;
WHEREAS, the City Council has found the aforesaid conditions of extreme peril
did warrant and necessitate the proclamation of existence of a local emergency;
and
WHEREAS, said local emergency shall be deemed to continue to exist until its
termination is proclaimed by the City Council; and
WHEREAS, the City Council has determined that local resources were unable to
cope with the effects of said emergency; and
WHEREAS, the City of Ukiah wishes to support the Mendocino County Board of
Supervisor's efforts in obtaining a Presidential Declaration of Emergency for this
County;
NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City of
Ukiah hereby requests Governor Schwarzenegger pursue a Presidential
Declaration proclaiming a state of emergency in Mendocino County.
