AGREEMENT FOR PARAMEDIC TRAINING
FIELD INTERNSHIP EXPERIENCE
This is an agreement between Santa Rosa Junior College,hereinafter referred to
as "College"or"District" and City of Ukiah Fire Department
hereinafter referred to as "Agency" made and entered on the following date,April
1, 2021.
SECTION 1 GENERAL CONSIDERATIONS
The parties hereto have mutually covenanted and agreed and by these present
to covenantand agree as follows:
a. The District operates the Santa Rosa Junior College. As part of the educational program
at said College, the District offers a paramedic training program which provides
prehospital care training for persons desiring to become paramedics in accordance with
the provisions of S.B. 125 and California regulations pertinent to paramedic training.
b. In order to provide prepared paramedics to the community,the District, through its
College and the operator of the Agency desire to cooperate so that students participating
in the paramedic program are able to obtain field internship experience by being
assigned to mobile intensive care units operated by the Agency.
c. Students and instructors will at all times be students and employees, respectively of the
College and not employees of the Agency.
In the performance of this agreement, it is mutually understood and
agreed thatthe College and Agency are at all times acting and performing
as independent contractors. Therefore, the parties understand and agree
that the Agency is notresponsible in any way, directly or indirectly,for any
employment-related benefits for students or College instructors. College
shall ensure thatstudents and instructors understand thatthey are not
employees of the Agency and are not beneficiaries of any benefits or
employee programs of the Agency.
d. Students shall receive no salaries or stipend forservices provided as a student.
e. Nothing in this agreement is intended to restrict the employment by the Agency of
students, nor shall any provision in this agreement be construed to apply to such
employment.
f. The parties recognize the limitations on financial commitments by the District and,to the
extent possible,the parties shall endeavor to provide such notice sufficiently in advance
of its effective date to permit adjustments to be made in the school class offerings.
g. It is not the intent of the College or Agency that the students or College instructors
occupy the position of third-party beneficiary of any obligations assumed by either party
pursuant to this Agreement.
SECTION 2 RESPONSIBILITIES OF COLLEGE AND AGENCY
a. Agency has facilities forfumishing this field internship experience to the student
participating in the College program and is desirous of making its facilities available for
this purpose.
b. Agency agrees to provide a supervised program of field internship experience to the
selected students in accordancewith the terms and conditions stated in this agreement.
Individuals supervising the internship experience shall be mutually acceptable to the
parties.
C. The period of time foreach student's field internship experience shall be mutually agreed
upon between College and Agency priorto the beginning of each student's field
internship. Learning objectives will be made available prior to the start of internship.
Reasonable extensions of the internship may be agreed to by the parties if a particular
trainee requires additional experience.
d. The number of students to participate in the field internship with Agency at any given time
shall be mutually agreed upon by College and Agency priorto the beginning of the
internship program,and may be modified from time to time by mutual agreement upon
the request of either party.
e. The students will be assigned to a preceptorwho is an employee of the Agency. Hours
of duty will correspond with the preceptorschedule. Duties of the student will be those of
a paramedic. The College, through the instructors, shall share supervision
responsibilities of the student with the Agency.
f. College shall be responsible for selecting the individual students who will be assigned to
Agency and such selection will be made without regard to race, creed, color,sex,
handicap, or national origin of the student. On or about four(4)weeks priorto the
beginning of each student's field internship with Agency, College shall forward the name,
biographical data, report of health status, and other appropriate information of each
student selected by College to participate in Agency field internship program. Agency
shall have the right, prior to the arrival of the student,to request from College additional
reasonable information concerning any or all of the selected students.
g. College clinical coordinator shall schedule regular visits with the student and preceptor
and shall participate in informal and formal evaluation.
h. Agency may request College to withdraw from Agency field internship program any
student who Agency determines is not performing satisfactorily, orwho refused to follow
Agency administrative and patient care policies, procedures, rules and regulations. Such
request must be in writing and must include a statement of the reason or reasons why
Agency desires to have the student withdraw. All matters of discipline shall be referred to
the College instructor. However, in the event of an emergency or if any student
represents a threat to patient safety or fails to meet Agency standards for health, safety,
cooperation orethical behavior, Agency may immediately exclude the student from the
Agency until final resolution of the matter with the College.
i. The College agrees to instruct students and instructors regarding confidentiality of patient
information.
j. It is the responsibility of College to notify the student that the student will be responsible
for:
1. Following the administrative and patient care policies, procedures, rules and
regulations of the Agency.
2. Acquiring and using the necessary and appropriate uniforms.
3. Arranging for their own transportation and personal living accommodations
and costs when not provided by Agency,and
k. Agency shall maintain complete attendance and progress records and reports on each
student's performance and shall provide an evaluation for each student to the College on
forms provided by the College.
1. Agency shall, upon reasonable request, permit College and/or appropriate governmental
agencies charged with the responsibility of accrediting or approving the paramedic
training program to inspect Agency facilities, services,student records, and such other
materials which pertains to the field internship program.
SECTION 3 INSURANCE
a. The District shall, as required by Education Code Section 5992, provide such Worker's
Compensation Insurance as may be required to protect the Agency and the District
against any liability under the Worker's Compensation laws of the State of California for
injuries to students while on duty at the Agency.
b. The District shall provide Comprehensive General Liability(including
Premises/Operations, Products/Completed Operations, Contractual Insurance, and
Personal Injury): Bodily injury-$1,000,000 each occurrence, $3,000,000 aggregate, and
Property Damage-$500,000; or combined Single Limit of$1,000,000 each occurrence
forbodily injury and property damage, $3,000,000 aggregate. The insurance policy shall
provide forthirty(30) day written notice of insurance cancellation.
C. The District shall provide professional(malpractice)liability insurance in the amount of
$1,000,000 each occurrence and $3,000,000 in aggregate.
d. Within thirty(30) days of execution of this Agreement, College shall provide Agency with
a certificate evidencing all such insurance for all participating students. Further, all
insurance policies shall provide forthirty days prior written notice of insurance
cancellation to Agency.
SECTION 4 INDEMNIFICATION
a. District shall indemnify,defend and hold harmless the Agency and its
directors, officers, employees and agent, against all claims, demands,
suits,judgements,expenses and costs of any and every kind, including
reasonable attorney fees, caused solely out of the acts or omissions of the
District and its directors, officers, or associates, employees, agents,
instructors or students,in the performance of this Agreement and activities
contemplated within.
b. Agency shall indemnify,defend and hold harmless the District and its
directors, officers, employees and agent, againstall claims, demands,
suits,judgements,expenses and costs of anyand every kind, including
reasonable attorney fees, caused solely outof the acts or omissions of the
Agencyand its directors, officers,or associates, employees, agents, in the
performance of this Agreement and activities contemplated within.
SECTION 5 TERMS OF AGREEMENT
a. This Agreement shall be reviewed annually but may at any time be altered, changed or
amended by mutual agreement of the parties in writing.
b. This Agreement shall become effective and shall continue until terminated by either party
after giving the other party six(6) months advance written notice,with or without cause,
of its intention to so terminate.
