The project area and the surrounding area has already been evaluated and surveys for special status plants but must also be evaluated for animal species that are listed as rare, threatened, endangered, and species of special concern. Research is conducted regarding specific species that have been identified in the area and require the habitat found within and adjacent to the project area. Mitigations for animal species will be developed if necessary. During site visits, any potentially Environmentally Sensitive Habitat Areas will be searched for and mapped if present as per California Department of Fish and Wildlife and County of Mendocino and mitigations developed if necessary. ATTACHMENT TO PO 47554 Page 2 of 3 ENVIRONMENTAL SERVICE AGREEMENT Date Initiated: October 19, 2021 Client: City of Ukiah Project: Biological Assessment for proposed Upper City View Trail Project Manager: Jacobszoon & Associates, Inc. Project APN: 001-030-01 Biological Assessment and Report Description of Scope of Services: Project communication and administration with client Office based research for special status animals on agency databases Develop scoping list for Biological assessment site visit Soils research Project site biological resource mapping Biological assessment site visit Development of Biological assessment report Estimated Project Fee: The estimated Client costs for the above referenced services: $5,000.00 - $6,600.00. All Services shall be billed at Time & Materials plus expenses All Services shall be billed at Time & Materials plus expenses every 30 days and are due within one month (See Consulting Fees below). A retainer fee deposit of $1,250.00 must accompany the signed agreement to begin work. Credit from the retainer fee deposit will be applied to Client’s account every 30 days for time and material billed. This project cost does not include the implementation of mitigations if environmentally sensitive habitat areas or animal species are found within the project area or if additional surveys need to be conducted, such as, aquatic species surveys, nesting bird surveys, etc. Fee Schedule Senior Wildlife Biologist…………………………………………………………………………………….…$110.00/hour Environment Analyst……………………………………………………………………………………………..$95.00/hour Environmental Technician……………………………………………………………………………………..$85.00/hour Mileage………………………………………………………………………………………………………………….…$0.75/mile Note. Travel time is charged both ways; all other expenses are charged at cost. Authorizations: By executing this Environmental Service Agreement, the undersigned Client authorizes Project Manager to proceed with the services in accordance with the scope and estimated fees as shown above. Page 3 of 3 Termination without Cause: Project Manager may terminate this Agreement at any time upon twenty-four (24) hours’ notice to Client. Client’s only liability for termination without cause will be payment to Project Manager for work completed prior to the termination date. I hereby agree to be responsible to meet the stated terms and conditions of SWRCB Order WQ 2019- 0001-DWQ, Fish and Game Code 1602, 5650, and 5652 as well as other applicable state, county, and local laws. Furthermore, I agree to release J&A and its employees, contractors, and consultants, and will hold them harmless from liability which may arise from implementation of remediation work to the extent allowed by the law. Assumptions and Limitations: J&A does not make any guarantee of the viability of the project, the date upon which approvals will be received, or the successful completion of the project. J&A does not possess any control over the approval process employed by any involved government agency, or the timely processing of application submittals. Time and material estimated fees are estimates of required effort; to meet project objectives, J&A may adjust the budget allocations for tasks but may not invoice in excess of 10% of the total estimated cost without written approval from Client. All information required by J&A for execution of services defined in this agreement will be provided by Client. Client will pay all public agency fees associated with this project.
