ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UKIAH
AMENDING SECTION 7154 OF ARTICLE 10 OF CHAPTER i OF
DIVISION 8 OF THE UKIAHCITY CODE TO PROHIBIT THE PARKING
OF CERTAIN VEHICLES IN RESIDENTIAL DISTRICTS WITHIN THE
CITY OF UKIAH.
The City Council of the City of Ukiah hereby ordains as fol-
lows.
Section One.
Section 7154 of the Ukiah City Code is hereby amended to read
as follows:
Section 7154 - No Parking of Vehicles with gross weight of
20,000 pounds in residential districts:
(a) It shall be unlawful and constitute a violation of this
Code to park or allow to stand a commercial vehicle having a
manufacturer's gross vehicle weight rating of 11,000 pounds or more
on any street in any R-l, R-2, or R-3 zoning district in the City
of Ukiah. This prohibition shall not apply to any commercial
vehicle:
(1) making pickups or deliveries of goods, wares, and
merchandise from or to any building or structure located on the
restricted streets;
(2) delivering materials to be used in the actual and
bona fide repair, alteration, remodeling, or construction of any
building or structure located on or within the restricted street
for which a building permit has been previously obtained, if a
building permit is legally required for such repair, alteration,
remodeling or construction; or
(3) delivering equipment to be used in grading or con-
struction activity within the street or on property abutting such
restricted street for which a building permit has been previously
obtained, if a building permit is legally required for such grading
or construction activity.
(b) It shall be unlawful and constitute a violation of this
Code to park or allow to stand a commercial vehicle having a
manufacturer's gross vehicle weight rating of 11,000 lbs. or more
on any lot, plot or parcel of land in any R-I, R-2, or R-3 zoning
district within the City of Ukiah, where parking is prohibited on
a public street under subsection (a) of this section 7154 unless
the parcel is 1 acre or more in size or the commercial vehicle is
not visible from any public street, and it is not operated between
the hours of 10 p.m. and 7 a.m.
Section Two.
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this ordinance. The City Council of the City
of Ukiah hereby declares that it would have adopted this ordinance
and each section, subsection, sentence, clause, phrase or portion
thereof irrespective of the fact that any one or more sections,
subsections, sentences, clauses, phrases, or portions be declared
invalid or unconstitutional.
Section Three.
This ordinance shall be published as required by law and shall
become effective thirty days after its adoption.
