ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UKIAH AMENDING ARTICLE 3, CHAPTER 1, DIVISION 3, OF THE UKIAH CITY CODE TO ALLOW 150 SQUARE FOOT EFFICIENCY DWELLING UNITS 479 The City Council of the City of Ukiah hereby ordains as follows: SECTION ONE. : Section 3016(3) is added to the Ukiah City Code to read as follows: 3. Section 1208 of the Uniform Building Code, relating to the definition of "Efficiency Dwelling Units" and the pertinent code requirements, is modified to allow efficiency dwelling units of between 150 and 219 square feet if the following criteria are met. Except as specifically amended by this section, the provisions of Section 1208 shall remain in effect. (a) No more than 20 such units shall be located within a single structure and/or no more than 30 such units shall be located on a single parcel. (b) Maximum occupancy of such units shall be two persons. (c) Such units shall only be allowed in conjunction with a housing program approved by the City of Ukiah Zoning Administrator in which the tenants have been assigned to a specific unit and a representative of the organization providing the housing program shall reside on site. (d) Approval or denial of a housing program proposing to use these units shall be made by the Zoning Administrator after consideration of the application for such designation during a noticed public hearing. Notice of the hearing shall be given by publication in a newspaper of general circulation within the City of Ukiah at least 10 days prior to the hearing. Appeal of the decision may be filed by any interested party and shall be made to the Planning Commission in the manner prescribed in Ukiah City Code Section 9215. (e) Applications for such a housing program must be made by an entity legally created to provide housing or administer housing related programs within the corporate limits of the City of Ukiah. (f) An approved housing program shall specify the legal authority of the organization to provide and manage housing units; the organization's long term entitlement to the subject parcel; assurances that all applicable laws, statutes, and ordinances shall be adhered to; a detailed analysis of the client characteristics, on-site security and management system, organization structure and personnel; a three year 480 financial plan for the program to include revenue and expenditure projections; and a description of the organization's technical expertise and previous experience in providing housing. (g) Approval of the housing program shall be conditioned upon compliance with the provisions of the program. Failure to comply may be enforced as a violation of the building code. SECTION TWO. This Ordinance shall be published as required by law and shall become effective thirty (30) days after its adoption.
