HomeMy WebLinkAboutCC Reso 2020-34 - Wastewater Sewer Rates RESOLUTION NO. 2020-34 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ADOPTING SEWER WASTEWATER SERVICE RATE ADJUSTMENTS FOR FIVE YEAR PERIOD FY 2020 - 2025 WHEREAS, 1. The City of Ukiah operates and maintains a wastewater collection and treatment system; and 2. The report entitled "City of Ukiah Wastewater Rate Study," was presented to the City Council on March 11, 2020, and presents a comprehensive analysis of the sewer utility's rate structure and proposed rate increases; and 3. The City Council considered the proposed increases at a regular meeting on April 22,2020, and authorized staff to provide notice and schedule a public hearing on the proposed rate increase in accordance with the procedures contained in Article XIIID, Section 6 of the California Constitution and Ukiah City Code Sections 3950-3957; and 4. Written notice of the amount of the fee or charge proposed to be imposed, the basis upon which the amount of the proposed fee or charge was calculated, the reason for the fee or charge, and the date, time, and location of a public hearing on the proposed fee or charge was mailed to the record owner of each parcel in the City of Ukiah and all customers of the City's wastewater system not less than 45 days in advance of the hearing on the proposed changes; and 5. On June 17, 2020, the City Council conducted a public hearing concerning the proposed rates, and heard and considered public comment on the proposed rates; and 6. The City Council did not receive at or prior to the hearing on June 17, 2020, written protests from a majority of the owners of the parcels receiving wastewater services in the City of Ukiah; and 7. The City Council has determined that the proposed rates comply with the requirements in Article XIII.D of the California Constitution. NOW, THEREFORE, BE IT RESOLVED that: 1. This Resolution supersedes and replaces any prior resolutions establishing sewer rates in the City of Ukiah. The City Council has determined that the changes are required to cover the costs of providing sewer service and to fairly apportion those costs based on cost of serving the customer. 2. Rates. Each premises or user connected to the public sewage system shall be classified under one of the following user categories and shall be subject to the rates specified for such category. Premises or users which are susceptible to classification under two (2) or more of such user categories shall be specially classified by city and shall be subject to rates established by city which shall allow for a reasonable usage allocation. 3. Residential Users. "Residential users" are defined as a residential dwelling unit, consisting of each single family dwelling, regardless of size, each occupiable living unit in a duplex, tri- plex, four-plex or apartment building or complex and each occupied space in a mobile home 1 park. This user category shall pay a monthly Service Charge per dwelling unit (1 sewer service unit for each dwelling unit at the rate established by this resolution). 4. Commercial Users. "Commercial users" are defined as all non-residential accounts including public utilities and public agency facilities. This user category shall pay a monthly Service Charge per Equivalent Sewer Service Flow Unit (ESSFU), which is based on the average water use of residential dwelling units. The ESSFU value for each Commercial user shall be calculated based on that account's average monthly water usage during the prior months of January through March divided by the ESSFU value. As an example, if the ESSFU is determined to be 8.0 Hundred Cubic Feet ("HCF") and a Commercial account has an average winter water usage of 20 HCF, that Commercial account would be assigned a value of 2.5 ESSFUs. If a sewer connection receives its water from other than a metered domestic water system, such as the systems operated by the City, Millview water district, or Willow water district, the water use must be metered, unless another method of determining water or sewage usage is approved by the City Engineer. The following provides guidance for the classification of commercial accounts. Classification Description Business Type Commercial 1 Low Strength Professional offices, retail, hospital/ convalesce schools/college, car wash, Laundromat Commercial 2 Moderate Strength Hotel without dining, service station, auto repair shop Commercial 3 Medium Strength Hotel with dining, market with food service, coffee / shop Commercial 4 High Strength Restaurants, mortuary, bakery, high-strength industrial 5. Rates for the period October 1, 2020 to September 30, 2025 are set forth in the attached Exhibit A which is incorporated herein. 6. Sections 1-5, above, shall become effective on October 1, 2020. 7. The rates set forth in Exhibit A shall become effective on October 1, 2020.
