AUTHORIZATION Upon execution of this amendment, service provider is authorized to provide the service described under the Scope of Additional Work identified in this Amendment No. 1. SCOPE OF ADDITIONAL WORK Work authorized by this amendment shall include that work described in the August 21, 2018 letter proposal. A copy of said letter is included in this first amendment. COMPENSATION Compensation for the performance of the additional work shall be made on a time and expense basis at Consultant's customary fees. CIVIL ENGINEERS • LAND SURVEYORS Mr. Tim Eriksen, Director of Public Works, City Engineer City of Ukiah, Public Works Department 300 Seminary Avenue Ukiah, CA 95482 August 21, 2018 Job Number R18019 RE: AMENDMENT #1 TO AGREEMENT FOR SERVICES FOR SURVEYING PORTIONS OF THE BOUNDARY OF PARCELS RETAINED BY NORGARD PROPERTIES, INC. ON NORGARD LANE, UKIAH. Dear Mr. Eriksen: Rau and Associates, Inc. (RAU) was authorized to provide some professional surveying services related to the property line between the City Water Treatment Plant Facilities at Plant Road and the property owned by Norgard Properties, Inc. The properties were retained by Norgard Properties, Inc. from a sale of Norgard Property south of Norgard Lane to the City of Ukiah. A short summary of the tasks to be performed included research existing deeds along Norgard Lane to establish property lines of the various owners, survey the location of two parcels to be retained by Norgard Properties as marked in the field, prepare legal descriptions for two parcels, set monuments at various property corners for two parcels, and prepare a Record of Survey of two parcels. As work progressed, it became evident that there are actually three parcels which Norgard Properties should retain and that part of one of them has.an overlapping land owner. The deeds were vague and in the form of a chain beginning back in the 1940's. The plot of APN 184-080-11 on the Assessor's Map does not coincide with the lines of occupation on the ground, which reportedly have existed for approximately 40 years. The difference in location on the Assessor's Map and the lines of occupation on the ground is approximately 55 to 60 feet. Consequently there was considerably more work to locate existing property lines and then develop the legal description of three parcels. Additional Tasks Description: Additional Research to Establish Deed Location of APN 184-080-11 (Stephens) and APN 184-080- 27 (Norgard Properties, Inc.) The property owned by Norgard Properties, Inc., identified as APN 184-080-27 is actually formed by a number of deeds with exceptions. This required obtaining several deeds going back to the early 1940's and piecing them together. The property owned by Stephens is described as being adjacent to one of the parcels which make up APN 184-080-27, again complicating the attempts to understand where it is located. In addition, some of the monuments from the Yokayo Rancho mentioned in the deeds have been lost over time, but their location had to be researched to be sure that they are not in evidence. The additional cost of this research is estimated to be $1,690, including reimbursable expenses for copies of deeds and maps of $54. 100 NORTH PINE STREET • UKIAH, CALIFORNIA 95482 • 707-462-6536 • FAX 707-463-2729 www.rauandassoc.com Mr. Tim Eriksen August 21, 2018 Page 2 Additional Field Surveying and Office Mapping to Establish Property Line Locations of APN 184- 080-11 (Stephens) The original scope of work for the project included the intent of some fence lines and three or more stakes along the southern boundary of two parcels desired to be retained by Norgard Properties, Inc. As legal descriptions were researched and references found to other parcels or to monuments, additional trips to the site to attempt to find other evidence became necessary. It then became necessary to plot new information and several deeds in the chain of title to try to distinguish the deeded location of APN 184- 080-11 with the lines of occupation on the ground. The scope of work to establish the boundary is increased since it was necessary to search search for additional evidence, locate it in the field, and expand the office mapping information. The additional cost to perform the search for additional evidence, field surveys, and additional office mapping is estimated to cost $2,260. Additional Effort to Prepare Deeds for Three Parcels to Norgard Properties, Inc. Initially, it was thought that there would be two parcels to describe. As the work progressed and the confusion grew about the location of APN 184-080-11, it became evident that describing three parcels would provide a cleaner title for all involved. Two of the parcels have definitive boundaries. These lie to the east and to the west of APN 184-080-11 and are separated far enough from the lines of occupation to not create any uncertainty as to their location. The third parcel in the middle between the east and west parcels does have an overlap between the lines of occupation and the location shown on the Assessor's Map for APN 184-080-11. Therefore additional effort was required to prepare a third legal description and to prepare one legal description which excepted out APN 184-080-11. The additional cost to prepare the third legal description and qualify one legal description to maintain the clear title of APN 184-080-11 is estimated to cost $960. Set Additional Monuments and Provide Addional Information on the Record of Survey The original agreement anticipated setting four corner monuments around regularly shaped parcels. In order to monument the property lines as established by the more extensive research, between 13 and 17 monuments will be set. At some locations, existing fence posts will be tagged for monuments and their location noted on the Record of Survey. The irregular shape to the parcels will require more work to complete a Record of Survey Map. As required by the State Map Act, it will also me necessary to monument the corners of occupation of APN 184-060-11 to show the discrepancy between lines of occupation and the Assessor's Map location. A significant amount of evidence, above what was originally contemplated to be necessary, must also be included on the map to show how the location of APN 184-080-11 varies from where it is located on the Assessor's Map. Additional mathematical closures must be submitted to the County Surveyor's Office with the map. The additional cost to perform this task is estimated $1,740 to set the additional monuments and $1,570 to add more information to the Record of Survey Map, for a total of $3,310. The total amount for this additional work is estimated to cost $8,220. Mr. Tim Eriksen Schedule: August 21, 2018 Page 3 The additional work to set monuments and complete a Record of Survey is anticipated to be done within about 4 weeks. The Record of Survey Map will be turned in to the County Surveyor for checking and then corrected or information added as required. The additions/corrections are anticipated to take two or three days. Then the map will be returned for acceptance by the County Surveyor and recording by the County Recorder.
