RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH AUTHORIZING USE OF
DIGITAL AND ELECTRONIC SIGNATURES
WHEREAS:
1. The use of electronic and digital signatures, in lieu of manual signatures, has
increased efficiencies and overall customer service in the private sector; and
2. Current law clarifies that government agencies may use all types of electronic
signatures, which includes digital signatures, in accordance with the Uniform
Electronic Transactions Act, California Civil Code § 1633.1 et seq.; and
3. Benefits of using electronic signatures include: reduction of paper generation;
significant decrease in time and cost associated with transmitting, approving, and
retaining physical documents; as well as creation of an audit trail of the modification,
editing, and approval/signing of documents; and
4. The City of Ukiah (the "City") wishes to authorize the use of digital and electronic
signatures for certain situations in order to increase customer service and efficiencies
within the City's contracting practices and grant application process; and
5. The City intends to authorize the use digital and electronic signatures to the fullest
extent allowed by law.
NOW, THEREFORE, BE IT RESOLVED that:
1. Whenever a signature is required, the City may agree that an electronic signature,
which includes, but is not limited to, a digital signature, satisfies that requirement,
provided it is in accordance with the Uniform Electronic Transactions Act, Government
Code § 16.5, and 2 CCR §§ 22000-22005.
2. City employees who are designated by the City Council, the City Manager, or a
department director to sign City documents may sign City documents digitally if such an
option is available.
3. The City Manager or his designee shall determine the documents for which the City will
accept electronic signatures, as well as the type(s) of acceptable electronic signatures the
City will accept.
4. The City Manager or his designee shall determine acceptable technologies and
vendors under this Resolution consistent with industry best practices to ensure the
security and integrity of the data and the signature.
