AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UKIAH ADDING ARTICLE 5, ENTITLED PROHIBI- TION AGAINST SIGNS ON PUBLIC RIGHTS OF WAY AND PROPERTY, TO CHAPTER 2 OF DIVISION 7 OF THE UKIAH CITY CODE. PREAMBLE. The City Council finds that allowing members of the general public to paint or post signs on streets, curbs, sidewalks, hydrants, street and traffic signs causes clutter and visual blight. In addition, the frequent painting or posting of signs within public rights of way such as sidewalks and streets can obstruct and interfer with the free flow of pedestrian and vehicular traffic. Moreover, the placement of painted and posted signs on public property and within public rights of way can dis- tract drivers and pedestrians, increasing the risk of accidents. For these reasons the City Council has determined as a m~t- ter of policy that such use of public rights of way and property must be prohibited to protect the peace, safety, and visual at- tractiveness of the City of Ukiah. THEREFORE, the City Council of the City of Ukiah does ordain as follows: Section One. Sections 6170-6171 are hereby added to the Ukiah City Code to read as follows: Section 6170. Siqns and hand-bills prohibited in public riqhts of way and on public property. (a) No person shall paint, mark or write on, or post or otherwise affix, any hand-bill or sign to or upon any sidewalk, crosswalk, curb, curbstone, hydrant, or upon any fix- ture of the fire alarm system or upon any street sign or traffic sign, within the City of Ukiah. (b) Nothing in this section contained shall apply to the installation of terrazzo sidewalks or sidewalks of similar construction, sidewalks permanently colored by an admixture in the material of which the same are constructed, and for which the Board of Public Works has granted a written permit. (c) Any hand-bill or sign found painted, posted, or otherwise affixed upon any public property contrary to the provi- sions of this section may be removed by the Police Department or the Department of Public Works. The person responsible for any such illegal posting shall be liable for the cost incurred in the removal thereof and the Department of Public Works is authorized to effect the collection of said cost. (d) Nothing in this section shall apply to the instal- lation of a metal plaque or plate or individual letters or figures in a sidewalk commemorating an historical, cultural, or artistic event, location or personality for which the Department of Public Works, with the approval of the City Council, has granted a written permit. (e) Nothing in this section shall apply to the paint- ing of house numbers upon curbs done under permits issued by the Director of Public Works under and in accordance with other provisions of this code. 321 (f) Nothing is this section shall apply to markings on streets or sidewalks necessary to direct or control pedestrian or vehicular traffic done under permits issued by the Director of Public Works under and in accordance with other provisions of this code. Section 6171. Penalty for Violation. Any person violating any of the provisions of section 6170 shall be deemed guilty of a misdemeanor, and upon conviction shall be punished by a fine of not more than One hundred dollars ($100.00), or by imprisonment of not to exceed thirty (30) days, or both such fine and imprisonment. Section Two. This ordinance shall be published in a newspaper of general circulation and shall become effective thirty (30) days after its adoption.
