ORDINANCE NO. 863
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF UKIAH AMENDING PORTIONS OF CHAPTER I
DIVISION 8 OF THE UKIAH CITY CODE, PERTAINING
TO THE REGULATION OF PARKING ON CITY STREETS.
PREAMBLE
The City Council finds that it must amend the penalty
provisions applicable to certain parking violations to comply
with the State Vehicle Code and that it is in the best interests
of the City to allow users of metered parking on certain streets
where parking is limited to a maximum of five hours to extend the
allowable parking limit on those streets by inserting additional
coins in the meters.
THEREFORE, the City Council of the city of Ukiah does ordain
as follows:
Section One
Section 7044 of the Ukiah City Code is hereby repealed.
Section Two
Section 7155 is hereby added to Article 10, Chapter 1,
Division 8 of the Ukiah City Code to read as follows:
7155. Infraction penalty for violating this article.
It shall be unlawful and constitute an infraction for any
person to violate any provision of this Article. Any such
violation shall be punishable by a fine not exceeding $50.00 for
a first offense, $100.00 for a second offense committed within
one year and $150.00 for each additional offense committed within
one year, except as to continuing offenses as provided in section
7051. As to continuing offenses the fine for each violation
deemed to be a separate violation by section 7055 shall not
exceed $50.00.
Section Three
Section 7171 is hereby added to Article 11, Chapter 1,
Division 8 of the Ukiah City Code to read as follows:
Section 7171. Infraction penalty for violating this arti-
cle.
It shall be unlawful and constitute an infraction for any
person to violate any provision of this Article. Any such
violation shall be punishable by a fine not exceeding $50.00 for

a first offense, $100.00 for a second offense committed within
one year and $150.00 for each additional offense committed within
one year, except as to continuing offenses as provided in section
7051. As to continuing offenses the fine for each violation
deemed to be a separate violation by section 7055 shall not
exceed $50.00.
Section Four
Section 7189 is hereby added to Article 12, Chapter 1,
Division 8 of the Ukiah City Code to read as follows:
Section 7189. Infraction penalty for violating this arti-
cle.
It shall 'be unlawful and constitute an infraction for any
person to violate any provision of this Article. Any such
violation shall be punishable by a fine not exceeding $50.00 for
a first offense, $100.00 for a second offense committed within
one year and $150.00 for each additional offense committed within
one year, except as to continuing offenses as provided in section
7051. As to continuing offenses the fine for each violation
deemed to be a separate violation by section 7055 shall not
exceed $50.00.
Section Five
Section 7215 of the Ukiah City Code is amended' to read as
follows:
Section 7215 - Unlawful to extend time beYond limit:
Except as otherwise specifically authorized by resolution of
the City Council adopted pursuant to section 7164, no person
shall follow the operational procedure or any part of the opera-
tional procedure for the purpose of increasing or extending the
parking time of any vehicle beyond the legal parking time which
has been established for the parking space adjacent to which said
parking meter is placed.
Section Six
Section 7164 of the Ukiah City Code is amended to read as
follows:
Section 7164 - Five Hour Parking:
The Council may, by resolution, designate certain streets or

portions of streets as being restricted to standing or parking
for a period of time not longer than five hours at any time
specified by such resolution.
On those streets or portions of streets designated by
resolution of this city, when authorized signs, parking meters o
curb markings have been determined by the City Traffic Engineer
to be necessary and are in place giving notice of parking re-
stricted to not longer than five hours, no operator of any
vehicle shall stop, stand or park said vehicle in such restricted
area in violation thereof.
On those streets or portions of streets controlled, regulat-
ed and inspected with the aid of parking meters, the Council may
adopt a resolution authorizing the owner or operator of any
vehicle or a person acting with the knowledge or consent of said
owner or operator to follow the operational procedure for operat-
ing the parking meter to increase or extend the parking time of
said vehicle beyond the single five hour limit established for

the parking space adjacent to which said parking meter is Placed
For purposes of this section, the five hour limit for such a
meter controlled space shall include any additional periods of
five hours or any portion thereof as long as the parking meter is
not showing a signal indicating that such space is illegally in
use.
Section Seven
Section 7232 of the Vehicle City Code is amended to read as
follows:
Section 7232 - Penalties for violation:
Except as otherwise specifically provided in this Code or
the Vehicle Code, any person violating any of the provisions of
this chapter shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be punishable by a fine not exceeding
Five Hundred ($500) Dollars, or by imprisonment for not exceeding
six (6) months, or by such fine and imprisonment.
Section Eiqh~
This ordinance shall be published in a newspaper of general
circulation and shall become effective 30 days after its adop-
tion.
