ORDINANCE NO. 838
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
UKIAH REPEALING EXISTING CHAPTER 1, 2, 3, 4, 5,
AND 6 OF DIVISION 3 OF THE UKIAH CITY CODE AND
ADOPTING NEW CHAPTER 1
The City Council of the City of Ukiah does ordain as follows:
SECTION 1.
Ae
Existing Chapter 1, 2, 3, 4, 5 and 6 of Division 3 of the Ukiah City
Code are hereby repealed.

New Chapter 1 of Division 3 of the Ukiah City Code is hereby adopted.
CHAPTER 1
BUILDING REGULATIONS
ARTICLE 1
MODEL CODE ADOPTION
Section 3000 - Adoption of Model Codes:
The following model codes are hereby adopted by reference:
A. Uniform Building Code 1982 edition, including the Appendix thereto.
B. Uniform Building Code Standards, 1982 edition.
C. Uniform Housing Code, 1982 edition.
D. Uniform Code for the abatement of Dangerous Buildings, 1982 edition.
E. Uniform Plumbing Code, 1982 edition, including the Appendix and
Standards thereto.

ARTICLE 2
DEFINITIONS
Section 3001 - Uniform Building Code:
The term "Uniform Building Code" as used in this chapter shall mean the
publication published by the International Conference of Building Officials
entitled "Uniform Building Code" with the year of the edition designated.

mean the publication published by the International Conference of Building
Officials entitled "Uniform Building Code Standards" with the year of the
edition designated.
Section 3003 - Uniform Housing Code:
The term "Uniform Housing Code" as used in this chapter'shall mean the

entitled "Uniform Housing Code' with the year of the edition designated.
Section 3004 - Uniform Code For The Abatement Of Dangerous Buildings:
The term "Uniform Code For The Abatement of Dangerous Buildings" as used
in this chapter shall mean the publication published by the International
Conference of Building Officials entitled "Uniform Code For The Abatement Of
Dangerous Buildings" with the year of the edition designated.
Section 3005 - Uniform Plumbing Code:
The term "Uniform Plumbing Code" as used in this chapter shall mean the
publication published by the International Association of Plumbing and
Mechanical Officials in conjunction with the International Conference of
Building Officials entitled "Uniform Plumbing Code" with the year of the
edition designated.
Section 3006 - Uniform Mechanical Code:
The term "Uniform Mechanical Code" as used in this chapter shall mean
the publication published by the International Association of Plumbing and
Mechanical Officials in conjunction with the International Conference of
Building Officials entitled "Uniform Mechanical Code" with the year of the
edition designated.
Section 3007 - Uniform Electrical Code:
The term "Uniform Electrical Code" as used in this chapter shall mean
the publication published by the Pacific Coast Electrical Association
entitled "Uniform Electrical Code" with the year of the edition designated.
Section 3008 - National Electrical Code:
The term "National Electrical Code" as used in this chapter shall mean
the publication published by the National Fire Protection Association
entitled "National Electrical Code" with the year of the edition designated.
Section 3009 - Administrative Authority:
The term "Administrative Authority" as used in any of the model codes
herein adopted shall mean the building official of the City of Ukiah.
Section 3010 - Jurisdiction:

The term "jurisdiction" or "this jurisdiction" as used in any of the
model codes herein adopted shall mean the City of Ukiah.
ARTICLE 3
EXCLUSIONS AND MODIFICATIONS

Section 3015
The provisions of this chapter shall not apply to any project under the
control and jurisdiction of the Public Works Department of the City of Ukiah,
the County of Mendocino, the State of California or the United States unless,
and to the extent, the contract or specifications for a particular project
species compliance with this chapter or any of the model codes adopted
herein.
Section 3016 - Modifications to the Uniform Building Code:
1. Section 302(a) of the Uniform Building Code, relating to applica-
tion for building permits, is modified to require in addition to the other
information already required in an application for a building permit the date
when the building was first constructed, if known, when the applicant seeks a
building permit to demolish the building.
2(a). Section 303(a) of the Uniform Building Code, relating to
permit issuance, is modified to require that, except as expressly provided in
this section before issuing a building permit to demolish a building that was
first constructed fifty (50) years of more prior to the date of application,
the Director of Community Development shall first refer the application to
the City Council for a determination under the procedures provided in
subsection 2(b) as to whether the building has historical, architectual or
cultural value to the City of Ukiah.
(b)(1) The City Council shall determine by majority vote no later
than its next regularly scheduled meeting following referral by the Director
of Community Development whether the building has historical, architectual or
cultural significance.
(2) At tile time of application or as soon thereafter as is
practical but no later than five (5) days prior to the City Council meeting
at which the application is to be reviewed, the applicant shall be notified
in writing by mail or personal service of the date and time when the City
Council will review the application.
(3) After its review the City Council shall determine whether the
building is historically and/or architectually significant to uae City of

Ukiah. If the building is determined to have such significance, the permit
to demolish the building shall not be issued.
(c) Referral under subsection 2(a) shall not be required:
(1) When the building is an accessory building such as, but not
limited to, a garage, storage shed, or carport, whether attached or detached,
to a main building. ~

(2) When, in the judgment of the..Building Official immediate
demolition of the building is necessary to protect the public health or
safety and the failure to immediately demolish the building would constitute
a serious threat to the public health or safety.
Section 3030 - Uniform Building Code Section 3313 is amended as follows:
Add sub-section (c): In addition to the other requirements of this
section, all required exit signs in a room or area with an occupant load of
one hundred (100) or more persons shall be lighted from two separate sources
as described in Uniform Building Code Chapter 33.

ARTICLE 4
FEES
Section 3050 - Permits Fees
The City Council may from time to time, by resolution ~stablish fees to
be charged and collected for permits issued or services rendered hereunder.
In the absence of a resolution by the City Council setting fees for any
specific type of permit or service, such fees shall be as specified within
the model codes herein adopted.
Section 3051 - Exemption of Political Bodies from Permit Fees:
The United States, the State of California, the County of Mendocino, the
City of Ukiah or any school district shall be exempt from the payment of any
fee for the issuance of a permit as required herein.
ARTICLE 5
PENALTIES
Section 3060 - Fees a Debt:
The amount of any fee due and any penalty imposed by this code shall be
deemed to be a debt owed to the City of Ukiah and an action to recover any
delinquent fees and penalties may be commenced in the name of said City in
any court of competent Jurisdiction.
Section 3061 - Remedies Cumulative:

All remedies prescribed by this code or allowed by law, shall be
cumulative and the use of one or more remedies by the City of Ukiah shall not
bar the use of any other remedy for the purpose of enforcing the provisions
of this code.
Section 3062 - Penalties for Violation:
It shall be unlawful for any person, firm or corporation to erect,
construct, enlarge, alter, repair, move, remove, convert or demolish, equip,
use, occupy, or maintain any building or structure in the City of Ukiah, or
cause or allow the same to be done, contrary to or in violation of any of the
provisions of any of the model codes herein adopted.
Any person, firm or corporation violating any of the provisions of the
model codes herein adopted shall be deemed guilty of a misdemeanor, and each
such person shall be deemed guilty of a separate offense for each and every
day or portion thereof during which any violation of any of the provisions of
the model codes herein adopted is committed, continued or permitted, and
upon conviction of any such violation such person shall be punishable by a
fine of not more than $500.00, or by imprisonment for not more than
six months, or by both such fine and imprisonment.
SECTION 2. This ordinance shall be published as required by law in a
newspaper of general circulation published in the City of Ukiah.
SECTION 3. This ordinance shall become effective 30 days after its
adoption.
