AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF UKIAH AMENDING DIVISION 5,
CHAPTER 1 OF THE UKIAH MUNICIPAL CODE,
ENTITLED HEALTH AND SANITATION,
ANIMALS GENERALLY, BY ADDING ARTICLE 6,
COMMENCING WITH SECTION 4150, THERETO,
ENTITLED APPLICATION AND ENFORCEMENT
WITHIN CITY LIMITS OF MENDOCINO COUNTY
ANIMAL CONTROL ORDINANCE.

THE CITY COUNCIL OF THE CITY OF UKIAH does hereby
ordain as follows:
SECTION ONE:
Article 6 is added to Division 5, Chapter 1 of the
Ukiah Municipal Code, entitled: APPLICATION AND ENFORCEMENT
WITHIN CITY LIMITS OF MENDOCINO COUNTY ANIMAL CONTROL
ORDINANCE.
SECTION TWO:
Section 4150 is added to the Ukiah Municipal Code
to provide as follows:
Pursuant to Food and Agriculture Code section
30501 the City of Ukiah requests that sections 30801, 30802,
30803, 30804, 30805, 30952, 31105, 31106, 31107, 31152,
31153, 31251, 31252 and 31254 of said Code apply within the
confines of the City of Ukiah in conformity with Mendocino
County Ordinance No. 3332, adopted in 1981, as amended.
SECTION THREE:
Section 4151 is added to the Ukiah Municipal Code
to provide as follows:

Consistent with section 4150 the followin~
sections of the Mendocino County Code, respecting animal
control, including penalty provisions, are hereby declared
to apply within the City limits of the City of Ukiah and to
be enforceable within said limits by duly authorized county
officers and employees: 10.04.040, 10.04.050, 10.04.060,
10.08.010, 10.08.020, 10.08.030, 10.08.040, 10.08.050,
10.12.010, 10.12.040, 10.12.050, 10.12.060, 10.16.010,
10.16.030, 10.16.040, 10.16.050, 10.16.060, 10.24.020,
10.24.030, 10.24.040, 10.24.050, 10.24.060, 10.24.070,
10.24.080, 10.24.090(A), 10.24.090(B). If peace officers or
other personnel of the City of Ukiah enforce any of these
provisions of the Mendocino County Code, they shall
reference the appropriate county code sections in any
citation issued in the enforcement thereof.
SECTION FOUR:
Chapter 3, Division 5 of the Ukiah Municipal Code
is hereby repealed.
Section FIVE:
This ordinance shall be published in a newspaper
of general circulation five days after its adoption under
Section Six of this ordinance.
SECTION SIX:
This ordinance shall become effective immediately
upon its adoption on August 1, 1984, by a four-fifths vote
of the City Council of the City of Ukiah as an urgency
measure.
The adoption of this ordinance as an urgency
measure is necessary for the immediate preservation of the
public peace, health or safety. The City Council of the
City of Ukiah hereby declares that the following facts
constitute the urgency:
1. The County of Mendocino currently provides
animal' control services within the ~Ukiah City limits under a
thirty day extension of a contrac%~which will expire on July
31, 1984. i ~
~ 2. The County of Mendocino will continue to
provide basic animal control services within the~City limits
equal to services provided in the unincorporated areas of
the county as mandated by Division 14 of the Food and
Argiculture Code (commencing with section 30501); provided
the City adopts the ordinance required by section 30501 and
the county is authorized to enforce its dog control and
licensing ordinance within city limits.
3. If county animal control ordinances are
enforced within the corporate limits of the City of Ukiah
conflicting provisions of the city code must be repealed.
4. The City requires animal control services,
including the impoundment of rabid or other dangerous dogs.
The preserVation of those services with no gap in service is
necessary for the protection of the public peace, health and
safety. It is urgent, therefore, that these amendments be
adopted at the City Council's next regular meeting on August
1, 1984, effective immediately.
