ORDINANCE NO. 830
AN ORDINANCE OF THE CITY COUNCIL ~F THE
CITY OF UKIAH ~4ENDING DIVISION 6,
CHAPTER 3, ARTICLES 1 AND 2, AND CHAPTER
6 OF THE UKIAH MUNICIPAL CODE, ENTITLED,
RESPECTIVELY, FIRE PREVENTION CODE AND
OUTDOOR BURNING, AND REPEALING CHAPTER 4,
ENTITLED, FIRES.
THE CITY COUNCIL of the City of Ukiah does'~hereby
ordain as follows:
Section One:
1. UMC section 5200 is amended to read as follows:
Section 5200 - Adoption of Uniform Fire Code, 1982 Edition
The Fire Prevention Code for the City shall be the 1982
Edition of the Uniform Fire Code, including Appendices, I
through VI, inclusive, as compiled and published by the
International Conference of Building Officials and the
Western Fire Chief's Association, Inc. Said Uniform Fire
Code, three copies of which have been filed for use and
examination by the public in the office of the City Clerk,
is hereby referred to, and, except as to omission,
amendments and additions, hereinafter noted, is hereby
adopted and made a part hereof, as if fully set forth in
this article.
2. Section 5201 is repealed.
3. Section 5202 is renumbered Section 5201.
4. Section 5202 is added as follows:
Section 5202 - Enforcement:
1. The Uniform Fire Code (UFC) herein adopted shall be
enforced by the Chief of the Fire Department of the City of
Ukiah and by the regularly employed members of such
department in accordance with UFC sections 2.101 - 4.107.
2. UFC section 2.201 is amended by adding subsections
(c), (d) and (e) thereto as follows:
(c) For the purpose of providing and maintaining
functions necessary for the prevention of fire and for ~he
protection of life and property from fire and panic, there
is hereby established a self-inspection program assuring
that certain B-2 occupancies within the City are inspected
on an annual basis for fire safety.
(d) 1. The Ukiah Fire Department shall deliver, by
hand or by mail, a "Self-Inspection Worksheet" and "Business
and Emergency Record" forms as established from time to time
by said department to each B-2 occupancy within the City on
an annual basis.
2. The owner or manager of said occupancy or person in
highest authority in said occupancy shall be allowed thirty
(30) days from issue date, as noted on the Self-Inspection'
Worksheet, in which to conduct an inspection for fire
safety, correct any deficiencies, complete said forms, and
return completed forms to the Ukiah Fire Department as
directed by the Fire Chief or his designee.
(e) Any person who fails to comply with the
requirements to return said forms duly completed and to
correct the deficiencies noted in said occupancies within
thirty (30) days of the issuance of said forms shall be

guilty of an infraction.
3. Except as expressly provided elsewhere in this
Code, any person, firm, or corporation, whether as
principal, agent, employee, tenant, owner, or otherwise,
violating or causing the violation of any of the provisions
of this chapter, shall be guilty ~of a misdemeanor and upon
conviction thereof shall be punishable hy a fine of not more
than One Thousand ($1,000) Dollars.
5. UMC sections 5211, 5212 and 5213 are repealed.
6. UMC section 5211-5218 shall be identified as
"Unused."
7. UMC section 5219 is amended to read as follows:
Section 5219 - Section 10.309(b)5 is added to said Uniform
Fire Code to read:
Sec. 10. 309(b)5. Adequate Water Supply.
Compliance with the publication "Guide for
Determination of Required Fire Flow" as published by the
Insurance Services Office shall be deemed adequate, except
for the following:
(A) Where water supplies available for fire protection
do not meet the above requirements, buildings equipped
throughout with an approved automatic sprinkler system, or
dwellings and any accessary buildings thereto located at
least twenty (20) feet from a property line, need not
mandatorily comply with the provisions of this section.
(B) Buildings 3 or more stories in height or in excess
of 30 feet in height or that require a fire flow in excess
of 2,000 gallons per minute shall be equipped throuahout
with an approved automatic sprinkler system. For the
purposes of this subsection, dwellings with exterior walls
protected in accordance with the provisions of the Uniform
Building Code need not comply.
8. UMC section 5220 is repealed.
9. UMC section 5221 is amended to read as follows:
UFC section 79.501 is amended to read as follows:
Sec. 79.501 Restricted Locations
The storage of Class I and II liquids in above ground
tanks outside of buildings is prohibited within the
mercantile and other congested district.
10. UMC section 5222 is amended to read as follows:
UFC Section 79.1411 is added to said Code to read as
follows:
Sec. 79.1411 Location of Bulk Plants
No new Bulk Plants shall be constructed within the City
limits of the City of Ukiah.
11. Chapter 4 of Division 6 (UMC sections 5300, 5301,
5302 and 5303) is repealed, and shall be identified as
"Unused."
12. UMC section 5500 is amended to read as follows:
Section 5500 - Repealer:

UFC Section 11.101, 1982 Edition, is repealed and the
regulations of this chapter govern outdoor burning.
13. UMC section 5505 is amended as follows:
Section 5505 - Penalty for violation:
Any person, firm, or corporation, whether as principal,
agent, employee or otherwise, violating or causing the
violation of any of the provisions of this chapter, shall be
guilty of a misdemeanor and upon conviction thereof shall be
punishable by a fine of not more than Three Hundred
($300.00) Dollars or by imprisonment in the County Jail for
a term not exceeding ninety (90) days, or by both such fine
and imprisonment.
Section 2:
This Ordinance shall be published as required '~v law in
a newspaper of general circulation published in the City of
Ukiah.
Section 3:
This Ordinance shall become effective 30 days after its
adoption.
