B25 .\:,l ORDINANCE OF THE CITY COUNCIL OF THE CiTY OF UKIAH PROPOSING A SPECIAL TAX FOR CAPITAL iMPROVEMENT ON THE AIRPORT ~F THE CITY OF b"KIAH, SUBJECT TO THE APPROVAL OF TWO-THIRDS OF THE VOTERS ...,~i,IG r~on~,,,,,~., THE PROPOSAl, WITHIN TIlE ,~: OF I~KIAH. THE C:_.z oO~NCIL OF THE CITY OF b~IAH DOES ORDAi~i AS FOLLOWS: / Section !. In accordance with Article XIIIA, Section 4 of the (ixiifornia Constitution and Section 50077 of the Government Code a special tax shall take effect upon approval of two-thirds of the voters voting upon the oroposed soeciai tax at the June 5, 1984, general municiual election. Section 2. The proposed special tax shall be calculated from the l-:endocino County Assessor's records by parcels and land use, as follows: LAND USE [a) Vacant, equals: 1 (b) Single family residential, mobilehome on individual lot, rural, church and institutional recreation, duplex, equals: 2 (c) Apartment, trailer park equals: 4 [d) Retail, office, service, mortuary, hospital, rest- home, industrial, general commercial or industrial, BENEFIT UNITS TAX PER PER YEAR BENEFIT INIT PER PARCEL I1.25 11.25 11.25 22.50 11.25 45.00 equals: 10 11.25 112.50 ('e) Shopping center 15- 11.25 168.75 ~{ection 3. Vhe City Council of the City of ~'kiah si~a[i assess and collect the soecial ~ax provided in Section I only if the Federal ,\viation Administration (?:L~) accepts the nending proposal to locate a regional flight center at the Ukiah ~'Iunicipal Airport and the City Council determines to construct a building to FAA specifications to house said flight center ~t ~ nominal rental cost to the ~AA. Said tax shall cease to be effective in the City of Ukiah, :~hen ~he costs ()f financing and constru~, :;aid building have been paid in full, which in no event shall exceed a period of 166 (I0) ten ~'ears. >;ection 4. 7he C£tv q'ouncil of the City of Ukiah r.~av collect !ess than the amount of the -nppro~ed .~pecial tax. Section 3. ~se apDroved SPTM ~tax shall be collected in the ~ame · manner and subject to the ~;ame penalty as other char~es and taxes collected by the County of ~[endocino on behalf of the City of Ukiah. Section ~. If any nrovisions' of this Ordinance or the application thereof to any person or circumstances is held invalid, suc~ invalidity shall not affect any other provision or applications, and to this end provisions of this Ordinance are declared to be severable. Section 7. This Ordinance shall become effective immediately upon its adoption by a four-fifths vote of the City Council of the City of Ukiah as an urgency measure, although the authorized tax shall become effective only upon the conditions provided in sections I and 3 of the Ordinance. '~rhe adoption of this Ordinance as an urgenc,,, measure is necessary for the immediate preservation of the public peace, health or safety. The City Council of the City of Ukiah hereby declares that the followinz facts constitute the urgency: i. The City of Ukiah has submitted a proposal to the ~,' [-~ under which the City would provide facilities to house a regional flight center.at nominal cost to the F~. 7he provision of these facilities at a nominal rent has been determined as necessary to comoete with proposals submitted to the F~'~ by 7an Francisco Bav Area cities, if the regional flight center ~ere located at the Ykiah Airport, it would bring approximately 100 highly ~aid ~obs into the City and additional projected income into the City. It is estima[ed that these additional jobs and income would in turn generate ~00 additional, desperately needed jobs in the local economy and would ~ubstantiaily enhance the local tax base. £. in order for the FAA to act upon the proposal the voters must apprcve the proposed special tax at the June 5, 1984, general municipal ~i,.~ction. 5. To qualify for placement on the ballot for that election the qrdinance must be adopted at the February 1, I984, regular City Council ~eeting for submission to the Mendocino County Elections Department bv ~',~i)ruar7 ], [984.
