ORDINANCE OF THE CITY COUNCIL OF
UKIAH AMENDING DIVISION 1, CHAPTER
5, ARTICLE 1 OF THE UKIAH CITY
CODE - CIVIL SERVICE
PREAMBLE:
WHEREAS, on July 7, 1982, the City Council of the
City of Ukiah in Resolution No. 83-1, as required by
Elections Code section 17111, declared the results of the
General Municipal Election held and conducted on June 8,
1982, and resolved that Measure B on the ballot in said
election passed, and
WHEREAS, Measure B was a ballot proposition duly
submitted to the voters of the City of Ukiah by the City
Council of the City of Ukiah as provided in Elections Code
section 4017, and
WHEREAS, Measure B requires the amendment of the
Civil Service Ordinance of the City of Ukiah to withdraw
City department heads from the Civil Service System;
provided, however, existing department heads as of the date
of such amendment shall not be affected thereby but shall
continue to hold their offices or employment according to
their existing term of tenure; and
WHEREAS, under Elections Code section 4013, a
proposed ordinance submitted to the voters under Elections
Code Section 4017, shall be considered as adopted upon the
date that the vote is declared by the legislative body, and
shall go into effect 10 days after that date.
NOW, THEREFORE, the City Council of the City of
Ukiah does ordain as follows:
SECTION 1. Section 1302 of the Ukiah City Code is amended
to read as follows:
Section 1302 - Classified Service:
Provisions of this article shall apply to all
appointive officers and employees of the City of Ukiah who
are full time employees of the City of Ukiah, California,
except that the provisions of this article shall not apply
to City department heads appointed to their positions on or
after July 17, 1982.

SECTION 2. This ordinance shall be published in a newspaper
of general circulation five days after its adoption under
SECTION 3 of this ordinance.
SECTION 3. This ordinance shall'become effective
immediately upon its adoption by a four-fifths vote of the
City Council of the City of Ukiah as an urgency measure.
The adoption of this ordinance as an urgency
measure is necessary for the immediate preservation of the
public peace, health or safety. The City Council of the
City of Ukiah hereby declares that the following facts
constitute the urgency:
1. Due to the retirement of two department heads
and the creation of a new position, Director of Electric
Utility, the City of Ukiah has had to fill three positions
for City department heads, Fire Chief, Director of Public
Works and Director of Electric Utility.
2. The Fire Department has been without a regular
fire chief since May of 1982 and the ability of all three
departments to fulfill their responsibility to serve the
health and safety needs of city residents is greatly
impaired in the absence of regularly appointed directors.
3. The City of Ukiah has selected highly
qualified applicants to fill all three vacancies to meet
these departments' needs for leadership. All three
appointments are effective September 12, 1983.
4. At the same time the voters have mandated,
effective July 17, 1982, that all newly appointed department
heads shall be excluded from the City's Civil Service
System. In order to insure that the voter's mandate becomes
fully implemented and provide the timely and effective
leadership to these city departments which is vital to the
health and safety of City residents, it is urgent that this
ordinance become effective at the September 7, 1983, regular
meeting of the City Council of the City of Ukiah.
