HomeMy WebLinkAbout813ORDINANCE NO. 813 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UKIAH AMENDING DIVISION 9, CHAPTER 2 OF THE CITY OF UKIAH ZONING ORDINANCE - SECOND UNITS IN THE R-1 ZONE 109 The City Council of the City of Ukiah does Ordain as follows: SECTION I. Section 9017 (k) is added to the Zoning Code to read as follows: SECTION 9017 - The following uses may be permitted subject to first securing a use permit in each case: (~) Second units as prescribed in Section 9024 and defined in Section 65825.2(d) of the State of California Government Code. SECTION 2. Section 9024 is added to the Zoning Code to read as follows: SECTION 9024 - Second Units In Single Family Residential (R-I) Districts, second units may be allowed with an approved use permit subject to the following minimum criteria: (a) One of the units on the parcel must be occupied by the property owner. (b) The second unit shall only be used for rental purposes. (c) The construction of a new unit or alteration of existing structures shall be considered by the Planning Commission during the use permit process and have design continuity with existing homes in the neighborhood. (d) The minimum lot size upon which a second unit may be placed is 6,000 square feet. (e) Parking requirements for the second unit shall be one off-street independently accessible parking space. (f) The second unit must meet all applicable building and fire codes, and zoning setback and yard requirements per Sections 9020 and 9021. The unit shall have electric, water and sewer service provided through the City with the type of meter arrangement at the property owner's option. (g) In any event, a second and/or separate entrance to the new unit is required. 110 (h) This provision is applicable to all existing second units as well as those proposed after the effective date of this ordinance. Existing units must have an approved use permit to be considered as a legal'use. ,, (i) The maximum size of a new unit or addition to an existing structure for the purpose of rental as prescribed here is 660 square feet for a 6,000 square foot lot or 11% of the lot size for larger parcels. (j) Mobile homes are explicitly precluded for use as a second unit. (k) These regulations do not allow 'the division of property upon which a second unit is located unless all requirements of the R-1 zoning district are met. (1) The rental unit shall be limited to two occupants. (m) Any home constructed after the effective date of this ordinance is ineligible for the creation of a second unit. SECTION 3. This ordinance shall be published as required by law in a newspaper of general circulation published in the City of Ukiah. SECTION 4. This ordinance shall become effective 30 days after its adoption.
