HomeMy WebLinkAbout78-55RESOLUTION NO. 79-55 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ADOPTING REGULATIONS AND PROCEDURES TO COMPLY WITH THE REQUIREMENTS OF THE NATIONAL FLOOD INSURANCE PROGRAM 4 6 8 9 10 WHEREAS, the City of Ukiah is participating in the National Flood Insurance Program, and WHEREAS, this program makes low cost flood insurance available to residential and commercial properties within the city limits, and WHEREAS, the purpose of the program is to reduce flooding within the city limits, and WHEREAS, the Federal Insurance Administration has estab- lished certain regulations for communities participating in the program, 11 12 NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby adopt the following Flood Plain Managemen{ Regulations and Procedures: 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 $0 81 1) The Department of Community Development will notify the Administrator of the Flood Insurance Administration in writing whenever the boundaries of Ukiah have been modified, by annexation. -- ' 2) The Director of Community Development is herebv designated as the official responsible to submit the annual report required by Federal Insurance Administration regulations. 3) The Department of Community Development and Planning Commission shall review all proposed developments to assure that all necessary permits have been received from those governmental agencies from which approval is required by federal or state law. 4) The Department of Community Development shall review all permit applications to determine whether proposed building sites will be reasonably safe from flooding. If a proposed building site is in a flood prone area, all new construction shall be designed and adequately anchored to prevent flotation, collapse, or lateral movement of the structure and shall also be constructed with materials and utilize equipment resistant to flood damage and be constructed by methods and practices that minimize flood damage. 5) The Department of Community Development and the Planning Commission shall review subdivision proposals and other DroDosed new developments to determine whether such proposals wil~ b~ reasonably safe from flooding. If a subdivision proposal is in a flood prone area, then all such proposals will be reviewed to assure that they are consistent with the need to minimize flood damage. 6) The Public Works Department, in constructing water and sewer systems in flood prone areas, will design these systems 82 _ ~__ 1 8 4 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 $0 81 82 to minimize infiltration of flood waters into the system and to eliminate or minimize discharge of sewage into flood waters. 7) The Planning Commission shall reauire that all sub- division proposals and other new developments greater than 50 lots or five acres shall include base flood elevation data with their proposal. The Department of Community Development is directed to utilize all'available flood elevation data to insure that all new construction will have the lowest floor elevated to or above the base flood level. 8) For all new construction within Zone A, of the City of Ukiah Flood Hazard Boundary Map, the Department of Community Development shall obtain the elevation of the lowest habitable floor and maintain a record of this information. 9) The Department of Public Works shall notify the appro- priate state and federal officials as well as adjacent communi- ties in the event any alteration or relocation of a water course is planned within the city limits. 10) The Public Works Department shall insure that in any project that will alter or relocate any water course that the flood carrying capacity is not diminished. 11) The Department of CoMmunity Development shall require that all mobile homes placed within Zone A, of the City of Ukiah Flood Hazard Boundary Map, shall be anchored to resist flota- tion, collapse, or lateral movement and shall see that mobile homes constructed in Zone A, of the City of Ukiah Flood Hazard Boundary Map, shall meet further tie down requirements of the Federal Insurance Administration. 12) The Department o.f Community Development shall see that prior to approving any mobile home Dark or mobile home sub- division in Zone A, of the City of Okiah Flood Hazard Boundary Map, that an evacuation plan is filed with the State Disaster Preparedness Office. ~3) The Planning Commission is directed to review and evaluate the standards for an overall, comprehensive management plan contained in Section 1910.21 of the Federal Regulations Governing Flood Insurance Program and to make a report on their findings and recommendations within six months to the City Council.
