PASSED AND ADOPTED this 21st day of September, 1977 by the following roll call vote: AYES: Councilmen Brannon, Wood,-Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None ATTEST: 20 liCITlY CLERK 21 23 25 26 27 30 31 32 DRAFT -- 22 June 1977 CITIES - COUNTY AGREEMENT FOR DISTRIBUTION OF FEDERAL-AID FOR SAFER OFF-SYSTEM ROADS FUNDS (SOS FUNDS) COUNTY OF MENDOCINO THIS AGREEMENT, executed by the Board of Supervisors of !Iendocino County this day of , 1977, by and between the County of Mendocino, a political subdivision of the State of California, hereinafter referred to as "COUNTY" and four incorporated cities within Mendocino County, acting as independent parties, hereinafter referred to as "CITIES" WITNESSETH WHEREAS, under the provisions of Title 23, Unit'ed States Code, and other Federal-Aid. Highway Acts, federal funds are authorized to be appropriated ~r expenditure on rural, and urban roads not on a Federal-Aid System; and federal funds have been, and will be in the future, appropriated for such expenditures; and WHEREAS, in accordance with applicable State Law federal funds have been, and will be in the future, apportioned to Mendocino County for construction of Federal~Aid Off-System road projects selected by COUNTY or CITIES in cooperation with the State of California Department of Transportation; and WHEREAS, under the provisions of State Law distribution of Federal- Aid Off-System funds amoung the cities within each county and ~he county shall be determined by agreement between the county and a majority of the cities, which cities shall include a majority of the minicipal population within the county. NOW, THEREFORE, the parties hereby agree as follows: Federal-Aid for Safer Off-System Roads funds (SOS Funds) appro- priated each fiscal year for road construction projects in Mendocino County shall be apportioned between CITIES and COUNTY as follows: 1. Two-thirds of the total allocation according to the following formula (A) One-third in the ratio which the area of each entity bears to the total area of the County. (B) One-third to COUNTY representing the rural population in the unincorporated area of the County. (C) One-third in the ratio which the off-system maintained road mileage of each entity bears to the total off- system maintained road mileage in the County. 2. One-third of the total allocation in the ratio which the population of each entity bears to the total population of the County. In Lieu of its apportionment of Federal-Aid funds each city, acting independently, may, at its option, elect to accept a direct payment from COUNTY. The amount of the "in lieu"payment shall be seventy-five (75) percent of the city's apportionment of the Federal-Aid for Safer Off-System Roads funds allocated for expenditure in Mendocino County. Said "in-lieu" payment shall be made unconditionally by COUNTY upon receipt of written notice from a city requesting the "in-lieu" payment. No payment shall be made to CITIES, pursuant to the provisions of this paragraph, until COUNTY has been advised in writing that the applicable federal funds have been allocated and are available for expenditure by COUNTY. Any parties to this agreement, acting independently, may elect to combine their respective apportionments of Federal-Aid funds for the purpose of constructing a project beneficial to the entities involved. Combining of apportionments for a particular project shall be accomplished by separate agreement between the entities desiring a jointly funded project. Within 60 days of COUNTY being advised that Federal-Aid Off- System funds have been appropriated for expenditure in Mendocino County, COUNTY shall advise each city within the county of ~he total amount of the allocation and the amount of each city's apportionment determined in accordance with the terms of this agreement. Within 60 days of receipt by each city of said notice, each city shall advise COUNTY whether or not it wants to claim its apportionment or accept the "in-lieu" payment as provided for above. In order that COUNTY may administer this agreement each city shall, during the month of January each year, submit to COUNTY the following information: 1. Population of the .city. 2. Approximate land area within the city incorporated area. 3. Total number of miles in the city maintained street system. 4.. Total number of miles of city maintained streets within a Federal-Aid System. The Mendocino County Department of Public Works shall be responsible for the administrative procedures required to .. implement the provisions of this agreement. All correspondence or reports to be furnished to COUNTY by CITIES shall be submitted to the Mendocino County Department of Public Works. IN WITNESS WHEREOF, the parties have executed this 'Agreement by their duly authorized officers on the date indicated.
