PASSED AND ~DOr~?um thi ~' o~ , ~ s 3rd da.;: ~ust 197'7~ h~ 'ti~e following roll call vote~ AYES: Councilmen Braunou, Feibusch, Councilwoman Sa~der, Mayor Simpson None ,~3bENT' Councilman Wood 7/22/77 AMENDMENT TO NORTHERN CALIFORNIA POWER AGENCY JOINT POWER AGREEMENT This agreement by and among the parties signatory hereto hereinafter called "Parties" witnesseth: WHEREAS, each of the Parties has heretofore executed an agreement made July 19, 1968, and subsequently amended and reVised, to create .the Northern California Power Agency hereinafter called "the Agreement"; and WHEREAS, the Parties desire to amend the Agreement further; now therefore the Parties do agree as follows: Section 1. Section 4.5 of the Agreement is amended to read as follows: "4.5 The treasurer of the Agency shall be the Treasurer of the City of Palo Alto, who shall be the depository and have custody of all the money of the Agency from whatever source. The Controller of that City shall be the Controller of the Agency who shall draw warrants to pay demands against the Agency when the demands have been approved by the Commission. The Treasurer and Controller shall comply strictly with the provisions of the statutes relating to their duties found in Chapter 5, Division 7, Title 1 of the Government Code, beginning with Section 6500. The Treasurer of the Agency and the Con- troller of the Agency herein designated.as the persons responsible for any moneys of the NCPA are hereby also '4 designated as responsible for all other property of the NCPA. The Controller and the Treasurer shall each file an official bOnd in the amount determined from time to time by the Commission." Section 2. This amendment shall take effect upon the date of the last execution of it by the parties.
